There is a new article talking to her attorney- He says "She is under a lot of pressure having this hanging over her head".

I'll have to go look for that but just from the title alone I would say that the defendant and her attorney's are not doing themselves any favors by treating these charges as nothing more than a nuisance in her life. They are paid to be confident in themselves of course, but given their client is using a stillbirth as a defense and yet she had zero medical training and zero experience with birth to make that determination if the 1% chance that that happened, they really shouldn't be considering this an open and shut case.

She knew she was pregnant but would not know the baby would be in the 1% of stillborns yet somehow the only defense that would work to find her not responsible for the death of this baby is supposed to be exactly what coincidently happened? And in addition to that perfectly played out scenario, as a first time giving birth it also just so happened that she labored, delivered, had the state of mind to come up with the spontaneous plan to go get a shovel, dig a grave (having just given birth she was able to repeatedly put a foot on a shovel and press firmly into the earth and remove it), bury the conveniently stillborn baby, clean up the bathroom of all the blood and fluid, and go back to bed all inside what just so happens to be the sleeping hours of the night for everyone else so it went undetected. No, unfortunately I have no reasonable doubt whatsoever once all the pieces have been so perfectly placed in this puzzle. No wonder she feels this trial is such an inconvenience, apparently she is the only person on the planet who can perfectly script every moment of their lives.

"...After months of appeals, a conference is scheduled for Monday morning in Judge Donald Oda II’s courtroom in the case of Brooke Skylar Richardson....

After the meeting in chambers, defense attorney Charlie Rittgers confirmed the Sept. 3 trial date....

Last week, the Ohio Supreme Court denied a motion to reconsider the defense’s appeal of a doctor-patient privilege issue in the case....

Richardson, now 19, is charged with aggravated murder, involuntary manslaughter, gross abuse of a corpse, tampering with evidence and child endangering in death of her infant daughter. She is free on bond.

The appeals court ruled that physician-patient privilege doesn’t apply in the case and that the teen’s conversations with two doctors should be admitted as evidence in her upcoming trial...."

*Status Conference Hearing (@ am ET) - OH - A few hours old baby girl Annabelle “Baby Jane Doe” (May 6 or 7, 2017, Carlisle) - *Brooke 'Skylar' Richardson (18) accused/indicted on multiple felony charges including aggravated murder (special felony), involuntary manslaughter (1st degree felony), endangerment of child (3rd degree felony), tampering w/evidence (3rd degree felony), & gross abuse of corpse (5th degree felony)/allegedly killing, burning & burying her newborn baby in backyard of her Carlisle home. Free on $50K bond.
Trial starts 9/3 to 9/13/19.

4/18/19 Update: The Ohio Supreme Court today (4/18/19) denied a motion for reconsideration of an appeal filed by the defense team. Status conference hearing on 4/23.
4/23/19 Update: No hearing today. Attorneys & Judge met in chambers & confirmed Sept. 3 trial date. Next Pretrial hearing on 7/1.
 
The attorneys and prosecutors are to meet today with the judge to confirm both sides are on track for the scheduled Sept. 3 trial.

The defense plans to file additional motions before the trial.

Glad there is no plea deal. With all of the delays the defense has caused there shouldn't be any deals. Lets move on with the trial! jmo imo moo

"...After months of appeals and meetings between attorneys in judge’s chambers, Brooke Skylar Richardson was in Judge Donald Oda II’s courtroom for a brief hearing. Her trial is scheduled to begin Sept. 3.

Richardson’s attorneys, Charles H. Rittgers and Charles M. Rittgers, and Assistant County Prosecutor Steven Knippen agreed during the hearing that there had been no plea offers for the defendant, who is now 19.

A pre-trial hearing was set for Aug. 19.

The defense said it plans to file additional motions before the trial but did not say what they might be....

Now she wants 3 seperate trials.....

Richardson is charged with aggravated murder, involuntary manslaughter, endangering children, tampering with evidence and abuse of a corpse.

The defense team is requesting that the court order one trial for the aggravated murder charge, one trial for involuntary manslaughter and endangering children charges and a third trial for tampering with evidence and abuse of corpse.

The defense argued the prosecution has admitted it does not intend to keep it presentation of each offense “simple and direct.”

Letting the defendant have 3 separate trials....is new to me. Has it ever been done before? What trials and what was the outcome?

Is the defendant asking for special rulings?

Sorry - haven't read another trial that had separate trials for each charge....

Did this doctor give her OPTIONS?
Did this doctor give her phone numbers for adoption agencies?
Did this doctor give her the information for DCFS?
Did this doctor tell her about the Safe Haven Law?
Did this doctor tell her there were two baby boxes in her state? (2 hour drive but still.)

What options did she feel she had when she left that doctor's office?
Did she KNOW that she could have that baby at home alone, clean everything up, take her to the hospital or fire station or baby box and leave her without any consequence?
DID THE DOCTOR TELL HER THAT?
That's what I want to know. Because if the doctor DID give her some or all of those options, there is no excuse for what she did. She knew of other options. Common sense should tell you there are other options, but if she was actually told them that's a whole other story.
 
Family members explained that Richardson, who is short and petite, has struggled with eating disorders through her teen years. While on the cheerleading team at Carlisle High School, she was generally one being tossed in the air for stunts. The family shared pictures of Richardson in which she is “scary skinny” and then when she was “curvy.”

When she began putting on weight this past year, family members were relieved that she was healthy and were hesitant to comment or inquire further. Everyone admired how “curvy” and “beautiful and radiant” she looked in her prom dress.

About the prom dress, Vanessa now admits, “In hindsight she does have a bump. We are hating ourselves for that now. But at the time, we just thought she was eating good and not making herself throw up.”

The family believes the amount of time Fornshell spent discussing the case with reporters and on social media has tarnished Richardson’s reputation irreparably before the trial even begins.

“I think it is extremely unprofessional for the prosecutor to tweet and Facebook share news of the case. He has made the public think that [Richardson] is a terrible person and she’s not,”
says Jay. “All this publicity will hurt her. All our lives, we have been a family who have worked hard at our jobs and built stable lives. We have solid reputations and now everyone just looks down at us.”

“It’s a game to them,” says Vanessa. “They just want to win.”


Family Sheds New Light On Brooke Skylar Richardson Case

I have to agree with them on the prosecutor. I've never seen a prosecutor post about cases on social media before.

So much for the medial privacy argument:

I'm not understanding how they mistakenly thought the baby had been burned? Isn't that something that would be first identified visually then more closely with testing and such? Like was there an abrasion or lesion or something to give the impression of having been burned? Having loosely followed this story I guess I took it as a given that the burning happened, but what a weird detail at all and particularly weird to be incorrect.

You know this bothers me. It's a huge detail to be wrong about. It reminds me of this case where the father is charged with rape and the autopsy shows no rape! It's flabbergasting to me... like you'd think that would be one of those things that would leave definitive proof!

However, with that said I think that the abuse of a corpse charge might still apply here even without the burning.
