Testimony to continue against Mt. Lebanon man accused of killing his infant

Mr. Gazzam pleaded guilty in April to a general count of homicide. On Monday, the prosecution began presenting evidence at a degree-of-guilt hearing, after which Allegheny County Common Pleas Judge Randal B. Todd will determine whether he is guilty of first-degree murder, third-degree murder, voluntary manslaughter or involuntary manslaughter.

Ms. Walter testified Monday that the couple’s relationship, which began in 2015, was “like a roller coaster.” She said Mr. Gazzam had a history of cocaine use, adding that he bought cocaine and drank a 12-pack of beer the night before their daughter’s death.

Ms. Walter’s brother, 17-year-old Zach Walter, testified that when he was first alerted to the incident by police entering the home, he found Mr. Gazzam in a “very emotional” state.

“He was crying, sobbing,” he said.

The hearing resumes Tuesday morning.

Judge mulling degree of guilt for Mt. Lebanon man accused of killing his infant

In an Allegheny County courtroom Tuesday afternoon, Assistant District Attorney Alison Bragle placed a baby doll on her podium.

Addressing Common Pleas Judge Randal Todd, she struck it five times with a closed fist, imitating what prosecutors say happened to Joseph Gazzam’s 4-month-old daughter on the morning of her death.

“After that first blow, your honor, you have formed the specific intent to kill,” Ms. Bragle said.
[.....]
Arguments in a hearing to determine the degree of Mr. Gazzam’s guilt concluded Tuesday, and Judge Todd is currently mulling a verdict, with options ranging from third- or first-degree murder to voluntary or involuntary manslaughter.

Anyone hear any news on verdict? Or is the Judge still mulling it over....
