A New Hampshire prep school graduate convicted of sexually assaulting a 15-year-old classmate as part of a competition among upperclassmen was released from jail Monday for good behavior.

Owen Labrie, 23, was sprung around 8:30 a.m. from Merrimack County’s jail — 10 months ahead of his scheduled release date.

“Owen is happy to be home with his family. He will be settling in and working on rebuilding his life,” his lawyers told ABC News. “He’d like to thank the friends and family that have stood by him and supported him all these years.”

Labrie was acquitted of raping the female classmate in 2015 at the exclusive St. Paul’s School but convicted of misdemeanor sexual assault charges and endangering a child’s welfare. He was also found guilty of using a computer to lure an underage student for sex.

Former student released from jail over good behavior in sex assault case

Owen Labrie's attorney confirmed to ABC News that he was released from Merrimack County’s jail Monday morning after nearly six months. He was serving the remaining 10 months of his sentence, The Associated Press reported.

In October 2015, Labrie was sentenced to 12 months in prison. A judge suspended that sentence and Labrie was freed on bail under curfew at the home of his mother in Tunbridge, Vermont, while Labrie appealed the decision. In March 2016, the court revoked his bail after prosecutors accused him of missing his court-ordered curfew several times.

Earlier this month, the New Hampshire Supreme Court denied Labrie's appeal to have a new trial based on ineffective counsel.

Labrie, 23, was serving the remaining 10 months of his sentence at Merrimack County’s jail. He had completed nearly six months.
 
Prep school grad linked to sex assault free on good behavior

His release comes more than two weeks after the New Hampshire’s Supreme Court denied his request for a new trial.

In its 3-0 ruling, the court dismissed arguments that Labrie’s trial lawyers were ineffective for failing to mount a defense against the computer charge.

The lead trial lawyer, J.W. Carney Jr., is a well-known defense attorney whose clients included the late Boston gangster James “Whitey” Bulger.

After the trial, Carney unsuccessfully asked a judge to set aside the guilty verdict on the computer charge. It never occurred to him before the trial, he said, that it was an issue worth exploring.

Last year, the same court upheld his convictions on the computer charge. The court dismissed arguments by Labrie’s lawyers that prosecutors failed to prove intent in his use of the computer and that the law was meant to be used to target sexual predators and pedophiles combing the internet, not in cases like this.

A judge allowed Owen Labrie to walk out of the Merrimack County courthouse Tuesday without handcuffs, giving him the chance to celebrate Christmas at home before heading back to jail to serve the remainder of his 12-month sentence.

The St. Paul’s School graduate must report the morning of Dec. 26 to the Merrimack County jail in Boscawen, where he previously served 63 days of his sentence for repeatedly violating his bail conditions in the sexual assault case. In the 947 days since his release, Labrie has been on electronic monitoring at his family’s Tunbridge, Vt., home, where he has worked with several attorneys to file two appeals in the state’s highest court and to ask for a reduction of his one-year sentence.

The New Hampshire Supreme Court recently upheld Labrie’s felony conviction for using a computer to solicit sex from a 15-year-old classmate, but has yet to rule on his claims of ineffective counsel. Labrie was delivered a second blow Tuesday when the trial court judge denied his request for a reduced sentence that would have meant no further jail time.

“I think given the crimes and the circumstances that it’s just not appropriate to amend the sentence at this time,” Judge Larry Smukler ruled.

He also denied the defense’s request for Labrie to be allowed out of jail on work release.

As the high court’s decision in his last appeal looms, Labrie, now 23, will begin serving the roughly 10 months he has left of a 12-month jail sentence that was handed down more than three years ago.

ETA: He was convicted and sentenced more than 3 years ago. Since then, he continued to live as though rules didn't apply to him -- violating his probation/curfew numerous times.

And he still got out early -- to remind us of his privileged life.... pft.
