New charges filed against woman who locked boy in basement
ACKLEY, Iowa — New charges have been filed against an Iowa woman convicted on charges related to locking her boyfriends son under basement stairs.

Trial started 2/5/19. 4/10/19 found guilty of false imprisonment & not the 1st or 3rd degree kidnapping charges. Authorities allege Alex Craig Shadlow, 30, and his fiancé, Traci Lynn Tyler, 40, kept the then 8-year-old boy in the locked area behind the stairs as punishment and withheld bathroom breaks in 2017. Prosecutors allege the treatment amounted to torture and kidnapping.
Shadlow’s trial is scheduled for August, and the defense has hired a clinical psychologist as an expert witness it says needs to evaluate the child.
Prosecutors are challenging the move, saying the court doesn’t have the authority to order the child to comply with a psychiatric examination.
Shadlow’s jury trial is scheduled to take place at the Dickinson County Courthouse in Spirit Lake following a venue change. He is charged with kidnapping and child endangerment.
Tyler was tried on the kidnapping charge in a February bench trial and was found guilty of a reduced charge of misdemeanor false imprisonment. Prosecutors then added a child endangerment charge based on the same incidents.
Her attorneys are fighting the endangerment charge, asking it be thrown out on double jeopardy grounds.
“The common law principle of double jeopardy prevents any person from being twice put in jeopardy for the same offense,” defense attorney Jennie L. Wilson-Moore wrote in a motion challenging the charge. “The state is attempting another bite at the apple after not receiving a felony conviction following the first trial involving this offense, while using the exact same evidence presented at trial on the prior offense.”
Tyler’s second trial, this time in front of a jury, is tentatively scheduled for July, and she is seeking a change of venue to remove the trial from the Hardin County area.

Insult to injury. The "defense" gets to choose their own "expert" for an evaluation of the abused child. I am sure that it will be completely unbiased.

5/13/19 Update: Attorneys appointed. Plead not guilty. Next pretrial hearing on 7/8. Scheduled to stand trial at 9 a.m. Tuesday, July 16, on a Class B felony charge of enhanced child endangerment. And his request for a jury trial & jurors will be scheduled to hear that case at 9 a.m. Monday, Aug. 12, at the Dickinson County Courthouse in Spirit Lake.

6/26/19 Update: Defense is asking the court for an independent medical evaluation of the boy ahead of Shadlow's upcoming trial. Defense has hired a clinical psychologist as an expert witness it says needs to evaluate the child. Prosecutors are challenging the move, saying the court doesn’t have the authority to order the child to comply with a psychiatric examination. Hearing set for 7/1. And pretrial hearing on 7/22. 7/1/19 Update: Motion to withdraw from counsel (6/27/19). Next hearing on 7/8

5/28/19 Update: Tyler was tried on the kidnapping charge in a February bench trial and was found guilty of a reduced charge of misdemeanor false imprisonment. Prosecutors then added a child endangerment charge based on the same incidents. Her attorneys are fighting the endangerment charge, asking it be thrown out on double jeopardy grounds. And is seeking a change of venue to remove the trial from the Hardin County area. Motion to dismiss & Change of Venue motion will be heard on 7/8 @ 1:30pm. Order for continuance will also be heard on 7/8 @ 9:30am.

Plead not guilty. $500K cash only bond. **Hardin County moved to Cerro Gordo County Case #FECR311202 Trial started 2/5/19. 4/10/19 found guilty of false imprisonment & not the 1st or 3rd degree kidnapping charges. Bond was reduced to $1500, cash bond posted on 4/10/19. 4/26/19: Was sentenced Friday to up to a year in jail. Because Tyler served 266 days in jail before her conviction, she may only serve another three months. That time could be reduced for good behavior. She was fined $315.

An Iowa couple accused of confining an 8-year-old boy beneath a basement staircase has pleaded guilty to felony charges.
Alex Craig Shadlow, 31, pleaded guilty Monday to one count of third-degree kidnapping and two counts of child endangerment causing serious injury. Traci Lynn Tyler, 40, pleaded guilty Monday to three counts of child endangerment causing serious injury, court records show.

The slippery slope here, if the defendant is allowed to include a court ordered psychological evaluation of the child/victim of this crime, what is to stop, say a rapist, from demanding a psychological evaluation of their victim to be mandated, and included in the court case?
