"A JUDGE will rule on Monday if the editor of a newspaper is guilty of contempt of court over the publication of a front page story on the Ana Kriegel murder trial.

The article was published in the Irish Daily Mail on May 3, 2019, and bore the headline "CCTV shows Ana being led to her death".

It appeared over a report of the previous day's evidence when CCTV footage was played to the jury showing the two defendants, known as Boy A and Boy B, and 14-year-old Ana in the park on the evening she disappeared.

The publication of the article led to an, albeit brief, reporting ban on the entire trial.

The ban was reversed on the same day it was imposed, but Mr Justice Paul McDermott ordered that the ban continue in the case of the Irish Daily Mail (IDM)."

I feel so so sorry for them, they now have months to wait to relieve themselves of that weight, October is a long way away, should have been sooner. I suspect that they are sourcing in external experts from overseas as I don't believe there are any experts on this island who can give the evaluations that the Judge asked for.

Prosecution counsel Brendan Grehan SC said that there were aspects of the reports prepared on the boys, known as Boy A and Boy B, what he referred to as "the narrative of events" which was relative to their co-accused.

Mr Grehan said it was proposed that "those specific parts" ought to be disclosed to the respective parties.

Sentencing due for boys convicted of Ana Kriégel murder

A sentencing hearing is due to take place this morning for the two teenage boys convicted of murdering 14-year-old Ana Kriégel in May last year.

The two boys, who are now 15 years old, have been in detention since their convictions earlier this year.

The teenagers, known as Boy A and Boy B, were convicted of murdering Ana in a derelict farmhouse in Lucan on 14 May 2018.

Boy A was also found guilty of aggravated sexual assault.

The boys were not sentenced to the mandatory term of life in prison for murder because of their age. Instead they were remanded to Oberstown Detention Centre to allow reports to be prepared.

Mr Justice Paul McDermott said he was seeking "professional assistance" in a case he described as "very difficult".

Psychiatric and psychological assessments have now been carried out.

This morning the judge will hear evidence of those reports and he will also hear victim impact statements prepared by members of Ana's family.

He is also likely to hear submissions by defence lawyers in relation to the sentences he should impose.

The judge has made it clear he is conscious of the enormity of his decision for such young boys and has limited the number of journalists who will be allowed to be present in court.

The hearing is expected to last most of the day.

"Also on Friday, at the Central Criminal Court, the judge refused to allow more than five journalists to attend the sentencing hearing next week.
Citing the need to protect the boys’ rights, their physical and mental well-being, and their dignity, Justice Paul McDermott refused an application by RTÉ and various newspapers, including The Irish Times, to increase the number of journalists who will be present in court ... Luan O’Braonain SC, acting for the media outlets, on Friday told Mr Justice McDermott that the courts have established that the media is the “eyes and ears” of the public in court. Article 34 of the Constitution states that justice must be done in public and Mr O’Braonain said that viewing the proceedings in a separate room is not the same as being in the courtroom. He added: “It does not allow the same opportunity to see, hear and feel.”.... Mr Justice McDermott rejected the application and ordered Mr O’Braonain’s clients to pay the costs of legal teams for the two boys to attend Friday’s hearing."
