Anxious for the 23rd. Since it is a day for motions, I am guessing the defense will request a trial delay. If they do, I think the DA would grant it. Why be in a hurry?

I am guessing KKL is toning up this summer. Getting ready to rock the courtroom with her testimony and make PF see what he is missing? I do not believe he would give two cents for her. He had years to chase her and he didn’t.

The prosecution is going to give a reason for not seeking the death penalty huh? I am sure they will say they could not secure the DP with the political climate in CO.

Any news about the case in MSM?

I never dreamed this case would go to trial so soon.

We’ll know a hell of a lot more in a few days, in regards to if this remains on track.

I just can’t wait to find out his defense strategy, so we can find out if he’s completely screwed, or merely dead in the water.

The fact that both of those are essentially the same thing, notwithstanding.

Well, May did say that it takes about a year in his district to bring a murder case to trial. I guess he wasn't kidding.

It does seem incredibly quick in comparison to other cases but that's fine with me. Bring it on! Just a little over two months. :) MOO

Yeah, this is lightning fast compared to my state, where a case like this wouldn’t see a courtroom for several years.

I think the decision not to seek the death penalty is because the prosecution feels that the defense will push hard to try and convince a jury that KK is the actual killer. That reasonable doubt thing. Any doubt, reasonable or otherwise, might make someone reluctant to vote for the death penalty.
It also, in my opinion, doesn’t help that KK got a super lenient deal for her testimony. A jury might think well KK did awful things and her involvement was huge....and she basically walks, while the jury is supposed to put PF on death row.

Does anyone recall what he said to ML with DHS that he is trying to suppress in the motion above?

I also thought it was interesting that the people were the ones to ask for jury names and addresses way before the trial started. Usually it's the defense that does that. I really think the defense thinks they have a home team advantage.
I wonder if it has to do with him saying he should have killed the nurse that reported him when Baby K was born? MOO

I was wondering about the DHS statement as well. Just guessing that it was something about Kelsey being able/fit/present to take care of baby.... Also what is up with the alternate suspect defense. He has to let prosecution know in advance if he is going to try to pin it on someone else. Gee, I wonder who that would be. I'm not legal savvy but that's how I interpret P-15.

I'm hopeful we'll see an October trial. So much evidence we still don't know such as what was the true relationship between KK and PF?

I totally agree. I am prepared to be wrong but it would be one of the only murder trials with this number of various charges I have ever seen proceed within a year of arrest without a plea deal or a guilty plea. I hope as well it goes on but no confidence that it will, this case started out with delays of quite some time, months on end. My one doubt about that is he probably is sick of being in jail and may want the defense to get this over with (even though my hope is he moves on to prison of course).

I don't know what their relationship was and am curious as well but it was certainly sick, twisted and perhaps resulted in a tie between them that will be lifelong...

I completely agree with you. Whether the case is solid or not, there are a lot of questions remaining and information that is out there and not reported by MSM that brings up questions. I am going to believe that LE did check everything out and that hopefully the Berreth family has justice for KB. It still breaks my heart she had to die to satisfy someone’s sick needs. Of course, we see this all the time on Websleuths.

If PF did kill KB, I am not convinced that KKLs story of a baseball bat is true. More likely he took her somewhere and shot her and buried her where she will never be found. I have questions about LE entering her condo three times as a missing person case and didn’t use luminal or something of that nature in the beginningto find blood and only looked when a Berreth family member found blood. And why wasn’t PFs DNA found? He had to have cleaned up in order to take baby K out of the condo. Instead, the police found unknown Male DNA in the bathroom. KB wasn’t reportedly seeing another man. It wasn’t her brothers DNA, nor his partner, nor her Dads DNA. For all we know it could have been the DNA of an accomplice. Or maybe it is the DNA of a plumber. Those are only a couple of questions I would like to see answered. I think the trial might cover everything, if not the DA then the Defense. In any case, I look for parts of KKLs story to be shredded, especially since she destroyed phones and cleaned her FB account. When you consider those things, naturally you wonder what some of the jurors might think.

I am sure that you, like me, don’t care who committed this murder. What matters is that the perp spends his life in a cell so he cannot hurt someone else.

Still, KKL had a lot to hide and she went to party with friends right after the biggest and best clean up of a crime scene ever? I was listening to a crime scene specialist on CNN talk about another case. He said there is always some type of DNA left at a crime. It is just finding it. That’s why the perps get caught.

As far as burning KBs body, I don’t believe you can do that in the short time PF had to do that. In other cases it is stated it cannot be done without finding evidence of that body. I can see where they may have burned other evidence and that is why they found black plastic balls. In any case, PF may well be guilty.

I am not ignoring the evidence they may have. I believe there is more to the story, which is why I am waiting for the trial.

Yes, I want them both put away for life. Since we probably cannot see that with her, I hope the jury does not pull a Casey Anthony where they had questions about her dad, holes, etc. so it gave them reasonable doubt. Imo both are guilty here, and they need to convict PF even if they are not happy with KK's deal. At least take the ONE down, don't acquit because of the culpability of both which is clear, and hopefully the other will follow, at some point in time. She won't change, not significantly, she is not 20 and just growing up, and living and learning... Her devious ways are ingrained imo.

I think there is a lot untrue in KK's story and a lot that can be picked apart unfortunately. I am no expert but just her story alone I can find multiple things to charge her with of her own admission which they did not.

I don't think her body was burned at the Franch either. If it was, it was not completely burned in that short of time period. I think other evidence was burned. I also think three visits by LE and even State LE and yet the Berreths noticing blood and clean-up (the frig, etc.) is going to be a problem.

PF's DNA wasn't found when supposedly he was there on many occasions so was clean-up that good? If it was, then there should not be any unknown male DNA there either now should there? Seems again like a pretty short clean-up, like the fire, my guess is there was more than one time and/or he was there as well or had been back. There are hints of that in some of the preliminary hearing remarks. The vehicle remarks are still quite confusing as well.

I stick on the remark that he said to KK "You have a mess to clean up". She wanted this death and was just as much a part as he was. She was scared of him yet not so scared that in her own words she allegedly refused to take her body with her when she left (or ashes and bones) and she was not scared of his reaction to her refusal when she was present? Give me a break. She then goes off and celebrates and lies to LE and the feds and ain't worried about her daughter he "threatened' whatsoever.

All that said, I hope he is put away and then somehow she screws up her sweetie deal and her entire life.

P.S. I rarely do such things and I doubt it will make a difference but I am going to contact the Idaho Nursing Board with my opinion. They don't have any reason to wait for a trial here, in KK's own admissions she has done plenty that any board with any guidelines to be adhered to should have gotten rid of her arse by now. Good Lord, she at minimum let a young mother die, conspired to murder her, cleaned up the murder scene, got rid of evidence, cleansed her FB and turned off her location, lied to both local LE and state and the feds I believe... I could go on and on... Nurse Ratchett and Kathy Bates in Misery by Stephen King might just pale in comparison to KK who can even hit the feed bag afterwards...
