Billie Jean Cuttler appeared in Judge Paul White’s 159th Judicial District Court Friday morning after White ordered a second mental health evaluation be performed on her back in May.

Because there was a discrepancy between Cuttler’s first mental health evaluation and the second one, a jury will now decide whether she is competent to stand trial...

August will be the earliest time that the competency trial could be held for Cuttler.

Despite an Angelina County jury’s ruling that a Louisiana woman is not mentally competent to stand trial for capital murder in connection to the 2015 death of her 3-year-old nephew, Mason, the state will not dismiss the charges against her.

The judge in the case also chose not to set a bail amount for her.

A hearing is scheduled for the week of August 29 to determine if Cuttler will be sent for a civil commitment.

On Aug. 3, an Angelina County jury decided that Cuttler is not fit to stand trial after deliberating six-and-a-half hours. They heard testimony from mental health experts, law enforcement officers, and correctional officers.

Prosecutors say a Texas man who told police he drowned a 3-year-old boy because his girlfriend was pregnant and they needed room in the home has been sentenced to life in prison without parole.

Authorities say Bobby Woods Jr. told police that his girlfriend, Billie Jean Cuttler, was pregnant and that he wanted her 3-year-old nephew Mason Cuttler dead because they needed space at the home where several families lived. A lawyer later said Cuttler wasn’t pregnant.

Woods was convicted Friday of capital murder for the 2015 death. Investigators say Woods pushed Mason into a pond near Lufkin, 110 miles (175 kilometers) northeast of Houston.

Unfortunately he’ll still be less than 40 years old and will end up with some girlfriend with kids or get someone pregnant, and then he’ll probably murder one of those kids. Sigh.

If you by "he" mean the man who killed the boy, he got life without parole. Cuttler is a she, the paternal aunt of the boy, and she got 20 years.
