The brother of Olympic gymnast Simone Biles has been charged with murder in a New Year’s Eve shooting that left three people dead, PEOPLE confirms.

Tevin Biles-Thomas, 24, of Cleveland, is charged with murder, voluntary manslaughter, felonious assault and perjury, according to a statement from Cleveland police.

Jail records from the Liberty County Sheriff’s Office in Georgia show Biles-Thomas’ bond has not been set, and that he was arrested at Fort Stewart. NBC reports Biles-Thomas is on active duty with the Army.

An official with the sheriff’s office tells PEOPLE Biles-Thomas was arrested Thursday and taken into custody of the jail at about 3:30 p.m.

Tevin Biles-Thomas pleaded not guilty to all charges against him in the case, which include multiple counts of murder, voluntary manslaughter, felonious assault and perjury.

Simone Biles' brother's lawyers believes there's no evidence for charges

In pre-trial motions, lawyers for Tevin Biles-Thomas, the brother of U.S. Olympic gymnast Simone Biles who is charged in a triple murder in Cleveland, say there’s no evidence against Biles-Thomas and that he was charged by police after they improperly questioned him.

Police interrogated Biles-Thomas on Feb. 8, although he thought he was just coming in to give police a statement since he reportedly witnessed his cousin’s death, Patituce said.

“He had no idea he was a suspect,” Patituce told Cleveland.com. “He just wanted to tell the officer what he saw that night, and the next thing he knew he was being told he was a suspect in a serious crime.”
