Free on $50K bond. House arrest & is placed on a curfew from 9pm to 7am, GPS monitoring, random drug tests & unannounced home visits will continue & surrendered passport.

8/20/19 Day 47/Day 1-Deliberations: The jury was told to restart deliberations in the case, disregard all past discussions and remember they cannot talk to others about the case or seek outside information about it. Judge Thompson also imposed a gag order preventing attorneys from discussing the case with reporters. During a session in open-court outside the presence of the jury, Judge Thompson said at least two of the three women she booted from the panel yesterday could potentially face contempt proceedings because of juror misconduct, specifically having unauthorized contact with media or news reports and reviewing outside material. The judge described two of them as "offending jurors" and the third as a "non-offending juror," although Brian Getz, an attorney for Almena, made clear they believed all three should be considered "offending jurors." The new jury deliberated for their first full day without reaching a verdict. They will return for more talks Wednesday, 8/21 - and then they will not return until Tuesday, Sept. 3 because of a previously scheduled break approved by Judge Trina Thompson.
8/21/19 Day 48/Day 2-Deliberations: The minutes of closed hearings that Thompson held on Monday to discuss the alleged juror misconduct indicate that the alleged misconduct prompted attorneys for Almena & Harris to make oral motions asking her to declare a mistrial in the case but she denied their motions. Thompson said at the end of the day on Tuesday that she will hold a hearing on a defense motion Wednesday morning, 8/21. Jury deliberations probably will extend past Labor Day or even later because Thompson previously scheduled days off for jurors beginning on Thursday until Sept. 3, the day after Labor Day, so that jurors have time to transport their children to college. Thompson, who noted that her original estimate was that the trial would last until the end of October, said she also is dealing with jurors' requests for additional days off, including a request by one juror for a lengthy break between Sept. 9 and Oct. 6. No verdict reached on second day of “new” jurors. Jury will be back on Tuesday, 9/3.

Plead not guilty. $300K cash or $600K bond.
Trial started 3/18/19. 12 jurors are 8 women & 4 men; the 6 alternates are 2 women & 4 men.

GUILTY - NY - Christopher Grover, 30, shot to death, Poughkeepsie, 28 Sept 2017 *Arrest*

4/12/19 Day 18: A jury found Nicole Addimando guilty of 2nd degree murder. She faces a maximum sentence of 25-years-to-life in prison. Also convicted of 2nd degree criminal possession of a weapon, a charge punishable by 3 ½ years- to 15-years in prison. Sentencing is scheduled for May 20.
4/13/19 Update: The defense requested a later date to allow for more time to submit sentencing submissions. The judge approved the request in court. New sentencing date is 6/10. 6/10/19: Rescheduled for 7/15.
7/15/19 Update: Sentencing has been postponed. Conference hearing set for 7/30. No date for sentencing yet. 7/30/19: Sentencing scheduled for 9/4.


*Trial set to begin for both (@ 8am CT) – MO – 4 children (3 girls & 1 boy, ages 5 to 12 locked in small windowless boxes discovered 8/7/18, Farmington) – *Laura Elizabeth Cheatham (38) (adopted “mom”) arrested & charged (8/7/18) with 5 counts of endangering the welfare of a child & 3 counts of 2nd degree kidnapping. Plead not guilty. $500K bond; bond reduced (8/28/18) to $250K. Cheatham posted $250,000 bond on 9/14/18, & has been released with GPS monitoring & restrictions that she not have any contact with the children. Her attorney has moved to continue the October 9th Preliminary Hearing because she has documents she needs to review.
*Daryl Justen Head (38) (mom’s bf) arrested & charged (8/7/18) with 5 counts of endangering the welfare of a child & 3 counts of 2nd degree kidnapping. Plead not guilty. $500K bond; bond reduced (8/28/18) to $250K. Head posted $250,000 bond on 9/10/18 with no GPS monitoring and no restrictions.

*Trial set to begin (again) (@ 9am ET) – IN – Tammy Jo Blanton (46) (Sept. 11, 2014, Jeffersonville) – *Joseph A. Oberhansley (33) arrested (9/11/14) & charged (9/15/14) with murder, burglary & rape. Plead not guilty. Held without bond. DA seeks DP. DA has taken DP off the table (6/28/19).
Trial set to begin 9/4/19 with jury selection. Trial could last 2 weeks.
Previous trial started 8/19/19. Jury was picked from Hamilton County, trial will be held in Clark County. 12 jurors, 3 alternates. Jury was be sequestered. 8/22/19: Judge grants defense motion for mistrial after one of State’s witnesses mention Oberhansley’s prior criminal past & drug use.
Clark County had pulled in jurors from Hamilton County. Clark County Prosecutor Jeremy Mull said the jury selection will begin Sept. 4. That means opening statements could be heard as early as Sept. 6. But the defense filed a motion late Monday, 8/26 so that the next jury would be selected from a different county due to the publicity of the trial. If that motion is approved, that date could be pushed back. The jury will be sequestered.

(@ ET) - NC - Mariah Kay Woods (3) (Nov. 27, 2017, Onslow County; found Dec. 2, 2017) - *Adolphus Earl Kimrey II (32) (BF of Mom) arrested & charged (12/2/17) & indicted (on 2/23/18) with 1st degree murder, felonious child abuse inflicting serious bodily injury resulting in death & felony concealing a death, obstruction of justice, Felony 2nd degree burglary, felony larceny & Misdemeanor possession of stolen property. Plead not guilty. Held on no bond. DA will seek DP.
The cause of death was chloroform toxicity.
Trial was set for 9/9/19.

*Trial set to begin-vacated instead Plea Hearing (@ am ET) – MI – Ashley Regina-Maria Young (31) (last seen Nov. 29, 2018, Oshtemo Township, Kalamazoo County, found in basement of Chance’s rental home on Dec. 2, 2018, except head & neck) -*Jared James Chance (29) arrested (12/3/18), charged & arraigned (12/4/18) with 1 count of mutilating, defacing, removing or carrying away a portion of a body & of discovery of body & failing to inform proper authorities. Charged & arraigned (1/4/18) with open murder & 3 counts of tampering with evidence. Plead not guilty to all charges. $750K Bond. Judge sets no bond (1/4/19).
Trial was set for 9/9/19.
9/5/19 Update: Kent County prosecutors have offered a plea deal that would allow him to plead guilty to second-degree murder, provided he discloses all that happened. The deal would allow Jared Chance to avoid a mandatory life sentence without the possibility of parole. Chance will be allowed to plead guilty on Monday, Sept. 9 – the same day jury selection is slated to begin. The plea offer includes a recommendation that Chance serve a minimum of 31 years in prison. But the Judge will set the maximum term.

*Barbara Louise Chance (63) & *James Howard Chance (76) (Jared’s parents) charged (12/10/18), arrested (12/11/18) & arraigned (12/12/18) with accessory after the fact of a felony & perjury. Both plead not guilty. $25K bond. (released on 12/12/18).

12/12/18 Update: Both plead not guilty. $25K bond, released from jail 12/12/18. 12/17/18: Next Probable Cause hearing on 12/26 & Preliminary Exam hearing on 1/2/19.
12/26/18 Update: Next Preliminary hearing set for 1/10/19. 1/2/19 Preliminary hearing cancelled.
1/10/19 Update: Barbara Chance waived her right to the probable-cause hearing and also had her case bound over to Circuit Court. The judge ruled James Chance "misrepresented the facts," and said the felony charges of perjury and being an accessory after the fact were merited. Both cases are adjudicated.
3/27/19 All cases are closed. Both bound over to Grand Rapids circuit court. Next Status hearing on 4/29. 4/29/19: Trial starts 10/14/19 for both.

Okay - I'm going on a vacation (back to California!!!) for 2 weeks (starting 9/18 back on 10/2) - and I won't be bringing my laptop with me. :)

Week of September 16 - September 20th.

Monday, Sept. 16th:
*Trial set to begin (@ am CT) – MI/TX – Michael Lee Swearingin (32) & Jenna Kay Scott (28) (Jan. 4, 2019, Temple; found in Clearview, OK 1/9/19) – for *Ginell Marie McDonough (Army Staff Sgt.) (37) (Mark’s wife) arrested (1/11/19) & charged (2/19/19) for harboring a fugitive & charged with obstruction of justice. $75K bond reduced to $10K, released on bond with GPS monitor.
Maxwell also was hiding out in McDonough’s Michigan home, according to law enforcement officials. McDonough hasn’t been charged yet with a crime in Texas, and she was released from the Michigan jail after her bond was decreased from $75K to $10*.
Trial set to begin 9/16/19.
*Maya Renee Maxwell – Pretrial hearing on 8/30. No update as of 9/15.
*Cedric Joseph Marks – Murder charges: pretrial hearing on 8/29. No update as of 9/15.


*Trial Continues (Day 6) (@ 9:30am ET) - SC - Heather Rachelle Elvis (20) (Dec. 4, 2013, not found) - *Sidney St.Clair Moorer (38/now 43) arrested (2/23/14), charged & indicted (2/27/17) with kidnapping & indicted (4/27/18) with conspiracy to commit kidnapping. Plead not guilty. $30K Surety Bond.
Was to be tried in Georgetown County, but Judge brings it back to Horry County (6/21/19).
Trial began on 9/9/19 with jury selection. Jury: 6 women & 6 men, with 2 alternates: 1 woman & 1 man.

9/13/19 Day 5: State witnesses: Jeremy Leach (with the SC Highway Patrol-Investigative Division). Testimony about headlight analysis on video, defense is objecting. Judge overrules. Grant Fredericks (Forensic Video Solutions, Spokane, WA.-is a video forensics analyst/expert). Peter Cestare (HCPD Lieutenant of the CSI Unit). Jimmy Shroering (DME Forensics, CTO & Founder-Recovered video from surveillance systems). Trial continues on Monday, 9/16 @ 9:30am.
*Tammy Lorinda Caison Moorer (41/now 46) – Trial on 10/8/18 found guilty of kidnapping & conspiracy to kidnapping. Sentenced to 30 years for each charge, to be served concurrently with time served for any time served thus far (5 yrs). Not eligible for parole.



Tuesday, Sept. 17th:
*Sentencing Hearing (@ 1:30pm MT) – ID – Christine Lott (34) (Mar. 25, 2004, Priest River; found in a remote & forested area east of Coeur d’Alene, Feb. 26, 2016) – *Stephen Mathew Lott (49/35 @ time of crime) (husband) arrested (6/19/18) & charged (7/5/18) with 1st degree murder & failure to notify coroner of a death. Plead not guilty. $1M Bond.
Waited 2 days to report her missing.
7/13/18 Update: Arraignment hearing set for Monday, 7/16.
8/10/18 Update: Plea hearing remains on hold, as defense still waiting for GJ transcripts of indictment. Now set for 8/28.
8/28/18 Update: Plead not guilty. Next pretrial conference in 12/21, and Trial will start Jan. 15, 2019.
12/21/18 Update: Motion filed for continuance, too much discovery. Granted. Next Entry of Plea hearing on 1/7/19, final Pretrial conference hearing on 6/21, trial now set for 7/9/19.
5/17/19 Update: Hearing cancelled for 6/21 as is trial on 7/9. In mediation which could lead to resolution of case without a trial. Next court hearing is 9/20. Trial set for 9/26 @ 9am.
7/9/19 Update: Amended Indictment. Plead Guilty re Alford Plea. Lott has acknowledged that enough evidence exists for him to be convicted on charges regarding his wife's death. But in entering the plea, known as an Alford plea, Lott did not admit guilt for the crimes he was reportedly facing: manslaughter & concealing a body from authorities. Sentencing will be in Sept. 17.

(@ 8:30am AKT) – AK – Ashley Johnson-Barr (10) (Sept. 6, 2018, Kotzebue; found Sept. 14, 2018) - *Peter Vance Wilson (41) arrested (9/15/18), charged (9/24/18) & arraigned (9/25/18) with 1 count of murder-intent to cause death in the 1st degree, 2 counts of Murder-sexual assault/kidnapping of child, 1 count of kidnapping-injury/sexual assault, 4 counts of sexual abuse/penetrate of a minor in the 1st degree & 1 count of tampering with evidence. Wilson faces up to 99 years in prison. $3M bond.
Trial was to start 9/23-vacated
7/18/19: Motion for continuance granted; determination of competency. Status hearing on 9/18.

*Charged (9/17/18), indicted (9/20/18) & arraigned (9/21/18) of making false statements to a federal agent. The charge filed against Wilson centers on accusations that he lied to law enforcement, particularly in regards to Johnson-Barr's cell phone, which is said to have led authorities to her body Friday evening. Plead not guilty.
Trial set to begin 11/19/19
9/18/18 Update: First court appearance. Was appointed a Public Defender. Allegedly told investigators he didn’t know Ashley Johnson-Barr, didn’t see her name on the home screen of the cell phone he told investigators he found in the street, and didn’t use a four-wheeler the day of her disappearance. Investigators found evidence they say refutes all those claims as they searched for the girl, who was found dead more than a quarter mile off a road.
9/21/18: Arraignment hearing: Plead not guilty. The maximum penalty for making false statements could be five years in prison, three years of supervised release, and a $250,000 fine. Trial on 11/19/19.


*Trial set to begin for both (@ 8:30am ET) - FL – Daniel Eric Markel (41) (July 18, 2014, Tallahassee) - *Sigfredo Garcia (34) arrested & charged (5/25/16) with 1st degree murder, conspiracy & solicitation of murder. Plead not guilty. Held without bond. DP case.
Murder for Hire hit man. They split a $100K payoff for murder.
*Katherine Magbanua (32) (Garcia's wife) arrested (Oct. 2016) & charged with first-degree murder, conspiracy & solicitation of murder were brought together into one case on Tuesday (3/20/18). Plead not guilty. Held without bond.
KM has rejected several offers of immunity for her testimony.
Trial to start on 9/23/19 with jury selection. Should last from 3 to 6 weeks.
Accomplice:
*Luis Rivera (33) charged with 1st degree murder. Took a plea deal (Oct. 2016) & plead guilty to 2nd degree murder. Will testify against Garcia & Magbanua. Will receive 19-year sentence to run concurrently with his 12 year Federal time, which he is already serving.

POIs: Wendi Adelson (ex-wife of Markel), her bro Charlie, mom Donna Sue Adelson (68) & father Harvey Adelson. Investigators have not charged anyone in the Adelson family in connection with Markel’s death, but say Adelson’s mother and brother – Donna and Charlie Adelson – paid $100,000 to have Markel killed following the couple’s contentious divorce so their two young sons could move to South Florida.

Plead not guilty. Held without bond. *Robbery & possession of firearm at Family Dollar store on 12/3/18.

*Trial set to begin (@ 9am ET) – VA – Arieanna Day (3 mos) (Sept 12, 2018, not found, Roanoke) – *Andrew Christopher Terry (31) arrested (9/12/18) & charged (9/20/18) with illegal disposal of a body. Held without bond. Bond denied 9/20/18. Judge granted (10/25/18) $50K bond, has bonded out. Indicted (1/8/19) with concealing a body.
Trial starts 9/25/19 & on 9/26.

Friday, Sept. 27th:
*Sentencing Hearing (@ 9:30am PT) - CA - McStay Family: Joseph (40), Summer (43), Gianni (4) & Joey Jr (3) (Feb. 4, 2010, Fallbrook; found Nov. 11, 2013) - *Charles "Chase" Ray Merritt aka Charles Ray Mandel aka Charles Ray Morritt aka Chase Meredith aka Chase Jarvis (57/now 62) arrested (11/5/14) & indicted (11/7/14) of 4 counts of murder with special circumstance. Plead not guilty. Held without bond. DP case.
Trial started 1/7/19. Dark on all Fridays. Jurors started with 8 women & 4 men; now have 9 women & 3 men (alternates started with 4 men & 2 women-alternates left 1 men & 1 woman). Took about 22 hours of deliberations for guilty verdict on all 4 counts of 1st degree murder with special circumstance.

6/24/19 Day 6: Jurors started deliberations about 9:37am to 11:32am. (2 hrs). Lunch until 1:30 pm. Jurors have reached a verdict after 4.5 hours of deliberations. It will be read at 4pm. Verdict: Count 1 LWOP (Joey), Count 2 Death (Summer), Count 3 Death (Gianni), Count 4 Death (Joey, Jr.). Judge dismisses jurors. Judge Smith sets sentencing on Sept. 27.
Schedule for Penalty Phase-Week of June 24 thru 28th: Jury deliberations-6/24, Monday and ended.
Jurors have deliberated: 6/20-Day 1: 11:50am-3:53pm (1.5 hr lunch right after start) = ~ 2 ½ hrs. 6/21-Day 2: 8:36am-9:48am = 1 hr. & 9 mins. 6/24-Day 3: 9:37am-11:32am = 2 hrs. (2 hour lunch). Came back with verdict at 1:51pm. Total hours of deliberation: ~5 hours, 10 minutes, give or take a few minutes.
