Still no future court hearing but the trial date on court site.

All these motions are ridiculous. Surely they won't be granted will they?

I wonder if she will plead guilty to dismembering and disposing of Sydney, as Trail did. He implicated her in that so I wonder if he will be subpoenaed to give evidence? Is that possible? He may also take the blame for the killing perhaps. Does this postponement to March 2020 mean his appeal will be heard first? Any news on that?

The only thing I know is - he has a hearing on 9/11.
 
The court site has this - but her trial was supposed to start on 10/15, so I'm going to put this in my notes as just a "hearing" - we shall see! :)

8/1/19 Update: Defense files motion for change of venue.
8/9/19 Update: Saline County District Judge Vicki Johnson wants more time to consider whether to move Boswell's murder trial out of the county. Johnson on Friday allowed state prosecutors to add a conspiracy to commit murder charge to Boswell's case. But the judge also took under advisement a challenge to her order barring the media from naming or broadcasting the likenesses of three witnesses in Boswell's trial. It was decided that Boswell will not have to be shackled and can wear civilian clothing at her trial. Defense Attorney Todd Lancaster also wanted gruesome crime scene photos, talks about witchcraft, and hearsay statements from Trail banned from the proceedings. There will be another pretrial hearing but court site is yet to be updated.

9/5/19 Update: Boswell, which was set to begin next month in Wilber, Nebraska, has been moved 173 miles west to Lexington and now will start on March 16. The argument for the trial move, which District Judge Vicky Johnson approved on Friday, was that the publicity of the case would prevent potential jurors to “fairly serve.” Next hearing per court site on 10/28.
*Aubrey C. Trail (51) – Found guilty of all charges 7/8/19. A 3-judge panel will hear penalty phase. Motions hearing for new trial on 9/11.

Wednesday, Sept. 11th:
*Motion Hearing (for new trial) (@ 11am CT) - NE - Sydney Loofe (24) (Nov. 15, 2017, Lincoln; found Dec. 4 & 5, 2017 in Edgar, east of Clay Center) – only for *Aubrey C. Trail (51) charged & indicted (6/11/18) & arraigned (7/13/18) with 1st degree murder & improper disposal of human remains (plead guilty to this charge 6/18/19) & charged (3/1/19) with conspiracy to commit murder. Plead not guilty. No bond. DA will seek DP.
Trial started 6/17/19 with jury selection. Trial started on 6/18/19 & runs thru 7/8/19. Jurors: 7 women & 5 men, with 3 women alternates. One juror was excused for family emergency on 6/28/19 (no gender available). Jurors could be 8 women & 4 men. Now 2 women alternates. Jurors deliberating for about 2 ½ hours & found Trail GUILTY of all charges.

7/11/19 Day 15: Trail has waived his right to have a jury hear the aggravation phase of his trial, meaning a 3-judge panel will hear it instead at a later date this year. The court accepts this offer. The jury has been excused from the panel. Judge Vicky Johnson & two other judges will deliberate if this case is heinous enough for a death sentence. The alternative: life in prison.
7/16/19 Update: Defense files motion for new trial. 8/7/19: Motion hearing on new trial on 9/11.

Judge hears arguments over whether issues at Aubrey Trail’s trial warrant a new one


WILBER — Two months after a jury here found him guilty of murdering a 24-year-old Lincoln woman, Aubrey Trail returned to court with his attorney, arguing he should get a new trial over issues in the first one.

Among them, defense attorney Ben Murray said, a potential juror was kept on the panel despite saying in a questionnaire before trial that the death penalty was "too good" for Trail.

SALINE COUNTY – Convicted murderer Aubrey Trail’s attorney filed a request for a new trial, citing an outburst that led to him slicing his throat tainted the jury.

According to court documents, Trail’s defense attorney Ben Murray filed a motion for a new trial and the topic was discussed in Saline County Court on Wednesday.

In addition, Murray filed a motion to rule Nebraska’s death penalty unconstitutional because “it permits judges, not juries, to make factual findings necessary to impose death sentences.”

The state now has until September 20 to submit a brief on the motion and the judge took the topic under advisement.

He took Sydney’s LIFE. Her family will never get to hug her again. He destroyed so many lives and hurt so many people. Now he wants people to feel sorry for him because he doesn’t get to watch TV?
