Patrick Frazee defense gets deadline for identifying 'alternate suspects' in Kelsey Berreth's apparent murder

While being quizzed about his toddler daughter at the Teller County jail days after his arrest, Frazee claimed that he’d had repeated contact with Berreth in the days following Thanksgiving, when she was allegedly murdered.

The defense argues the statements shouldn’t be admissible because Frazee was in custody at the jail, and the DHS worker asked incriminating questions.

Prosecutors countered that the employee, Mary Longmire, was trying to find the best possible placement for Frazee’s daughter while he was jailed, and that Longmire followed the law in how she distributed the confidential information.

“She was not working at the behest of law enforcement or knowledge of law enforcement,” prosecutor Viehman said. “She was doing her job.”

The visit by DHS was prompted by a report from Woodland Park police that the toddler girl could have been exposed to violence on or around the holiday.

Patrick Frazee‘s allegations that his fiance Kelsey Berreth abused their 1-year-old daughter will be part of the evidence in the murder case against Frazee, a Teller County judge ruled Friday.

Frazee’s attorneys argued that the statements couldn’t be used at trial because he was not advised of his Miranda rights before his Dec. 26 interview with a Teller County Department of Human Services caseworker in the county jail. But Judge Scott Sells found the caseworker did not need to read Frazee his rights because she was not a law enforcement officer and Frazee voluntarily agreed to participate in the interview.

Frazee’s lawyers wanted to block their client’s statements from the interview because the caseworker asked “incriminating questions” about dates related to the criminal case. The caseworker, Mary Longmire, was tasked with learning more about Frazee and where the couple’s child was during Berreth’s disappearance so she could recommend to a judge who should have custody of the child until the end of trial.

She said that Frazee told her he and Berreth had split custody of their child, and that he had her Sunday through Wednesday, and that they switched Wednesday nights. She said that on the Wednesday before Thanksgiving of last year, they met in Florissant to switch custody of the young girl.

According to Longmire, Frazee said that during this meeting the two (who were engaged at the time) went to a ranch Frazee was working on to talk about their relationship. Berreth then left late to get Frazee over the counter medicine for his ulcers. They then exchanged their child, Kaylee, later that night.

On Thanksgiving Day, Frazee said that the two had planned on Berreth having the child in the morning and Frazee to have her in the afternoon. He told Longmire that he went to Berreth’s house to pick up the child and then took her on some jobs before going to his ranch to have dinner with his family.

Frazee told Longmire that Berreth then called him the day after Thanksgiving, and asked him to keep their child. He said that he talked to Berreth off and on during the weekend after Berreth was last seen. He told Longmire that he talked to Berreth that Saturday when she “lost it.”

Frazee then told Longmire that the last time he heard from her was when she sent him a text on the following Sunday saying, “Do you even love me?” Frazee said that he responded, “Of course I do” and then he never heard back.

Deadline passes for Frazee attorneys to name new suspect in Kelsey Berreth murder
The deadline has come and gone for defense lawyers to name an alternate suspect in the Kelsey Berreth murder case.

A court spokesperson said Monday that were anything to be filed, it would be reviewed Tuesday morning.

11 News is working to confirm whether or not anything was filed late Monday night. The Colorado Judicial Branch website is not showing any new filings in the Frazee case since Aug. 30.

Krystal Lee was named an alternate suspect in the Kelsey Berreth case Wednesday.

According to Colorado Court public information officer Rob McCallum, the defense filed for an alternate defendant on the 17th.

Patrick Frazee's attorneys expected to place some blame on his girlfriend
Patrick Frazee's attorneys have filed his list of defenses and witnesses for his murder trail, which starts in October.

Despite not naming an alternate suspect by Monday's deadline, court documents filed by Frazee's attorneys say they still plan to put part of the blame on Krystal Kenney, an Idaho nurse who was dating Frazee.

It’s unclear whether a Teller County District Court judge will accept the documents filed Tuesday.

While his lawyers did not file a motion to blame the murder on someone else as a defense, they do plan to use an alternate suspect to spark the idea of reasonable doubt.

The document also includes a component about pointing to an alternate suspect as part of the general denial defense. It's important to note this is not the alternate suspect defense.

"It is anticipated that as part and parcel to general denial, there may be evidence that other individuals committed or fabricated portions of the crimes alleged against Mr. Frazee, to include Krystal Lee (Kenney)...," the document read.

Patrick Frazee planning to blame girlfriend for Kelsey Berreth's murder
The defense might introduce "evidence that other individuals committed or fabricated portions of the crimes alleged against Mr. Frazee, to include Krystal Lee," according to the memo filed by his lawyer, Payne Steigerwald, in Teller County.

Defense lawyers missed a Monday night deadline to tell the judge it would present evidence of an alternate suspect. But there's still space, under Colorado statues, for that evidence to be permitted at trial, according to criminal defense lawyer Scott Robinson.

Frazee's defense needs to show Lee had motive and opportunity.

"His defense will have no problem proving that for Krystal Lee," said Robinson, legal analyst for NBC affiliate KUSA. "She has admitted her involvement, and cell phone records place her at the scene."
