O'Leary boat literally flew over the other boat, which was almost stationary. I don't know speed limit in that lake, but they were driving dangerously fast at night, when other boats were around.
 
O'Leary boat was ultra-fast and literally flew over the heads of the people in the larger and slower boat. The bottom of the boat struck the victims. O'Leary boat kept going, and parked in a far-away marina.

Could someone please provide me the MSM to substantiate the above details. I'm not seeing them anywhere.

The Ontario Provincial Police (OPP) charged Linda O'Leary with "careless operation of a vessel."

The OPP obtained 5 videos from cameras trained on the lake and they concluded she was driving 17 MPH at around 11:30 PM ... which police say was not a safe speed.


The OPP also charged the driver of the other boat, Richard Ruh. The OPP says he was driving without navigation lights. The driver had insisted the lights were on, but police say the video shows otherwise.

We're told Linda is going to "vigorously fight the charge." Police tell us Linda's alleged crime carries a maximum sentence of 18 months in jail or a $1 million fine.

Ontario Provincial Police said Tuesday that Linda O'Leary, 56, of Toronto, was charged with careless operation of a vessel, contrary to the Canada Shipping Act.

OPP spokeswoman Carolle Dionne said the operator of the other boat, Richard Ruh, 57 of Orchard Park, N.Y., was also charged with failing to exhibit a navigation light while underway.

Faling to exhibit navigation lights is a set fine, akin to a traffic ticket.

Linda O'Leary is scheduled to appear in court on Oct. 29.

You may recall that in 2017, Kevin OLeary entered the leadership race for one of the main Canadian Federal political parties. Had he been sucessful, the timing of boating crash would coincide with the Governor General's call for a Federal election to be held in October.

I expect he, and half the country are thankful that he doesn't have an election campaign to add to his plate.

Some people will continue to think Kevin was driving, so any video of their boat before the incident would be sufficient.

The other boat probably had some lights, because people on the deck recognized Kevin O'Leary. Their testimony will be important to figure out if he switched seats, in case he was driving.

Also, they will know how long Kevin's boat waited at the scene, before going to the marina.

In my opinion, the "public prosecutor" in charge of this case deliberately made this mistake, so the defence lawyer can point out there is no jail and only trivial fine.

Linda O’Leary’s lawyer, Brian Greenspan, says in a statement that the “tragic accident had nothing to do with alcohol.”

“Linda O’Leary was not impaired; she is a highly experienced boater who was proceeding cautiously with due care and attention,” Greenspan said in a statement to The Canadian Press.

“She collided with a totally unlit boat on a moonless night which was invisible to any prudent operator. No one could have avoided the collision.”

Det. Ronald Marshall wrote in the search warrant that another officer went to the O’Learys’ cottage shortly after the crash, following a 911 call that the couple had been involved in a boating accident and were injured.

“(Linda) O’Leary registered an alert and was given a three-day driving suspension,” Marshall wrote in the warrant documents.

“O’Leary claimed that she had consumed alcohol following the collision and after returning home.”

Months later in May, Kevin and Linda O'Leary filed their own lawsuit claiming more than $3 million in damages against Irv Edwards, the owner of the other boat involved in the crash, and Richard Ruh, the man who was driving.

In court documents, Edwards and Ruh both deny responsibility for the crash. They are also seeking to have any damages against them limited to $1 million under the Marine Liability Act.

According to unsealed search warrant documents, the navigation light on the Edwards boat was turned off before 11:30 p.m., when the O'Leary boat collided with it, fatally injuring two of its passengers: Brito, 48, of Uxbridge, Ont., and 64-year-old Gary Poltash of Florida.

Following the crash, Linda O'Leary was charged with careless operation of a vessel under the Canada Shipping Act. If found guilty, she could face a $10,000 fine. Ruh was charged with failing to exhibit a navigation light.

The search warrant documents also indicate that Linda O'Leary had alcohol on her breath the night of the crash, resulting in the automatic suspension of her driver's licence for three days. The Ontario Provincial Police documents say O'Leary claimed she had a drink after the crash.

Brito's family's legal team filed a motion in Ontario's Superior Court of Justice to access some of the files from the police and the Crown, but that matter is also pending with no hearing date set. Brito said her family still wants to know the details of Linda O'Leary's breathalyzer test that night and if there was any further blood testing to determine how much alcohol was in her system.

Her lawyers have filed a counterclaim that challenges the O'Learys' attempt to limit their damages under the Marine Liability Act. The counterclaim seeks damages of $3.5 million from the couple for the death of Brito's sister.

In O'Leary's civil claim against Edwards and Ruh, they seek $1 million for Linda O'Leary to compensate for "pain, suffering, emotional distress and loss of enjoyment of life." The claim also seeks $2 million for Kevin O'Leary, who appears on the U.S. reality TV show Shark Tank, for "loss of income." Linda O'Leary's injuries to her right foot required the removal of cartilage and the insertion of three plates and screws, and that "the joints in her right foot will remain fused and immobile." She "suffered psychological trauma and emotional distress" and has not been able to work since the crash. It said her husband was forced to cancel a number of paid appearances because of the publicity generated by the crash.
 
Richard Ruh of Orchard Park, N.Y., was charged after the Aug. 24, 2019, crash on Lake Joseph in the Muskoka region north of Toronto, which killed two people on the boat Ruh was in.

Linda O'Leary, who was driving the other boat, was charged with careless operation of a vessel under the Canada Shipping Act. Her trial is scheduled to start in June in Parry Sound, Ont.

The families of Gary Poltash, 64, from Florida, who died the night of the crash, and Susana Brito, 48, of Uxbridge, Ont., who died days later as a result of injuries sustained in the crash, have also filed civil suits.

Ruh originally opted to take his matter to trial, but in September 2020, he changed course.


Ruh submitted a letter to the Provincial Offences Office in Parry Sound withdrawing his intention to appear in court.

"As a result of the withdrawal of my notice, I understand that I will be deemed not to dispute the charge and that a justice may enter a conviction against me," Ruh said in the letter dated Sept. 4, 2020.

Ruh acknowledged that he understood that the "conviction may be entered without the prosecution calling any evidence despite the fact that I will not be entering a guilty plea or participating in a trial on the merits."
