The accused tells Detective Sergeant Ewan Settle on the interview tape, he had been "unmatched" with Grace on Tinder the day after their date.

He said he thought he "must have done something wrong".
Settle then refers back to the last time the accused saw Grace, where he claimed they parted ways on Queen St.

The accused says the pair had a "hug and a kiss at the intersection" and then he started chatting to a group of Chinese travellers.

"So you didn't see where she went?" Settle asks.

"I didn't. I know it sounds bad but I started talking to a group of people," the accused replied.

The accused then claimed he sat in a pub, he doesn't know the name of, and had at least 10 beers there and paid with cash.

Settle questioned why he paid with cash, when he paid for Grace's drinks at Andy's Burger Bar with his credit card.

I don't usually have cash, but low and behold it went pretty quickly, he replied.

He stayed at the bar until 10pm or 11pm that night, he said.

He had intended to meet a woman at the viaduct harbour, but when he didn't hear from her, he decided to drink alone.

10.45am

The jury is watching more of the accused's interview with police.

As Detective Ewen Settle continued his questioning the accused said he woke on December 2 to find Millane had unmatched him on the dating app Tinder after the pair had made plans for the day.

"I thought ahh, what's going on here? I must've done the wrong thing."

Settle asked: "How did the evening coming to an end?"

The accused replied: "There was a hug, a kiss on the cheek and a nice meeting you ... "I said 'let me know about tomorrow'."

The detective then asked him to identify where on a map the accused last saw Millane.

"I didn't," the accused replied. "I know it sounds bad, but I started talking to a group of people ... I started talking to a group of Chinese travellers. They were walking across the road."

Settle seemed perplexed.

"Okay, you just started talking to a bunch of tourists?"

"Yeah," the accused said.

The accused says on December 1, he was probably carried into his apartment by the hotel concierge - something that happens regularly, he claims.

He says he probably drinks too much alcohol because he saw his dad drinking as a child.

The next day, he claims he woke up around 9am or 10am in his apartment feeling very unwell.

But at around 4pm, he met a work friend at Revelry bar in Ponsonby.

He says he was with her until about 7pm when he caught a taxi and went to countdown to grab some snacks and water bottles on his way home.

On Monday, he called in sick for work, as he was not well after two nights of drinking alcohol, he said.

"I slept all day," he said.

11.05am

In the videotaped interview Detective Ewen Settle asked the accused to return to the sports bar he claimed to have visited on Queen St after meeting Millane.

"Can you describe that pub to us again?" the detective asked.

"It had only Lion products on tap. I asked for a Corona, they said they didn't do that. I asked for a Heineken and they said they didn't do that. I had to have a Tui.

"It was pretty old and dusty place."

Settle asked who the accused was socialising with.

"Whole lots of people, it was usually the people who were smoking outside," the alleged killer replied.

He then said he drank 10 beers at the pub over about two hours.

Settle wanted to know how he paid for the brews.

"I had cash," the accused said. "And low and behold the cash went pretty quickly."

Settle said: "So you were not using your card in that place, you were using cash?"

"Yep," the accused replied.

"Any particular reason you used just cash?"

"I had cash on me, I don't normally have cash," the accused said, adding he spent between $150 to $300.

Settle asked: "How do you handle your alcohol?"

"I know I definitely started singing that night ... Beer I can drink it until the cows come home.

"I was definitely having water that night too."

"After the questioning is over, Detective Sergeant Ewan Settle asks the accused if he would be willing to give a voluntary DNA sample.

He explains police are gravely concerned for the wellbeing of Grace.

He explains the forms he will be giving the defendant to fill out are "suspect" forms, and they are "laborious" and "quite confrontational."

"We think someone may have murdered her..." Settle said.

"... And it could be that you've done it. That's why we are asking you to provide a suspect sample while we investigate the disappearance of this young girl."

The defendant asks: "Do I need someone to look at them [the forms]?"

After Settle leaves the room, the defendant knocks on the closed door and asks: "Am I being arrested for something I didn't do?"

He is told by another officer that he isn't at the moment and it is an ongoing investigation."

Maybe this story of his would have had a fighting chance in a world without cell phones, digital evidence and surveillance cameras, but COME ON.

Why would a jury believe a word he says when it comes to the heart of the matter
 
"11.25am

On the Thursday night, November 29, the accused said he got blind drunk at a work function and ended up sleeping outside.

"I ended up sleeping outside the hotel and the concierge helped me upstairs," he told Settle.

"I tend to drink and somehow end up in bed ... I don't know how I ended up in bed that night.

"One of the Indian concierges said he helped me up to my room."

The accused added the reason he had a lot of cash on him was after the work function he intended to catch a taxi, but later caught at tuk tuk.

The alleged killer said on the night of December 1 he was again blind drunk and may have been aided to his bed again by hotel staff.

He said he woke at about 9am or 10am in his apartment.

"How did you feel?" Settle asked.

"I had a bit of a vomit, I knew I mixed drinks because I felt crap."

The accused said he then went and had a steak at a pub in downtown Auckland before meeting a friend later in the day in Ponsonby."

"Settle reads the accused his rights, before he begins the next line of questions.

"You've been pretty explicit about your movements. You met Grace at around 6pm at Andy's Burger Bar, you departed company at 8pm and then you went down to a bar to the point you can't remember anything else. You woke up at 9am or 10am the next morning..." Settle confirms with the defendant.

"Yes," he says.

Settle then shows the accused a photo of him taken in the hotel lift of the CityLife hotel, carrying a suitcase at 8.14am on that same morning.

"That's you walking in with a suitcase at 8.14am," Settles says.
"I'm still sure it was 10am, I'm still sure of it," the defendant responds.

There is a pause.

Then Settle says: "Is there something you want to ask?"
"There's a big difference between walking up at 10am and walking in at 8.15am with a suitcase. Can you explain that?" Settle asks.

"I've still got that suitcase ... it's in my room," he replies.

"You haven't told the truth about being completely drunk on Saturday night," Settle says.

"Maybe I got the time wrong? I had been very drunk the night before ... I'm being truthfully honest with you,I still have that bag in my room," he says."

11:39am - After another short break, Det Settle tells the man they have reached a point where he needs to advise the accused of his rights.


He then shows the man a picture and asks him whether he is in it. The accused says he is.

The picture is of the accused in the CityLife elevator at 8am on December 2 with a suitcase.

Det Settle asks how this can be as the accused had told him he was asleep until 9am or 10am.

"I may have got the times wrong."

The accused soon tells Det Settle he purchased the suitcase that day at The Warehouse.

The detective again questions how that can be if he was asleep. The accused then admits he had been at the Warehouse in the morning.

Soon after this, the video interview ends.

Det Settle tells the court that the accused purchased another suitcase on December 3.

11:43am - Under cross-examination, Det Settle confirms to the court that sometime after the end of the video, the accused asks to see a lawyer. Defence lawyer Ian Brookie soon arrives.

Det Settle has now finished giving evidence and the court is taking a short break.


The woman the accused had a drink with in Ponsonby on December 2 is also expected to give evidence.

"Where is it?" Settle said.

"In my room."

The suspicious detective asked him to explain his story.

"I might have got the times wrong," the accused said.

"If you're assuming that I've used that suitcase for something, then I've still got it and you can have it."

Settle said: "You haven't told the truth about being completely drunk on Saturday night .. This is quite important."

The accused replied: "I'm being truthfully honest with you."

Settle's questions then became more pointed.

"Where were you that night?"

"I've told you," the accused said. "That bag is still in my room."

"What's in it?" Settle asks.

"Nothing."

"Where did it come from?"

The accused said he bought it from the Warehouse in downtown Auckland.

"So wait a minute, now you're saying that you went to the Warehouse in the atrium?" Settle said.

"Now that you show me that, yeah," the accused said."

"Settle said: "It's possible that someone has killed her ... We don't know if she's been murdered or not, we don't know yet, she could be found, but she could be dead.

"And it could be that you've done it."

Settle then left the room again briefly.

The accused knocked on the door and asked: 'I just wanted to ask a question, have I been arrested for something I didn't do?"

"Holy ," he can be heard saying."

He’s cracking... I’m guessing he couldn’t fit grace in that suitcase so he had to go buy a bigger one the next day. How disturbing? I wondered why that grey suitcase was just randomly out in his bedroom and why he hadn’t used that one. Makes sense now
 
12:05pm - The court has now resumed, with Det Adam Bicknell returning to the witness box. He is the officer in charge of CCTV footage and previously gave evidence to the court.

The last shot of CCTV footage the jury saw was Millane and the accused leaving the CityLife hotel elevator. The jury is now seeing video from December 2 at 8am, with the accused going down in the lift.

The public gallery continues to be overflowing with people.
