U.S. Attorney’s Office files motion to involuntarily medicate man accused of Ashanti Billie’s murder

SEPTEMBER 12, 2019

"...According to court documents, the U.S. Attorney’s Office is seeking to restore Eric Brian Brown’s competency to stand trial in Billie’s murder. It requested a hearing on whether or not Brown should be medicated be held no earlier than the first week of November 2019 “in order to provide the parties an adequate opportunity to arrange for expert witness testimony.”

Since Brown’s arrest, staff at the Butner Federal Medical Center has been working to restore his competency to stand trial. A judge ruled Brown could be involuntarily medicated in June 2018, but at a August 2019 hearing, Brown was still considered incompetent to stand trial.

The death penalty was taken off the table by the U.S. Attorney General, but if convicted, Brown still faces a mandatory minimum sentence of life in prison."

New charges filed against man suspected of kidnapping, killing Ashanti Billie

"...In the short term, however, the new indictment handed down Thursday in U.S. District Court in Norfolk will have little practical impact on the case.

Eric Brian Brown — who has been diagnosed with schizophrenia — remains incompetent to stand trial....

Following his arrest, state prosecutors filed murder charges against Brown in Charlotte, N.C.

Brown was subsequently indicted in December on one count each of kidnapping resulting in death, assault resulting in serious bodily injury and theft. The new indictment adds charges of assault with intent to commit aggravated sexual abuse, assault with intent to commit a felony and stalking.

In court documents, prosecutors have said the “positioning of the victim’s body” and the conditions of the victim’s clothing was “suggestive of sexual assault.”

If convicted on the kidnapping charge, Brown could have faced the death penalty. Prosecutors, however, announced in August they would instead seek life in prison...."

3/22/19 Update: A competency hearing for 3/27 has again been put on hold. Brown has been ordered to be committed at Butner Federal Medical Center in North Carolina for an additional 120 days, where he will undergo more evaluation. Approximately around July 11, 2019.
8/6/19 Update: Federal prosecutors will not seek the death penalty. Brown's public defenders have objected to their client's forced medication. A hearing on whether it is still appropriate is expected later this year. Prosecutors asked the court in June to let them have their own experts examine Brown.
7/11/19 Update: Status hearing on 8/6. 8/6/19 Update: No appearance by defendant. Court grants Gov’t’s motion (#91) for psych exam. Defendant be committed to medical facility in Butner, NC for an additional 120 days; such commitment will expire 11/15/19. The Court ORDERS the director of medical at Butner to advise the Court as to Defendant's status by 11/8/19. The Court ORDERS the BOP to file any addendum to its 7/11/19 letter within 20 days of this Order, and ORDERS the BOP to provide all counsel with updated records on Defendant within 15 days of this Order.
10/1/19 Update: Indicted & charged (10/1/19) with kidnapping resulting in death, criminal forfeiture, assault with intent to commit any felony, assault resulting in serious bodily injury, theft of personal property & stalking.

It has now been over a week since the car of a college student was found damaged in Montgomery. Aniah Blanchard is still missing, and police are saying they believe foul play is involved.

Blanchard is the same age as a woman from Maryland named Ashanti Billie, for whom the "Ashanti Alert" was named. It's similar to the amber alert, but used for adults, and Blanchard's case would have applied.

It's been nearly a year since President Trump signed that bill, but a nationwide system has yet to be set up.

The Alabama Law Enforcement Agency told WAAY 31 they'll be ready to roll it out as soon as they get word. For now, local parents are reminding their kids about staying safe.

Case against man accused of murdering Virginia Beach college student in Federal Court

NORFOLK, Va. - For hours on Tuesday, the question of whether Eric Brian Brown will be able to regain his competency through medication was argued.

Brown was arrested and then diagnosed with schizophrenia. Since then, he has been held in federal care facilities. He is currently at FMC Butner in North Carolina. Since his arrest, he has refused to voluntarily take medication. However, he has been forcefully medicated at times because according to staff he has been violent and attempted to attack guards and staff.

During the hearing on Tuesday morning, Dr. Logan Graddy, a doctor and Chief Psychiatrist at FMC Butner, took the stand for the prosecution.

Dr. Graddy testified that if Brown was put on one of the facility's treatment plans, he believes Brown could regain his competency and stand trial for the crimes he is accused of.

The defense argued that since Brown is still not competent, even after being forcefully medicated against his wishes, he shouldn't be medicated any further.

..... Their witness, Dr. George Corbin does not treat Brown, but spent 16 hours with him over the course of nine visits.
[.....]
After hearing arguments all day, the judge asked both sides to submit a summary of their findings within seven days. The judge will then make his ruling.

"I am profoundly disappointed that the department has failed to implement the Ashanti Alert system in a well-organized and competent way," wrote Warner. "I look forward to the department's report and expeditious implementation."

Warner's full letter can be read at the bottom of this article.

The system is named for Ashanti Billie, a college student in Virginia Beach who was abducted and murdered in 2017.

Due to her age, she was ineligible for the AMBER and Silver alert systems.

Virginia created a state version of the Ashanti Alert system during the summer of 2018 and the first alert issued under it was for a missing man from the Charlottesville area.
