Man charged in Mandan killings challenges search warrants - KNBN NewsCenter1


FARGO, N.D. (AP) — A man charged in the grisly killings of four people at a North Dakota property management company argued in a filing Wednesday that authorities failed to obtain proper search warrants involving cell phone location and other searches and evidence should be thrown out.

Chad Isaak, 45, has pleaded not guilty to four counts of murder in the April 1 shooting and stabbing deaths at RJR Maintenance and Management in Mandan. Isaak lived in a mobile home park managed by the agency in Washburn, about 35 miles north (56 kilometers) north of Mandan. Police have not identified a motive in the killings.

Defense attorneys in a separate filing asked that his trial be moved from Morton County due to pretrial publicity. “Mr. Isaak can hardly enjoy an impartial and fair trial when already convicted by the media as a ‘mass murderer’ to the Morton County public,” the motion reads.

Isaak argues that law enforcement failed to properly obtain warrants for his home, his business, his truck, his social media accounts and his electronic devices. He says even if the state suspected him of committing the killings, the warrant applications were overbroad and failed to allege specific allegations, most importantly the failure to reference any cell phone, tablet or computer possessed by the suspect. That does not meet requirements for probable cause and taints other searches in the cases, the motion reads.

Eric Nelson, a Minneapolis criminal defense attorney, said it’s not a frivolous argument and the court “should ultimately chew on it” and analyze the data that was requested.

“I think the distinction on whether or not the motion has merit depends upon what they were specifically asking the cell providers to give them,” Nelson said. “Was it specific to one individual and one phone number or was it broader and capturing anybody who might be in there?”

Morton County prosecutors did not return a phone message seeking comment.

They said the warrant sought all device data in the target zone, vacuuming up untold amounts of unrelated devices’ data.

The defense team used this example in court documents: “probable cause does not exist to search every garage within a five-mile radius when a vehicle theft occurs. Similarly, probable cause does not exist to search all nearby data when a homicide occurs.”

Here’s what the defense wants to be thrown out:

  • Google search information
  • The search of Chad Isaak’s F-150
  • The searches of electronic devices owned by Isaak including his cell phone and computer hard drive
  • Evidence found during searches through Isaak’s business Facebook account
Documents refer to all of this as tainted evidence — creating a chain reaction of evidence stemming back to the original information gained through the CSLI evidence that did not come from a warrant.

While Isaak is asking for evidence suppression, he’s also asking for a change of venue.

Isaak said substantial pretrial publicity has prejudiced his ability to receive an impartial trial in Morton County.

The defense team claims media has branded him as a mass murderer instead of affording him the presumption of innocence.

While the defense has placed all these motions into the court record, there will be another hearing.

On Dec. 19, Judge Gail Hagerty is expected to hear the motion on suppression back at the Morton County Courthouse at 9 a.m. bbm

Documents filed Monday show the trial for Chad Isaak, 45, will start Sept. 14 in Morton County. South Central District Judge Gail Hagerty set aside 10 days for the trial.

Assistant Morton County State’s Attorney and defense attorney Robert Quick signed a stipulation to continue the trial, stating that it's necessary “due to the excessive amount of discovery in this matter.” "Discovery" is a legal term referring to evidence exchanged by attorneys on opposite sides of a case.

Hagerty, who recently announced her resignation effective in March, has assigned the case to Judge James Hill.

The North Dakota Board of Chiropractic Examiners recently suspended his license pending the outcome of the case.

MANDAN, N.D. (AP) — The trial has been delayed again for a man accused of killing four people at a North Dakota property management company.

Chad Isaak's trial was rescheduled for the second time in two weeks, The Bismarck Tribune reported. Court records show Isaak's trial is now scheduled to start Nov. 30, 2020.

A new judge also has been appointed. Attorneys for Isaak filed a demand to change the judge. No reason is listed. South Central District Judge David Reich is now assigned to the case.

Thanks @Niner -- the demand for the change in judge came on the heels of the judge's decision for suppression of evidence. Justice delayed for an entire community. :eek:
 
I can’t believe the lack-of information out there regarding this. I also can’t believe this guy has the balls to demand all of these things (change in venue, suppression of evidence etc) all the while pleading not guilty. What a slap in the face to the families.

I think it's a clue that CI doesn't want any information about his life, property, or finances to be exposed. It's a ridiculous request to demand all electronic records or data suppressed. I hope the hearing this month will provide some hint towards the motive. MOO
 
Agree- I am most intrigued by the MOTIVE for this senseless, horrific crime. I hope the prosecutors have figured it out (I know they don't have to show motive to prove their case) not only for our sake (selfish) but most importantly to provide some sense of closing the loop for the families.

that is a hint toward motive IMO

I don't expect CI will have much success with his suppression request -- search warrants were obtained.

Police look to Facebook, bank records in quadruple murder

MANDAN, N.D. - Police are turning to Facebook and bank records to try to identify a motive for why four people were killed at a North Dakota business two months ago.

Mandan Police Deputy Chief Lori Flaten says police are "trying to cover all the bases" in their investigation of the April 1 deaths of RJR Maintenance and Management co-owner Robert Fakler and three workers. Authorities say they were shot and stabbed at the business in Mandan.

Washburn chiropractor Chad Isaak is facing murder charges in the case.

Court documents show police have sought search warrants for Isaak's personal and business bank records, as well as victims' Facebook accounts.

Flaten says it's possible police will never uncover a motive, but wouldn't comment on how that could affect Isaak's prosecution.
