911 calls detail effort to find Renezmae
Victoria Maestas’ voice choked up with fear and panic as she told a 911 dispatcher she had just learned her daughter, 5-year-old Renezmae Calzada, had been missing for more than 10 hours.

“My poor baby … my baby … my baby … I can’t breathe,” Maestas told the woman who took her call around 7:40 p.m. Sept. 8. Authorities have said they believe Renezmae was last seen around 9:30 a.m. that day.

[...]

Within just minutes of Maestas’ call, dispatcher Fernando Andrade was on the phone with New Mexico State Police, asking the agency to prepare a search and rescue team.

And within an hour, Rio Arriba County sheriff’s deputies were on their way to the Dairy Queen in Española, where they arrested Malcolm Torres, Maestas’ former boyfriend, on outstanding warrants in an unrelated drunken-driving case and booked him into the Rio Arriba County jail in Tierra Amarilla.

[...]

The state Office of the Medical Investigator in Albuquerque has not yet completed an autopsy on Renezmae’s body to determine the cause of death, spokeswoman Alexandria Sanchez said in an email Monday.

FBI spokesman Frank Fisher said in an email he had no new information on the case.

[...]

Although law enforcement officers said Torres was not a suspect in the girl’s death at the time of his arrest, 911 dispatch calls reveal a hasty move to find him, bring him into custody and request an interstate criminal background check. Deputy Dwayne Epling reported to the dispatch center he had Torres in custody just before 9 p.m. Sept. 8.

Later that night, law enforcement converged on Torres’ home on Arch Lane in Española to set up a search team and call in a K-9 search unit. Just before midnight, dispatch records indicate, the FBI was “sending down people” as well.

[...]

Early law enforcement and media reports of the girl’s disappearance said Maestas first called 911 around 6:30 p.m. Sept. 8. But her initial call was made over an hour later from her workplace, the Santa Claran Hotel Casino.

“My daughter is missing,” Maestas told a dispatcher. “She was with her dad and we can’t find her.”

[...]

But Maestas did not mention the girl’s name. Asked by the dispatcher to describe what the girl was wearing, Maestas said, “I don’t know what she was wearing. She was with her dad. They just told me now she has been missing since 9:30 this morning.”

Neither Renezmae’s name nor her description comes up in the dispatch dialogue until past 9 p.m., when Andrade asks for that information to “get the ball rolling that way — it’s been way too long.”

Police issued an Amber Alert for the girl around 10:45 p.m.

[...]

One law enforcement officer later called Andrade, saying Torres’ grandparents had said Torres told them he also had called 911 to report the girl missing.

Andrade said he searched 911 calls back to “1400 [2 p.m.] and I can’t find anything.”

It's probably a miracle they located him.

Thank you!

This is what happens when we have "Sanctuary Cities" that do not report undocumented immigrants to federal authorities prior to release. Criminals are released, back into the community.

I am sure that Torres had a "hold" on his sheet, for federal detainer. Whoever released him, thought it was for Immigration Customs Enforcement, and ignored it.

'Dangerous' Española murder defendant went free

I won't say what I think happened here...
The article is dated October 30. A few notes:
  • A federal judge determined that MT was too dangerous and too much of flight risk to be allowed out of federal prison pending trial.
  • Two days earlier, MT was released for several hours even though a grand jury had indicted him for second-degree murder the month before. However, the indictment was sealed.
  • A spokeswoman for the MDC, said MT was released at 10:03 a.m. Sunday.
  • She said “MDC did not notify any agency that Mr. Torres was being released, because we did not receive a federal warrant or detainer.”
  • MT was arrested later Sunday at Pojoaque Pueblo by the FBI with help from the Española Police Department.
  • MT was indicted for Mae Mae’s death on Sept. 24, and a federal arrest warrant was issued the same day. But both documents had been kept under seal until after he was arrested Sunday in Pojoaque.
  • MT was arrested the night of Sept. 8, the day Renezmae’s disappearance was reported, but only on unrelated charges.
  • On Sept. 25, he was sentenced to 64 days in jail. He was released Sunday after spending 32 days at MDC.
  • At arraignment for the murder charge in U.S. District Court, MT pleaded not guilty. No details of the murder case have been made public.
  • MT also waived his rights to a detention hearing.
  • “I find that you are both a danger to the community and a flight risk,” Magistrate Judge Kirtan Khalsa said.
  • MT received credit for the 26 days in the Rio Arriba County jail in Tierra Amarilla after his Sept. 8 arrest, and he also earned a sentence reduction for good behavior. “Which left him 32 days to serve,” Hopkins said.
  • Police have said from the start of the case that Renezmae was last seen alive on the morning of Sept. 8, but the federal indictment for second-degree murder says Renezmae was killed “on or about Sept. 7.”

Prosecutors, defense request delay in Renezmae Calzada murder suspect’s trial
[...]

Attorneys on both sides have now filed a joint motion requesting a judge to designate the case as “complex,” which could significantly extend the amount of time before a trial takes place.

[...]

Court paperwork indicates that prosecutors have thousands of pages of discovery, multiple recordings, and a copy of what was on Torres’ cell phone, including nearly 30,000 photos.

Medical investigators haven’t finished Renezmae’s autopsy either. Prosecutors expect both sides may have to call up multiple medical experts to testify about how Renezmae died.

[...]

The U.S. Attorney’s Office for New Mexico has yet to say when they’re hoping to take Torres to trial. A federal judge could make a ruling on the request for an extended trial sometime next month.

Torres is due back in federal court on December 2.

30K photos on a phone? I didn't know that was possible.

Dear Lord....please tell me none of those photos have anything to do with lil Renezmae.......because if so, he could have sent them to ANYONE.......:(:(:mad: That could be what “complex” means!!!! MOO!

Unfortunately my immediate thought was that they wouldnt have mentioned them if they weren't relevant to the case, and I think that means that at least some of them are quite possibly photos of Renezmae that are not completely innocent:( Hipefully it is just my jaded suspicious mind and I am completely wrong. Española artists come together to paint mural of Renezmae Calzada
A group of artists is working on a project they hope will help heal the community of Española. It’s a mural of Renezmae Calzada who died at just five years old. They say they wanted to not only honor Renezmae, but the entire community, as well, with a beautiful piece of art that will last for years.

“Our hearts hurt deeply for her family,” said AS, one of the artists. “Our hearts hurt deeply for the community.”

[…]

“I’ve been looking for someone to put a mural on this wall for a long time,” said JW, President of the Española Firefighters Union. “These two artists came together.”

They’re painting the mural on their own time, after work and on the weekends. Every detail has Renezmae in mind.

“Her favorite teddy bear, that we incorporated, we implemented, as well as her favorite colors which is pink, blue and purple,” said AS.

[...]

Sandoval and Morfin say there’s still some work to be done on the mural. They plan to add angel wings on Renezmae, along with her name, and on the other side of the wall, they will add the first responders and names of everyone who helped in the search.

I had to go up North for work today so I left a Christmas bouquet for Renezmae* at her mural at the Wise Fire Station.
(*from all of us on here [WS] who fell head-over-heals in love with her from the first time we saw her sweet face)
Then I sat in my car and sobbed for 10 minutes before I could gather myself enough to drive home. :(

Remembering Renezmae- including her smirk
The life of Renezmae Calzada was unfairly snuffed out in September, but the spirit of the feisty 5-year-old is clearly visible in a mural on the Wise Fire Station.

Toby Morfin, a professional artist, and Adrian Sandoval, a Los Alamos National Laboratory employee who is known for his airbrush painting, have been working on the mural since mid-November.

They expect to finish it in the next month, weather permitting.

“When I read the story, it touched me because I have daughters,” Morfin said in an interview on Jan. 14. “I didn’t want this little girl to be forgotten.”

“The family had ideas about the colors they wanted. They gave us a picture of her in a red-and-black check dress that she had worn for Christmas,” Morfin said.

“They wanted to make sure we got Renezmae’s smirk right. They stressed the smirk,” he said.

‘Mr. Bear’
Renezmae’s constant companion, a teddy bear she called Mr. Bear, wasn’t in the photo, but the artists’ portrait shows her carrying it under her arm. In their mural, Mr. Bear is shedding a tear over the loss of his human friend, whose nickname was MaeMae.

[...]

Painting the mural has been a very emotional experience, said Sandoval and Morfin. Family and community members have come by to share their reminiscences of Renezmae and to bring the artists food and drink.

[...]

Morfin and Sandoval have given Renezmae a set of angel’s wings, which they are still working on. Although most of the mural is done, the artists must still finish the lettering for Renezmae’s name and a logo for the firefighters’ union that says “Serving the Española Valley since 1937.”

The final step will be applying an anti-graffiti finish to the mural to prevent anyone from damaging it. When people have “tagged” other public art in town that has this finish on it, the graffiti has been easily removed, Morfin said.
