Plea deal expected in Alexa Randolph murder case
The man charged with first-degree murder in the beating death of his grandson’s mother is expected to enter into a plea agreement Tuesday.

By using cell phone data, detectives determined Randolph had very recently been at the Smith’s residence. Smith immediately became a person of interest after the first interview, according to detectives.

On Jan. 29, pings from Randolph’s cell phone led police to the Walmart on Hornbeck Road where her body was found in the cargo area of her Ford SUV. Police also recovered surveillance video from the Walmart showing a subject fitting the description of Smith leaving the parking lot on foot.

An autopsy determined Randolph died of asphyxia and blunt force trauma. Consistent with the large amount of blood evidence found in Smith’s garage. The autopsy also determined Smith’s DNA was under the victim’s fingernails, signifying a struggle.

Smith will be sentenced on Nov. 2 at 4 p.m. The plea bargain will allow Smith to have a chance for parole after 15 years behind bars.

A West Virginia man has entered an Alford plea in the death of a woman from Fayette County.

Gary Smith II, 60, of Morgantown, appeared Tuesday by video from North Central Regional Jail to enter the plea in which he didn’t admit guilt but recognized there may be enough evidence for a conviction, The Dominion Post reported.

Gary Smith II, 60, entered what is called an Alford plea, which allows him to enter a plea without admitting guilt. However, he faces the same penalty as if he had pleaded guilty.

The plea will allow Smith and the families involved to avoid a trial in the killing of Alexa Randolph, who was last seen alive on Jan. 28. He also will be eligible for parole after 15 years in the plea agreement. Had he been convicted at trial, the jury could have determined not to grant mercy, which means no parole would have been possible.

As a result of the plea, Smith will receive a determinate sentence of life in prison with mercy, which means Smith may be eligible for parole after 15 years, the prosecutor’s office said.

Despite the sentence being set, a sentencing hearing will take place before Tucker at a later date in order for the victims to speak and prepare victim impact statements, according to the prosecutor’s office.

Smith told the court his attorney did not properly present all the options he had in the case and he had been denied his full discovery information as required by law. Smith went on to tell Judge Tucker he was under duress, confused and felt his court appointed attorney forced him to take the Alford Plea.

Despite objections from the prosecution, Tucker relieved Wilson and delayed proceedings until a new attorney is appointed.
