"I think I could do it on my own sir. It's a constitutional right that I have," said
#Stauch. She doesn't believe experts in the legal system hold much value in this case. The judge tells her it typically doesn't go well for those who represent themselves.

"As we sit here today, you don't know how you would introduce evidence. Is that fair?" That's fair, says
#Stauch. The judge asks if she thinks an attorney with experience would be helpful. Stauch says no, because she has "23 hours a day" to work, while they only have a couple.

Now the judge compares this situation to a dentist. Asks Stauch if she would have taken a drill to her own mouth, rather than having an expert do it.
#Stauch says this is different.

Judge: "There's a fundamental risk that you may not understand the rules of evidence and procedure as well as someone with experience... and that could very well work to your detriment. Do you understand that?" Stauch: "Yes sir."

#Stauch compares this situation to poker, and believes she has an "ace in the hole" on this case, insinuating she is innocent.

Judge: "It sounds as though if the attorneys were able to be there, and be there in person, you would feel differently?" Stauch: "I wouldn't know sir, it's been a year." Stauch says her situation is different than any other inmate. "It would be better for me to represent myself."

Stauch calls her attorneys "fine ladies," but blames the jail for not being allowed to meet with them like she should be. "That's the reason I want my own discovery and evidence. It's not a conflict." She says it's not because they haven't tried to do their job.

If we were to get close to trial and
#Stauch changed her mind and wanted an attorney, the court could find it's just a delay tactic, and she could be stuck with her decision. He wants her to understand that possibility is there. "They went over that with me," said Stauch.

#Stauch says she knows those two pieces of evidence will come into the courtroom under the rules. The judge says that's a pretty big gamble to take. Stauch says she doesn't think so. She doesn't want a different counsel to advise her on if she should represent herself.

Stauch says she's a "believer in Christ," and she goes with what he tells her, and "this is what she's confident in... I am so confident in the fact that there's two pieces of evidence, that no science can discredit, and it will clear my name."

"If you were to misbehave in a courtroom, I would have you removed, and the case would continue on," says the Judge. He doesn't say
#Stauch has been doing that.

Judge asks if
#Stauch understands the significant amount of evidence in the case. "It doesn't matter the significant amount, I'm still entitled to that," said
#Stauch. If she doesn't have the time to go through it, that would not stop the case.

Allen says there's roughly 30,000 pages of discovery in this case. The investigation extended from northern El Paso County, all the way to Florida and South Carolina. "This is an extensive case. It would be very difficult for somebody just getting discovery to get up to speed."
Colette Bordelon @ColetteBordelon 8m
Stauch wants to waive the preliminary hearings scheduled in March (proof evident, presumption great). Stauch: "I know what evidence there is, I can't say certain things 'cause it's on recording, I have to protect myself, I need to keep quiet about that part."
