From the sentencing remarks:

In Bolland’s case there is no mitigating factor at all other than the very limited
benefit to be gained from the absence of any serious offending in the past. In Worrall’s case there is the fact that he did not intend to kill as well as his limited criminal history. For the reasons I already have given I give some but not
substantial weight to the lack of an intent to kill.

The sentence required by law for the offences of murder is life imprisonment.
That is the sentence I impose on counts 1 to 4 in relation to Bolland and
Worrall. In Bolland’s case I consider that the appropriate minimum term is one of 40 years less the time spent on remand. In Worrall’s case the appropriate minimum term is 37 years less the time spent on remand.

Jury sworn in
A jury of seven men and five women has now been sworn in, and the trial is due to get underway here at Manchester Crown Court.

The judge, Mrs Justice McGowan, is addressing the jury with some opening remarks about how the trial will work.

The jury are all wearing masks and are sitting in an adapted jury box, with perspex screens separating them.

Social distancing is being observed by others in court.

"This is a safe way of working," the judge says.

Prosecutor Paul Reid QC will start his opening statement shortly.

Mr Reid is now starting his opening statement.

He tells jurors that Bolland and Worrall are charged with the murder of Michelle Pearson on August 25, 2019, following a house fire on December 11, 2017.

Jurors are told:

"Michelle Pearson died as a result of the injuries she sustained when Zak Bolland and David Worrall threw petrol bombs into the house where she was asleep with five of her children who were aged between three and 16 years old."

Jurors are told a third person, Courtney Brierley, was with Bolland and Worrall and 'encouraged and assisted' them.

They are told she is not on trial as she has 'admitted her guilt for what she did in causing the death of Michelle Pearson'.

Mr Reid says Ms Pearson's four youngest children died either that night or very shortly after.

Ms Pearson was 'very seriously injured' but 'clung onto life' until August 2019 when she died, the court is told.

Jurors are told Bolland and Worrall previously stood trial for causing the death of the four children.

They are told they 'denied their guilt' but were both convicted of the murder of the four children.

Ms Pearson was alive at the time of the trial but was too ill to take part, Mr Reid says.

Mr Reid tells jurors:

"Your task is made easier in this trial by your knowledge of their convictions in 2018.

"The prosecution say that if Michelle Pearson had died before that trial took place, that jury in 2018 would undoubtedly have convicted Bolland and Worrall of the murder of Michelle Pearson.

"We invite you to come to the same conclusion."

Jurors are told there was a 'continuing feud' between Zak Bolland and Kyle Pearson and other members of the Pearson family.

Prior to the fire, windows at the Pearson house on Jackson Street had been smashed by Zak Bolland, jurors are told.

A wheelie bin had been set alight in the garden on December 9, a few days before the incident on December 11, 2017, the court hears.

At about 5am on December 11 the house at Jackson Street was 'ablaze', jurors hear.

Kyle Pearson and a friend who was staying at the house, Bobby Harris, were able to escape.

Kyle Pearson's three siblings in the bedroom next to his 'perished' in the fire.

They were 15-year-old Demi, eight-year-old Brandon, and seven-year-old Lacie.

Michelle Pearson made her way out of her home with her youngest daughter Lia.

Lia, three, died two days later.

Accused threw two petrol bombs into the house, prosecution alleges
Jurors are told that Bolland and Brierley were boyfriend and girlfriend, and Worrall was a friend of both.

Shortly before 5am on December 11, Bolland and Worrall went to the back of the Pearson house on Jackson Street and had 'homemade petrol bombs', prosecutors say.

The two men removed a fence panel to gain access, smashed a kitchen window and threw two petrol bombs into the house, prosecutors allege.

Jurors are being told about the background to the incident.

Bolland and Kyle Pearson had been friends until about a fortnight before the fire, the court heard.

Things 'turned sour' following an incident on November 26 when Bolland's car was set on fire.

It appeared Bolland felt that Kyle Pearson was in some way responsible for the damage, jurors are told.

Bolland later contacted Michelle Pearson, who told him that the car fire had nothing to do with her son.

Mr Reid describes a number of 'tit for tat' incidents that followed.

Bolland 'threatened violence' at Pearson house, jurors told
Mr Reid is now moving to events surrounding the fatal fire.

Bolland was at home with Brierley with two other men and were watching the Manchester derby being played at Old Trafford on Sunday, December 10, 2017.

They later went to an off licence to buy some beer.

At about 12.30am on December 11 Bolland, Worrall and the two other men went to Jackson Street.

Bolland mentioned 'problems' he had been having and he wanted to go to 'some lad's house'.

Ms Pearson was woken up by one of her daughters and noticed the men, recognising Bolland.

Bolland was 'threatening violence' and said he was 'going to do your house', jurors were told.

He demanded that the two older Pearson children came outside.

Ms Pearson denied either was there.

Kyle Pearson claimed he heard Bolland shout that he was going to 'kill us all'.

Bobby Harris claimed he heard Bolland shout something like 'watch, all your family's getting it, they're all gonna die'.

The men left and Ms Pearson called the police.

Officers arrived later and she made a statement, and she and the children went back to bed.

A woman called Abigail Toone was trying to find her boyfriend, who was friendly with Bolland. She went to Bolland's home.

Ms Toone heard Bolland and Worrall talking together, she claimed they were getting 'really loud and aggressive'.

They seemed to be planning something, Mr Reid says.

Later they got up and Worrall took an axe and Bolland a machete, the court hears.

Bolland told Ms Toone to drive them to a petrol station.

Mr Reid said:

"The men pulled their hoods up, got out of the car with their home made petrol bombs and ran off up Jackson Street."

They were gone for a few minutes and re-appeared running from a ginnel.

After returning to the car Bolland allegedly said 'go, go, go, drive to mine, go to mine'.

Worrall allegedly said 'oh God, that was real weren't it' ... 'like he enjoyed it', Mr Reid says.

The car returned to Bolland's home, and Ms Toone left in the vehicle.

An investigation into the cause of the fire was launched by police and the fire service.

Mr Reid says:

"Two improvised incendiary devices had been thrown into the house through the broken window."

The smaller of the two, a Budweiser beer bottle, caused relatively little damage, the court hears.

The larger of the two petrol bombs was a clear glass bottle.

Kyle Pearson woke up his friend Bobby Harris and they both climbed out of a window.

As he escaped through the window he saw his sister Demi come to her bedroom window.

Kyle Pearson's immediate thought was to get back into the house to try and save other members of his family, jurors are heard.

But he was unable to get back into the house.

He had previously wedged the front door shut 'to prevent Bolland and his associates gaining unlawful entry'.

Mr Reid said it was a 'tragic irony' that it now provided an 'insurmountable barrier' stopping him from getting back into the house.

Firefighters arrived at the scene.

Demi, Brandon and Lacie were all pronounced dead within a short time.

Lia was still alive when she was rescued, but she died on December 13.

Mr Reid says:

"Michelle Pearson was admitted to Wythenshawe Hospital with 68 per cent total body surface area burns and inhalational injuries.

"Without prompt medical attention, her death would have been inevitable shortly after that incident.

"However, she survived following intensive care within the hospital environment.

"Her continued care required a large number of surgical procedures.

"She developed a number of complications such as infections and burn scar tissue breakdown leading to open wounds.

"Michelle Pearson succumbed to her injuries on August 25, 2019."

Mr Reid is now telling the jury of the developments leading to the arrests of Bolland, Brierley and Worrall.

Worrall had previously agreed to help a friend's girlfriend move house on the afternoon of December 11.

The day after, Mr Reid said Worrall told the friend he hadn't been at Jackson Street at the time of the fire.

Worrall allegedly told him:

"Zak threw a petrol bomb through the window."

He allegedly said that Bolland knew there were children in the house.

Bolland and Brierley were arrested at about 6pm on December 11.

The following day, on December 12, Bolland was charged with murder and attempted murder, jurors hear.

Worrall was arrested on December 12 in Pendlebury, jurors are told.

"Worrall claimed that he was going to hand himself in as a witness to the crime, and only realised from talking it through that he was part of the arson.

"He claimed that he was stupid, drunk and a little fearful of saying no to Bolland due to history."

Bolland says that he believed the house was empty and his only intention was to cause damage to the property, not to injure anyone.

He claimed Worrall broke the kitchen window with an axe, and that Worrall threw a petrol bomb before he threw a second petrol bomb.

Mr Reid says: "In summary, Bolland's case is that the idea to set fire to the house was Worrall's."

Jurors are told Bolland admits making the petrol bombs and being involved in throwing them but says he only meant to cause damage to the house, and didn't think there was anyone in the house.

"He knew or at least believed that the house was occupied and that there were children there, as, he says, did Bolland," Mr Reid said.

Jurors are told Worrall says he played no part in setting fire to the house, and denies throwing either of the two petrol bombs.

Jurors are told of the legal issues in the case.

Mr Reid says:

"The law provides that in this trial they (the defendants) shall be taken to have committed the offences of which they were convicted, unless the defendant whose case you are considering proves to you that he did not commit the offence.

"He does not have to make you sure that he is not guilty.

"He has to prove that it is more likely than not that he is not guilty."

Concluding his speech, Mr Reid says:

"The prosecution invite you to come to the same conclusion as the jury in 2018, namely that Bolland and Worrall threw petrol bombs into the house, knowing that it was occupied intending to cause death or really serious harm.

"For doing that, Bolland and Worrall are guilty of the murder of Michelle Pearson just as they were found guilty of the murders of her four children."

She said she would have been willing to attend court to support a prosecution, but due to a 'misunderstanding' she believed she did not have to attend court.

In the final statement from Ms Pearson, she spoke of an incident in the early hours of December 11, 2017, at about 12.30am, hours before the fatal fire.

She said she was woken up and saw four men in her garden, one she recognised as Bolland.

Ms Pearson said Bolland said 'get your son out here', and claimed he also said 'I'm going to do your house'.

Jurors have heard that Kyle Pearson was using his mother's phone at the time as he didn't have a phone of his own.

Bolland is accused of sending threatening messages to the phone, one allegedly to 'petrol bomb' the house.

Mr Pearson said he deleted the images because he regarded them as 'empty threats'.

"But obviously it weren't empty threats was it," he said.

He said he deleted the messages and didn't tell his mother about them.

Mr Ford asked him: "Have you made up a message about fire after what had happened?"

"No," he replies.

"Did you think the messages were childish?," asks Mr Ford.

"Yeah, course," says Mr Pearson.

"Did you take them seriously?" the barrister continues.

"No," Mr Pearson replies.

"Is that because you thought they were childish?," the QC continued.

"Yeah, empty threats," Mr Pearson said.

The jury has now left court for a break after Mr Pearson completed his evidence.

He agrees he couldn't get back into the house because it had been blocked from the inside.

"Yeah," Mr Harris said.

Ms Toone said Zak Bolland asked her to 'take these two home' and offered her £10.

In the car was Bolland and Brierley, two other men and 'Dave', David Worrall who got in the boot, she says.

Later she was asked to go to a petrol station.

She said they bought a bottle of white wine and a crate of beer, and they asked her to go back to Bolland's house.

Worrall picked up a 'really big axe' and Bolland a 'really big machete', she says.

"They were really pumped up and I think they had all been on drugs as well," she said.

She said she was asked to stop her car near a petrol station in Farnworth.

Ms Toone said: "When he got in my car I could really smell, I think it was oil or petrol.

"That's when I knew they were going to do something bad."

She added: "I knew something bad was going to happen."

She said she was asked to drive to another street, and when they got back in the car she was told 'go go go' and was asked to 'drive to Zaks'.

This follows an inconclusive first post mortem which was commissioned by the Home Office.

Prosecutor Paul Reid QC is going through statements Ms Toone previously made in relation to the incident.

Ms Toone appears visibly emotional on the video screen.

The court has heard she was 'pressurised' into taking Bolland and Worrall to Jackson Street.

Mr Reid says Ms Toone made a statement saying she had later seen the house 'in flames'.

"I thought Jesus what have they done," she said in the statement being read by prosecutors.

Ms Toone says she found out about deaths the following day on social media
Under cross examination from Mark Ford QC, Ms Toone says she found out that people had died the following day on social media.

She agreed she was 'worried' she might be considered a 'suspect' because she had driven the defendants to the scene.

She also agreed she would 'never' have driven them to the area if she knew it would 'put the lives of other people in danger'.

"Zak said he would try and find out where he was, so that's why I stayed for a bit"
Ms Toone says she went to Zak Bolland's house that night to try and find her boyfriend, after she had been to a work Christmas party.

Asked why she didn't leave after finding her boyfriend wasn't there, she said: "Zak said he would try and find out where he was, so that's why I stayed for a bit."

Then Bolland and Courtney Brierley offered to go with her to try and find her boyfriend. The trio left and Worrall remained at Bolland's house, jurors hear.

They didn't find her boyfriend and Ms Toone agreed to go back to Bolland's house, jurors hear.

Ms Toone, Bolland, Worrall, Brierley and two other men got in the car, and Worrall got in the boot.

She dropped two men off and she was asked to go to a petrol station where alcohol was purchased.

After they went back to Bolland's house.

Ms Toone said she stayed because she was still trying to find her boyfriend.

Ms Toone claimed she 'knew they were up to something'
Ms Toone has claimed that back at Bolland's house it seemed like they were 'planning something'.

Under questioning from Mr Ford she agreed there was 'no mention' of 'killing anybody'.

She said she disagreed with Mr Ford who suggested there was no mention of 'harming anybody'.

Ms Toone claimed she 'knew they were up to something'.

"But you didn't know quite what that was?"

"No," replies Ms Toone.

Mr Ford asks: "Did they say that violence would be done to you if you didn't comply with their request?"

"No," she said.

Ms Toone said she was 'scared'.

She said at the petrol station she saw them come back into her car with a jerry can, and she said she could smell petrol.

Ms Toone says she 'couldn't' leave when Bolland and Worrall left the car near Jackson Street, because Courtney Brierley was still in the car.

She dropped them off after and later drove near the area to see if she could see anything.

She saw a fire engine and 'flames'.

Jurors are told that she later went home and went to bed.

Mr Ford says: "I'm suggesting, Ms Toone, that you slept straight away when you got home, because you didn't think at that point that anybody had been killed, and you didn't think that anybody was likely to be hurt because you knew the conversations that you witnessed earlier on, that it was not Zak Bolland's plan to kill anyone?

"Yes," she replied.

Ms Toone is now being cross-examined by Worrall's barrister, Benjamin Myers QC.

She agreed with Mr Myers that she was 'terrified' of 'the trouble that you could have got into because of how it might look', after learning the extent of what happened.

Mr Myers said she was 'concerned' about what might happen to her.

She replied: "I wanted to do the right thing and tell the truth."

Mr Myers put it to Ms Toone that Bolland had two bottles, and that Worrall had no bottles in his hand.

"That's completely not true," she said.

Mr Myers is asking Ms Toone about comments allegedly made by David Worrall after he got back in her car after the incident on Jackson Street.

Worrall allegedly said 'oh God, that was real weren't it' ... 'like he enjoyed it', jurors have heard.

Mr Myers claims these comments were not said, and alleged Ms Toone 'gratuitously added' them at later interviews, which she denied.

Ms Toone has now completed her evidence.

Next witness is James Walker
The next witness is a man called James Walker, who had been staying at Abigail Toone's boyfriend's flat on the night of December 10.

He said the next morning, at about 6am, they were both woken up by loud banging, and he saw David Worrall.

Mr Walker said he exchanged a few words with Worrall before going back to bed.

Later that day, at about 1pm, Mr Walker said he saw David Worrall, Courtney Brierley and Zak Bolland at the flat.

He said they 'looked pale'.

"Looking back I know why," he said.
