Lawsuit: Atlanta officer broke man’s collarbone weeks before shooting Rayshard Brooks

Three weeks before shooting and killing Rayshard Brooks during a scuffle in a Wendy’s parking lot, embattled Atlanta police Officer Garrett Rolfe broke a man’s collarbone during a DUI stop, according to a federal complaint filed Monday.

The lawsuit accuses Rolfe of using excessive force when he allegedly grabbed Charles Johnson Jr. and threw him to the ground during a May 22, 2020, arrest, “thoroughly breaking his collarbone among other minor injuries.

It wasn’t the first time Rolfe was accused of using excessive force on the job. And Johnson’s attorney, Keith Foster, said if the Atlanta Police Department had handled a previous complaint appropriately, Brooks might still be alive.

The federal complaint also accuses the city of encouraging, tolerating and being “deliberately indifferent” to previous use-of-force cases involving Atlanta’s officers.

For me this has no bearing here. Nothing on the video from this incident points to excessive force. Just as George Floyd’s past had no bearing on that case, Garret Rolfe’s past has no bearing here.

I'd really like to see the footage as well because this just seems like a money grab in all honesty. If the guy resisted and got taken down, that's the consequences of his own actions.

Prosecutor appointed in Rayshard Brooks shooting death case

"More than a year after Rayshard Brooks was shot to death by an Atlanta police officer in a Wendy’s parking lot, the case finally has a prosecutor.

It took a judge’s order last month to compel State Attorney General Chris Carr to disqualify Fulton District Attorney Fani Willis’ office. On Wednesday, Carr’s office announced the appointment of Pete Skandalakis.

For more than 25 years, Skandalakis served as the district attorney for the Coweta Judicial Circuit, which encompasses Carroll, Coweta, Heard, Meriwether and Troup counties. In 2007, he was named Georgia’s District Attorney of the Year."

"Rolfe’s defenders say he was merely following his training. The 28-year-old officer, fired the day after the shooting by Mayor Keisha Lance Bottoms, was recently reinstated to the force by the Atlanta Civil Service Board. The order did not return him to active duty.

Noah Pines is one of Rolfe’s attorneys.

“Now that the State is represented we are looking forward to getting a hearing scheduled on our motion to modify Officer Rolfe’s bond so he can go back to work,” he said."

Rayshard Brooks’ family ‘unaware’ of any gang affiliation, lawyers say

"The GBI said in the warrant, “Prior investigation determined that Brooks was a member/associate of the Bloods criminal street gang.”

Willis said she invited the GBI to join the investigation, led by Atlanta police, about two months ago.

“They took the time and did the work,” she said. “Sometimes you know you need expertise. We were seeing things in the files that indicated to us that there was probably gang elements here and we thought it needed a deeper dive. (The GBI) has the gang task force and it just made sense to ask.”

2 years later, what will happen to Atlanta police officers who killed Rayshard Brooks?​

ATLANTA — Nearly two years after Rayshard Brooks was killed in an encounter with police outside an Atlanta Wendy’s, prosecuting attorneys are faced with the decision about whether or not they will move forward with the prosecution of two officers involved in Brooks’ death.

A special prosecutor confirmed to Channel 2′s Mark Winne that in a matter of days, he expects a breakdown of the evidence by experts that should provide the deciding factor in whether charges against the officers will move forward or if one or both cases are dismissed.

2 years later, what will happen to Atlanta police officers who killed Rayshard Brooks?

One option is for prosecutors to not move forward with prosecuting the officers at all.

The Atlanta Police Department first fired Garrett Rolfe, then later reinstated him with back pay. He's charged with murder and is currently on administrative leave pending the outcome of his trial.


Authorities charged Officer Devin Brosnan with aggravated assault and violation of oath of office.


On Friday, the officers announced lawsuits, seeking monetary damages from the city, the former mayor and police chief. The suit claims the city violated officers’ constitutional rights. "
