#RobertDurst - This morning the defense argued for a mistrial stating Durst's health will not allow him to testify and he has the right to testify. They had a doctor testify. Judge Windham is taking it under advisement.

#RobertDurst stood up and waved to someone in the gallery while there are arguments without the jury present.

*Trial continues (Day 37) (@ 10am PT) – CA – Susan Berman (55) (Dec. 24, 2000, Beverly Hills) – *Robert Alan Durst (57 @ time of crime/72/now 78) arrested (3/14/15) extradited (11/1/16 from Indiana prison to Calif.) & charged with 1st degree murder. Plead not guilty. $4M Bond.
Was serving a 7 year federal prison term for illegal possession of a revolver at the time of his New Orleans’ arrest.
Trial began on 2/11/20 with pretrial motions & jury selection started on 2/19/20. Trial started on 3/4/20. Jury: 8 women & 4 men. 11 alternates. (1 alternate excused on 5/18/21) Now 10 alternates. (1 juror (#3) excused for medical reasons on 7/8/21). Now 9 alternates. (Trial expected to last 5 months). Trial stopped 3/16/20 due COVID-19 & will restart on 7/27/20 & retrial was to restart on 4/12/21 continued to 5/17/21 continued to 5/18/21. No court on Fridays.
State will wrap up their case on Thursday (7/29/21). Defense has 2, possibly 3 witnesses (one is the defendant) & thinks 2 weeks for their case & will begin their case on 8/3/21.

I bet Gilberte was scared after they found her address and phone number in Durst's car in 2003! I would be and would demand to either move or buy a gun to defend myself. I think he had a rather long list of enemies. Was really sad to hear she is no longer with us, I know she would be happy someone is finally holding his feet to the fire over his crimes.

Also, did I hear correctly from Kathie's brother that as it turns out Durst never got a degree as he claimed?

#RobertDurst - No jury or testimony today. Attorneys/judge will be in at 9am PT/12pm ET to discuss jury instructions. We will have our camera there. The defense is expected to begin tomorrow afternoon. State expected to rest by lunch tomorrow. @LawCrimeNetwork

Defense attorney Dick DeGuerin: On Friday Durst was taken to a clinic and had to have a catheter placed again. He currently has a catheter.



Arguments happened this morning over the continuing back and forth of Durst's health regarding him testifying. Judge Windham slams Dr. Klein that testified: "The witness is not a psychiatrist or psychologist. He is a kidney specialist and disproportionately paid"

BREAKING: Judge Windham denies the defense motion for mistrial based on their client's health and inability to testify. He cited case law and also found Dr. Klein's testimony beyond the scope of his expertise. "It is a product of bias and I REJECT IT."

Now the question is...WILL DURST TESTIFY? We know his attorneys have said all along her will. We know he wants to. But, strategy may be to not put him on the stand since they keep saying he's too ill to testify (for appeals purposes).

WATCH LIVE: #RobertDurst trial. We expect the state to play the 2015 New Orleans jail interview between Lewin & Durst, then rest their case. The defense plans to call Dr. Elizabeth Loftus - memory expert as their first witness.

NOW: Reading the "BD Story" in Durst. This is a document Durst wrote that covers 12 yrs of his life. He wrote this for his attorneys in preparing for the Galveston trial.



Yes, Durst stood up in court and said, "I did not write this". It's described as a compilation of his handwritten notes, attorney notes from interviewing him, police reports, etc..

Durst is turning around to see everyone. Chesnoff does not want him doing that. The deputy also watches him closely

Earlier, Durst stood up, interrupted proceedings and said, "I did not write this. This was written by somebody else. I never wrote this document", referring to the so-called "BD Story" that's being read now.

#RobertDurst has turned himself around several times today (and throughout the trial) to look at the gallery.
? for my attorney friends: Would a defendant not in a wheelchair be allowed to stand up, pick his chair up, turn it around and stare at the gallery during testimony???

During the proceedings, or when the judge is present, all are supposed to face forward unless given permission. They can turn to see family, turn to introduce themselves to potential jurors etc. But all are limited and usually with permission

#RobertDurst - Cross-exam by Lewin of defense witness Dr. Loftus, Lewin asks why she wouldn’t agree to an interview with him before testifying, after going around and around she says, “You’re a bully and I didn’t want to subject myself to that unpleasant experience.”



Lunch break until 1:30pm PT/4:30pm ET. Dr. Loftus will still be under cross. Will the defendant take the stand when she’s done? I think the chances are good.
