Tuesday, Sept. 14th:
*Motions Hearing (@ am ET) – TN – Joseph “Joe Clyde” Daniels III (5) (April 3, 2018, Dickson) – *Krystal Nicole Daniels (27/now 30) “mom” arrested & charged (4/9/18) & indicted (6/8/18) with criminal responsibility aggravated child neglect & filing a false report. Charged (5/26/20) with criminal responsibility aggravated child neglect, accessory after the fact & making false reports to officers. $1M bond.
Trial set to begin on 2/1/22 with jury selection. Jury will be chosen from Stewart County but the trial will be in Dickson County.

7/18/21 Update: A hearing to set trial is scheduled on 7/19/21. 7/19/21 Update: Judge David Wolfe said jury selection will begin on February 1, and the trial will follow after that. The jury will be chosen from Stewart County. Additional motions hearings in the case were scheduled for September. A gag order remains in place for Krystal's case. Judge Wolfe set 9/3/21 as deadline for any pending motions to be filed by defense. Hearing moved to 9/14/21. 4 new charges will be introduced.
*Joseph Ray Daniels (28/now 31) “father” - Trial began on 6/1/21 to 6/11/21: Verdict: Guilty on 2nd degree murder (lesser offense), 1st degree murder in perpetration of a felony, aggravated child abuse, initiating a false report & tampering with evidence. Sentencing on 9/14/21.
 
sentencing hearing has started, court was hearing arguments from the defence that his son should be called to testify and state does not want him too, I think he should only testify if he wants to (did not catch whether he would be appearing voluntarily or if under subpoena)
 
defence arguing for child to be subpoena and brought to court, Judge recessed court whilst he takes a break to look at case law and then will reurn with his decision,

I think it will be very tough on this child being forced to come to court to tesify about this crime he is still only 11

Judge said questions they want to ask child should have been asked when he testifed at trial and it was defence strategy not to ask certain questions, I agree with judge that he should not be called to have to testify about his brothers murder again, Judge denies the defence subpoena

this witness is the aunt that didn't testify at trial but who lived in the home with Joseph Daniel and his family, she has hearing problems and defence atty is speaking very loud

we are revisiting the lock issue from the trial and she says the lock was off that night,
 
but she testfied to hearing an argument between Baby Joes parents about who was the father of Baby Joe which at trial was a possible issue between his parents even though at trial it was shown via proof that Joseph Daniels is baby Joes father
 
Joe Daniels is looking much better today than at trial, he has had a haircut which is much better than at trial, and to me he just seems to be looking healthier and more together, he knows he is probably never detting out of jail so maybe resigned to his fate,

Mr Daniels pants falling down, having to get them pulled up as he is cuffed, as he goes to be sworn in to testify, he is choosing to not testfy, Judge concerned about pants falling down as he goes back to defence table,

40/35 rule client lacks clear mental judgement, arguing not pre meditated, defence arguing no criminal convictions pre these crimes, and is a low risk according to pre sentence, again gotta love a trier saying probation would be suitable except for the felony murder charge,
 
state says defendant is a dangerous offender wants judge to enhance his years to be served, as his biological father he gets an enhanced sentence for killing his own child, state wants consecutive sentencing, for 12 years he was dangerous has homicidal ideations, and even scares himself according to what he told others.
 
Judge 3 counts merge, life, this is mandatory for Felony murder no parole for 51 years, then further years for the other charges, basically a whole life sentence,

to try to make it less of an appellate issue the judge runs the sentences consecutively not concurrently, he mentioned that it would be dreadful if the trial has to be re run for any issue and the juvenile witness has to come back to testify again for any reason,

maybe with the new charges Krystal may give up the location of his body in a plea agreement for less time, that is if she knows where it is,
