Holmes' counsel points to an Oct 2014 email that Peterson wrote stating her boss Jerry "committed on the spot $100M with Doug and Cheri in complete agreement." (This is to counter her testimony on direct that the DeVos firm doubled their investment to $100M after due diligence.)

*Trial continues (Day 21) (@ 9am PT) - CA – for *Elizabeth A. Holmes (34/now 37) (CEO of Theranos) charged (March, 2018) & indicted (6/14/18) & arraigned (6/15/18) with 9 counts of wire fraud & 2 counts of conspiracy to commit wire fraud and charged & indicted (4/11/20) with fraud relating to a patient's blood test. Another count of wire fraud was added in 2020, bringing the total number of felony charges to 12. Plead not guilty. No bond. Faces a maximum sentence of 20 years in prison & up to $2.75 million in fines, plus restitution, & $250K for each individual count of wire fraud & conspiracy.
Defrauding investors out of $700 million in funding for their blood-testing startup Theranos.
Trial began on 8/31/21 with jury selection. 12 jurors of 7 men & 5 women (6 Caucasians, 4 Hispanics & 2 Asians) with five alternates (3 men & 2 women). Juror #7 excused & replaced with alternate #1. Now jurors are 8 men & 4 women. Alternates 2 men & 2 women. 10/6/21: Juror #4 excused & replace with alternate #2. Now jurors are 8 men & 4 women. Judge Davila said the juror whose mother-in-law died suddenly last week wants to travel for a few days next week for the memorial service, so trial won't be in session next Friday, Oct. 29. 10/20/21: Judge Davila notes that a juror can't be in court Friday, 11/12 & 12/3 & the judge has a conflict in November at some point due to a meeting in the Ninth Circuit committee. Trial dates: 10/27, 10/29, 11/2, 11/3, 11/4, 11/5, 11/9, 11/10, 11/12, 11/16, 11/17, 11/18 (?), 11/19, 11/23, 11/24 maybe, 11/30, 12/3 so far.

10/26/21 Tuesday, Trial Day 20: Judge Ed Davila is on the bench. The parties are arguing over letting the jury see Holmes' Today Show & Mad Money clips.
Judge Davila says he received an email from a juror complaining about the noise from keyboard typing. The judge again says he'll bring in a Marshall to kick out folks who don't use silent keyboards. He adds that if they continue to complain, he'll ban keyboards from the courtroom.
Judge says he wants trial to go until 4pm today & he wants to add Mondays in Nov. A juror says it's getting "very tough" for him to manage his workload with added trial days. The judge says maybe they'll drop some days.
Government witness: RVD Corp private equity group manager Lisa Peterson, who helps manage the DeVos family's estate. Prosecutor Robert Leach on direct.

So Holmes falsely claimed that she was endorsed by Phizer when representing her fake blood test to investors? Financial fraud.

I hope she is not released. She is dangerous in terms of convincing others to do her criminal bidding.

I feel like every reporter covering Elizabeth Holmes’ trial closely has had or will have a total breakdown/freak out moment over public access issues or just the unpredictability of this trial. I think today may have be my turn.
 
I can't shake the feeling that half of the jury isn't able to follow the jargon, and the other half have mentally checked out!

I can't feel bad that the DeVos family didn't do their homework. They made the decision to invest in a conwoman, not their advisor, they could have chosen to reject her suggestion.

Thanks so much to everyone who keeps us up-to-date on this trial, I can't always stay up on it but I come back and reread everything in one big fell swoop. It's fascinating really.

The Pfizer thing was very damning evidence against her. And while the defense did score some points against the DeVos investor, I'm not sure how much of a defense "they didn't do their due diligence" is because it doesn't take away Holmes' intent.

Same here. It's a "You didn't do your homework, it's your fault- you should have known" type defense. Not Elizabeth's fault that you couldn't see through her con.

The parties are discussing limiting various buckets of testimony, including emails about Theranos' financial projections from ex-Cravath partner Dan Mosley and Fortune writer @rparloff's testimony. The judge is (big surprise here) holding off on ruling on the evidentiary issues.

Holmes' counsel pulls up a Sept 2014 letter from Theranos to investors that states "all current resources are focused on commercial lab business, and future growth in pharmaceutical, military, and other business will follow."

Peterson points out the letter also says Theranos "historically" had pharma and military business, but the judge strikes her comment as non-responsive. Holmes' counsel again notes that the letter went on to say pharma and military deals were on hold. She concedes the point.

Holmes' counsel Lance Wade pulls up the Theranos study that had a Pfizer logo at the top (which an ex-Pfizer exec testified wasn't authroized). Wade points out the footer of each page of the report has a Theranos address and Theranos' website. Peterson says she didn't notice it.

Wade points to an "RDV approval" doc on a new equity investment into Theranos that was signed by RDV CEO Jerry Tubergen. The doc says "Closed Oct 31, 2014," but there's no date under Tubergen's signature. (The DeVos fam didn't get Peterson's due diligence memo until Nov/Dec 2014)
