6/30/21 Update: Day 1 of sentencing: A three-judge panel began hearing evidence here Wednesday to determine if Bailey Boswell, his co-conspirator, should get the same punishment. Boswell would be the first woman in Nebraska to get the ultimate sentence. Assistant Attorney General Doug Warner & defense attorney Todd Lancaster presented their cases. Wednesday, which was the first day of a three-day hearing, was a graphic day. Photos of Sydney's dismembered body were shown to the three-judge panel. It included several photos of her arms, head, torso & thighs. State prosecutors did this because they argue that the “Crime was particularly cruel or manifested in exceptional depravity by ordinary standards of morality or intelligence.” Doug Warner, the assistant attorney general, said Loofe was singled out as a victim. “That the murder, where there was apparent relishment of the murder by the defendant, needless mutilation of the victim, senselessness of the crime & helplessness of the victim,” said Warner. Boswell's defense attorney, Todd Lancaster said the state’s case relies on body mutilation, which took place after her death. He says Loofe’s murder doesn’t fit into the specific criteria that warrant the death penalty. “Mutilation cases be limited to cases where the mutilation is not simply an effort to hide the crime. The evidence you’re going to see today is basically an effort to hide the crime,” said Lancaster. Boswell had some family members present. Two left when the photos of Loofe got especially graphic. Boswell kept her head down while many of the photos were shown. The hearing continues Thursday, 7/1/21 @ 9am.
*Aubrey C. Trail (51/now 53) – Found guilty of all charges 7/8/19. A 3-judge panel will hear penalty phase. 11/15/19: Judge denies Trail’s death penalty challenge. Judge denies motion for new trial. Sentenced on 6/9/21 to death.

It's day two of the sentencing hearing for Bailey Boswell. The state is seeking the death penalty for the murder of Sydney Loofe.

Right now the defense is going through mitigating circumstances....Specifically, how Bailey's life took such a whirlwind turn.

Her defense attorney Todd Lancaster is going through Bailey's life.

Star HS athlete, went to small Iowa college, met a guy that was bad for her.

She was sexually assaulted, forced to give "massages" for money, used alcohol & pot.

Eventually they split, but then she met Trail.

Boswell's attorney says she was pressured into the murder, her brain wasn't developed and was merely an accomplice....among other mitigating factors.

Lancaster goes on - says Boswell qualifies for a family sympathy mitigator. Saying a death sentence would have a huge effect on her family, specifically her five year old daughter.

Her attorney says Boswell has been in the Saline County jail for four years.

Says she has changed since she left Trail. She's become a caretaker in the jail, and they have letters from other inmates speaking to her character.

Now the state is up. Assistant AG Doug Warner says Boswell met Trail while she was seeking a 'sugar daddy' and that Trail fit the bill for her.

That's all he really said in his opening statement.

Now we hear from Corrections Director Scott Frakes. Defense called him.

The defense is saying the death penalty would be unconstitutional b/c she'd be the only woman on death row. And stuck in solitude.

Male death row inmates can interact w/ each other.

Frakes asked how Boswell would be housed if she gets a death sentence.

Says he'd draft policy language to her needs. Says she'd be housed in York. Would be same screening tools that every other inmates in the system.

Frakes says death row inmates are isolated and have "very, very minimal contact" w/ the general population.

Peripheral contact, no day-to-day socialization.

Asking procedural housing questions currently. Frakes is outlining policies for different levels of inmates (maximum, minimum, etc).

Boswell is very engaged, looking right at Frakes throughout. Yesterday she looked down a lot when graphic pictures were shown.

Frakes asked about solitary confinement. Says it's not used in Nebraska prison systems b/c it's not healthy or beneficial to inmates.

It is defined in Corrections policy still.

Frakes asked about death row inmates.

Says they usually come out in two groups - the dozen or so inmates are a tight knit group and actually have more freedoms than inmates that placed in restrictive housing (used for disciplinary reasons).

They have their own outdoor space.

Their individual cell is around over 80 sq. ft. Designed for one person in each cell.

Frakes confirmed that death row inmates are their own community, informally celebrating birthdays, holidays.

Defense clearly trying to show their treatment would/could be different than if Boswell was on death row in York's women-only prison.

Frakes says he doesn't know if Boswell would be housed/allowed to interact with other inmates.

Says no discussions have even taken place, yet.

Frakes says the women's prison is unlike the male prisons b/c needs are different and women are only 9% of the state's prison population.

He again says he doesn't know how Boswell would be housed in that prison.

Frakes, who previously worked in the Washington Corrections system, says no female inmates were housed in that system and that he's never worked in one that a woman on death row.

Defense has no other questions.

Now the state is asking questions, many of them repetitive of what the defense asked.

Frakes is now off the stand.

Now up to the stand, an expert witness, Susan Michalski, a nurse who specializes in domestic violence.

It appears she'll be speaking on the effects domestic violence (which the defense says Boswell endured) has on people.

Michalski says she has not spoken with Boswell directly, but has read records on the case.

She says one misconception on domestic violence is 'why somebody would stay?'

Says there is often barriers - including an escalation in violence, as well as traumatic bonding that occurs in these incidents.

Also mentions women could stay b/c of fears to family, friends, etc.

Boswell did have a child with the man the defense says abused her.

She expands on 'traumatic bonding.' Says perpetuating partner will determine early what makes victim tick....and then uses it against the victim.

These could be personal past experiences, good and bad.

She talked for a while on abusive relationships.

Now the state is questioning her - asking her about masochistic relationships, or a 'sugar daddy' relationship.'

She says she does not consider herself an expert in these type of relationships.

We're now going to a videotaped interview w/ Boswell's mom Priscilia.

It was recorded about four weeks ago.

She's giving background about family.

Speaking on Bailey's father (name: Pennigar?)

Says he left after Bailey was born, got involved in drugs, eventually got back together w/ him. Lived in David City w/ him, then he was later murdered.

Bailey was one y/o when he died.

The man that murdered Boswell's dad, Alfred Pinegar, was eventually executed in Missouri.

The murderer was John Middleton.

Boswell's mom was said Bailey did great in school, very outgoing, played sports.

Doesn't recall mental health issues, but was always looking for signs of it due to Bailey's father being murdered.

Eventually Boswell went to counseling proactively.

Says in high school Boswell was a dedicated basketball player, and was quite good.

Says she didn't get into trouble in high school.

Bailey eventually got a basketball scholarship at AIB School of Business.

One major selling points was a kind older coach. He left before she came, and was replaced by a colder, rigid coach.

Boswell had various conflicts w/ the coach. He made her cry, overall didn't get along well.

Bailey became to get distressed.

We're back underway.
Boswell's mom talks about Bailey's tough college experience.
Says she went to the hospital for alcohol poisoning. Also says she was raped at one point.

Boswell's mom now talking about Bailey's ex-BF and father of her child, Freddy.
Says he acted normal but there was another side. Convinced her to drop out of AIB, took her money and overall abused her.

Says Freddy physically abused her, gave her bruises, shoved her down the stairs, kicked her.
Also, emotionally abusive.
She says the BF would pimp her out. Having Bailey give massages/happy ending for money.
He then took any money she made.
They also sometimes robbed these people while doing this.
She says he forced/urged her to do this.

Eventually they had a daughter, who was later removed the home.
Says it was due to Freddy smoking marijuana.
Eventually Bailey's mom got permanent guardianship for the daughter.
Freddy has lost his parental rights completely.

Eventually, Boswell got away from Freddy, stayed w/ her mom & step-dad.
She at some point got aquainted with Aubrey Trail. Started selling antiques w/ him.
Then got an apartment, car that Trail bought for her in eastern Iowa.

Boswell's mom says Bailey wasn't the same girl that she was when she went to college.
No self-esteem, not happy self, "just different, I don't know how to explain it."

Boswell's mom says she met Aubrey Trail in Leon, Iowa.
He was using a different name,Alan Gambino. Says she didn't have anything nice to say about him.

Boswell's mom says they now talk daily, and almost always speaks to her daughter Nola.

Bailey's mom closes by pleading with the panel - "please don't put her to death."
Boswell now clearly emotional for the first time in this hearing. Wiping away tears.

Jeff Boswell, now up to the stand, while technically her step-dad, she is her adoptive father and she refers to him as dad.
He describes very similar stories about Bailey's childhood.

You could audibly hear Boswell crying after her family's testimony, here's the video camera shot after her mom's recorded testimony.

Been busy working on the 6pm story, but the defense is now using Aubrey Trail’s statement at his sentencing hearing in June.
Trail said he had no reason now to lie, admitted to lying in court and then said he alone killed Loofe and Boswell wasn’t apart of the dismemberment.

“Nineteen years seems like a long time to wait for justice,” said Michael Black, an uncle of Alfred Pinegar, after the execution, “It’s a lifetime for a little girl who had to grow up without her father…Our family has waited all this time, never forgetting that our son, grandson, uncle, nephew, father and best friend is not with us.”

Try as I might, I can't feel any sympathy for Boswell. Many people have awful things happen to them but don't end up trolling people on dating apps and killing them for sport. IMO, she knew exactly what was going to happen to Sydney. Further, I think she was more active in this murder than she or the other murderer assert. When she lured Sydney to a meeting, she had ample opportunity to get her out of this mess but did not.

Yeah I kind if felt the same (but I am not in favor of the State executing people. )

The whole sugar daddy part was new to me. Says she put an ad in Back Page and that's how she met Trail.

WILBER, Neb. (KMTV) — Over the last two days, Bailey Boswell’s defense team made their case that she does not deserve the death penalty for the murder of Sydney Loofe in 2017.

Friday, for the first time, we heard from Boswell herself.

“I’m so sorry for everything that happened to Sydney Loofe and for my role to what happened to her,” said Boswell.

Boswell was apologetic and emotional as she pleaded with the three-judge panel to not give her a death sentence.

We’re on the third and final day of the sentencing hearing of Bailey Boswell.
She’s convicted of murdering Sydney Loofe.
The state seeks the death penalty, Boswell is hoping for life in prison.
Follow this thread for what’s going on in the Wilber courtroom.

Day one the state laid out there case that it was a depraved crime. In day two, Boswell’s team added mitigating factors and stressed her bad relationships and that she had a young daughter.
Today, we start with more witnesses for the defense.

We again will hear from Eli McBride, an FBI special agent who worked on the case.
This is the second time hearing from him, as the state called him as their own witness on Wednesday.
He described what he saw at the scene where authorities found Loofe’s body.

McBride describing an interview with Aubrey Trail’s ex-wife.
She’s not a fan, says he’s a liar, thief and con-man.
McBride says she told him she was scared of him and being used by Aubrey Trail the entire time.

McBride describing an interview with Boswell’s father.
Says Boswell at a younger age, shadowed a doctor, saw blood during a surgery and passed out.
McBride says the office made a policy not to allow children to witness surgeries.

Defense clearly trying to display that it would be difficult for Boswell to aid in the dismemberment if she is squeamish towards blood.
Trail mentioned in his hearing, she dry-heaved after Loofe was dead.
Boswell also looked down during most of the graphic images.

McBride describes an interview with Boswell’s friend, who was an “emotional wreck” during the interview and believed it was completely out of character for Boswell to do something like this.
She also knew Trail and was less surprised about his involvement.

Defense asking questions and trying to paint a picture that Trail was a controlling person, and that control was also directed at Boswell.

McBride is done, no more witnesses but the defense is submitting documents.
This includes character letters of inmates of the Saline County jail, who are speaking on how Boswell was a model inmate, compassionate, strong and a “blessing” inside the jail.

Another inmate says she initially had bad feelings about Boswell but got to know her and found her to be a caring person and good mother.

Now up is a Papillion psychologist (didn’t catch the name).
He did an psychological evaluation on Boswell.
She’s called to identify mitigating circumstances.

Dr. Kirk Newring, meticulously went over his accreditation and resume.
Spoke about erotic sexual practices and is now speaking, generally about sex trafficking- who has the control, reasons women get involved in it, etc...
Eventually, she'll speak on his meeting w/ Boswell.

Newring, asked about 'sugar daddies.' Defines it as typically an older man gives a younger woman gifts, money, etc..In exchange for sexual favors, companionship.
Now speaking about Boswell's meeting - specifically IQ tests.
Says Boswell is overall pretty smart, scoring a 108 in an IQ test, the 70th percentile.
Did have trouble when getting explained things in detail, but very adaptable learner.

Back after the break, Dr. Newring saying how Boswell developed trauma with Trail.
Saying he’d control her whole life, mentions driving, leaving the house, etc….

He says while meeting in the jail, that Boswell wouldn’t believe that Trail isn’t monitoring her somehow.
Says she knew logically it made no sense, but she couldn’t disprove it so it was still in her head.

Newring says Boswell rates high on the trauma scale and that her test results he did, lines up with what she has told him.

He says he’s highly confident she qualifies for PTSD from her past traumas.

Along with PTSD, he says Boswell qualifies for Alcohol, Cannabis and Stimulant abuse disorder.

Newring says the PTSD set her up for Trail’s manipulation for her.
Meanwhile, Boswell’s mother can barely watch, put her head into her lap while her husband comforts her.

Says Boswell is not a major risk for crimes of violence…saying they only happened with Trail.
Limited criminal history before the murder, just drug related and shoplifting.

He says he’s concerned what will happen if Boswell is in solitary confinement.
Corrections doesn’t use it, but if policies for men go on to her, he says she’d be effectively in solitary confinement.
Corrections hasn’t said how they’ll handle Boswell, if sentenced to death.

Newring mentions that the brain isn’t fully developed until the age 25 and those under that age may be subject to more undue influence than when it’s fully developed.
Boswell was 23 at the time of the murder.

He says Trail enticed her with money, experiences and promises. Gives her drugs and sex, and leads her down an ugly path.
He doesn’t believe she’s ireplically broken.
Now the state will cross examine him.

The state questioning Newring about what he asked her.
Asking what he asked her about the murder and the details. Newring said he didn't ask about that.
Said he wanted to find her path leading up to the murder, not get details of the murder herself.

He says he didn't check her story with other sources, says yesterday's testimony corroborated what Boswell and her mom told him.

The state aiming to paint Boswell as someone who sought out a 'sugar daddy' relationship with Aubrey Trail.

Newring says Boswell believed she couldn't get out of the relationship. Said she believed that "this was her life now."

Boswell now giving a statement now.
Says she's sorry to what happened to Loofe, and for role what happened to her.
Says she was in a bad place when she met Trail.

Says she felt trapped when she met Trail, and that she felt she loved her.
She later feared him, and what he would do to his family, and he said he'd kill them.
Says she believed he had special powers over him.

Says she knows many in her situation find God...but says she really has because she didn't know what else to do.
She emotionally says her and her daughter will never spend time outside of a prison, and will later learn what she did.

"For my sake please don't, for my daughter's sake, please don't take my life."
The defense rests.

For the record, this is really the first time we've heard from Boswell. She didn't speak at her trial. No recorded videos of her we're played either.

The state now responding to the mitigating factors.
Says Boswell's mom found out that Bailey was setting up meetings for possible sugar daddies.
They've alluded to this multiple times.

The state is showing letters from the Saline County Jail, some of which were introduced in Trail's trial.
A few of them coded, one of them found in Bailey's cell. The idea is to create a plan to co-coincide w/ testimony.
Judge allows the letters, despite objections.

The state says the coded notes were deciphered by jail staff.
They say the letters indicate a plan that Boswell should proceed with. Judge doesn't allow it to be read.

Hearing is done.
Both teams will submit written briefs due in August 6th and rebuttals on the 13th.

A Nebraska man who was convicted of killing and dismembering a woman is seeking to represent himself during the appeal of his death sentence.

Trail filed a request last week with the Nebraska Supreme Court to fire his court-appointed attorneys and represent himself during the appeals process, the Omaha World-Herald reported. The appeal is automatic.

The convicted murderer complains in his paperwork that his lawyers are not supporting his request to sell about $25,000 in antiques and rare coins so he can donate to a memorial fund for Loofe. However, both he and Boswell are already under orders by the court to pay $400,000 to a couple from Kansas that they scammed with a fake rare coin in a separate case.

The Nebraska Supreme Court has rejected the request of convicted murderer Aubrey Trail to serve as his own attorney.

Trail, who was found guilty and sentenced to death for the 2017 slaying and dismemberment of Lincoln store clerk Sydney Loofe, had recently asked to dismiss his court-appointed lawyers and instead be appointed to handle his own legal affairs.

He said that he had reached an “impasse” with his attorneys on how to handle the legally required appeal of his death sentence and that he had the “common sense” to serve as his own lawyer.

In an email from prison to The World-Herald, Trail said his attorneys had opposed his desire to waive his automatic appeal and set an execution date within a year.


“I don’t want to appeal, the court sentenced me to death, carry out the sentence,” he wrote.

Boswell was apologetic & emotional as she pleaded with the three-judge panel to not give her a death sentence. Her team pointed to letters from Saline County Jail inmates saying she’s been a blessing. She thinks she can do that in the prison for women in York. The state put documents into the record that included coded jailhouse messages between Trail & Boswell, that they say attempted to align with each other's testimony. They also say Boswell sought a relationship with Trail & has messaged men & women in jail in exchange for money. Boswell focused much of her statement on her young daughter, saying she’ll later learn what she did, and that still, she wants to have a relationship with her. Closing arguments were not made in court, and instead will be written statements that are due in August 6 & rebuttals on 8/13/21. The three-judge panel must later unanimously agree for Boswell to be sentenced to death. Sentencing hearing on 11/8/21 @ 10am.
11/2/21 Update: Judge denies Boswell’s request to wear civilian clothes at her sentencing. noting that no jurors will be present to see her in prison jumpsuit & shackles.
*Aubrey C. Trail (51/now 54) – Found guilty of all charges 7/8/19. A 3-judge panel will hear penalty phase. 11/15/19: Judge denies Trail’s death penalty challenge. Judge denies motion for new trial. Sentenced on 6/9/21 to death. 9/23/21: Filed an appeal. 10/10/21 Update: Trail said his attorneys had opposed his desire to waive his automatic appeal & set an execution date within a year. “I don’t want to appeal, the court sentenced me to death, carry out the sentence,” he wrote.
