Moira O’Neill, the director for the office of the Child Advocate, said Harmony’s disappearance isn’t necessarily a systemic failure.

“A bureaucracy can only do so much in a state government,” she said. “The failure is at the level of community. It’s a societal failure that we don’t pay attention to kids around us.”

“It was only recently that DCYF has been able to get a court order to actually get in and see a child if they’re worried about the child,” she said. “Everyone thinks they can do everything, but they actually have pretty limited authority around going into people’s homes.”

DCYF has had a long, troubled reputation in the public eye.

Most publicly, the agency came under fire after the death of two children, Sadee Willott in 2014 and Brielle Gage in 2015.

Child protection workers were involved in Sadee Willott’s life just days after her birth. Over the first 21 months of her short life, caseworkers met with Sadee’s family 30 times to check whether the toddler was being physically abused and neglected. Every report was dismissed, except for the last – but by then it was far too late. When the ruling was made, Sadee had already been dead for more than a year.

In the year before Brielle Gage died, DCYF received at least five reports of abuse and neglect against the toddler or her four brothers, who ranged in age from nine months to 8 years old.

A 2017 Monitor investigation found that crushing caseloads, high staff turnover and a lack of thorough investigations were to blame for the oversights.

Another Monitor investigation from November found that many of these problems still exist in DCYF offices, especially at the Manchester office which would have responded to reports surrounding Harmony Montgomery.

In a state that employs a total of 283 child protection workers, 196 have quit or transferred out of their positions since 2019, according to data from the N.H. Department of Health and Human Services.

AB, a former Manchester child protection worker, said when she left her position in the spring of 2019 she was working on cases for more than 200 children. She said she worked between 70 and 80 hours a week to keep up with her workload while caring for her own newborn.

The Millers said their family was once at a baseball game and J did not want to leave because he thought he saw Harmony.

"He said, 'I think that's Harmony over there,' and he wanted to go play with that little girl just to make sure it was not his sister," Johnathan said.

J's dads said they are in constant communication with police and frequently send along any tips they receive to detectives.

"She has a little brother that loves and needs her," Johnathan said. "He wants to hug his sister again, and we want to give him that opportunity."

– Harmony’s father, AM, whose criminal history includes burglary, first degree assault, and stalking, and which dates back to 2007, shot RJ, in the face during a heroin deal. A surveillance camera captured audio and video of the shooting, which was alleged to have involved multiple people, including CS and her uncle, JS.

Jan 28, 2014 - U.S. Marshall’s located AM in Manchester, NH and arrested him on an unrelated probation violation warrant out of Middlesex Superior Court. AM had a bullet wound in his right arm.

On or after Jan 28, 2014 - Harmony’s mother was also charged on allegations she helped Adam evade police, although the charges were later dropped. She was four months pregnant at the time.

Mar 2014 - AM was arraigned on charges of armed robbery and assault with intent to murder and held without bail but the charges were later reduced.

Jun 7, 2014 - Harmony was born.

Sep 2014 - AM received a sentence of 18 months behind bars, after pleading guilty to lesser charges of larceny, carrying a firearm without a license and discharging a firearm within 500 feet of a building in an armed robbery during which he allegedly shot a man in the head.

Jul 2018 - Court documents show Harmony’s mother lost custody of Harmony because of substance abuse issues. Harmony began bouncing in and out of foster care.

Dec 2018 - The MA DCF requested that NH DCYF conduct a home study of AM and KM. NH's DCYF Interstate Compact for the Placement of Children unit responded to MA DCF stating that in order to conduct the home study, add'l info was needed regarding AM and his wife's progress and their engagement of services with MA DCF. While NH DCYF was waiting for the information, a court in Lawrence, MA abruptly gave sole custody of Harmony to her father 2/2019.

Sometime in 2019 – Harmony was last enrolled in school in Massachusetts, but (as of 12/31/21) LE did not yet know where.

Feb 22, 2019 – Harmony’s mother no longer had custody. Harmony was returned to her father without an Interstate Compact for the Placement of Children (ICPC) and was no longer in MA foster care system according to juvenile court records from Lawrence, MA.

Feb 25, 2019 - KM filed a change report to add Harmony to her DHHS account and monthly benefits increased $129.

About Apr 21, 2019 - The last time CS spoke with Harmony was over a Facetime video call around Easter 2019. CS later told LE that Harmony "seemed frightened" during the call.

Jun 7, 2019 - BM and JM begin fostering Harmony's younger brother. "From night one, in the bedroom, he asked where Harmony was going to sleep," JM.

Jul 2019– The uncle of Harmony’s father reported an incident to DCYF. After he reported the incident, his nephew stopped speaking to him. Montgomery said he called DCYF in July 2019 after he saw that she had a black eye — but nothing happened. From the affidavit: Due to the above facts and circumstances I believe probable cause exists that AM committed the crime of Second-Degree Assault, RSA 631:2, I(d) on or between 7/1/2019 and 7/22/2019, in that he knowingly caused bodily injury to HM 06/07/2014, a child under the age of 13, by striking her in the face.

Nov 2019 - CS lived at 37 Chapel St #3, Lowell MA with her boyfriend JE who has never met Harmony in person.

Nov 22, 2019 - Boston 25's Blair Miller adopted Harmony's brother on National Adoption Day. Miller inquired with DCF about adopting Harmony as well. A caseworker told him then Harmony had been reunited with her father.

Nov 2019 - The Millers reach out to CS and say they want to send Harmony a Christmas gift from her little brother, but she tells them she’s again unable to reach AM.

Approx Nov 28, 2019 (Thanksgiving Day) - AM told LE he hadn’t seen her since her mother came to pick her up around Thanksgiving of 2019.

The day after Thanksgiving, 2019 - KM told LE that on this date, AM dropped KM off at work and told her that he was taking Harmony to her mother to live.

Around Thanksgiving 2019 - A neighbor, who has lived on Gilford St for decades, said she went away for the Thanksgiving holidays in 2019 and returned to find the family had moved out. She said the house had fallen into foreclosure and AM and KM were refusing to leave and were “basically squatting” at the home with their children before finally being “forced out."

Late 2019 - AM's uncle, KM, said he has not seen Harmony or AM since late 2019.

Dec 2019 - CL (KM's mother) said AM and KM were at her home at the end of December 2019, during the holidays. AM and KM were living on the streets and in a car. CL thinks something happened between the day after Thanksgiving and Dec 6. When the reporter asks her what the significance is of Dec 6, she says KM reminded her of that date because they were homeless, needed a place to stay, and they were there during that timeframe.

Jan 12, 2020 - Police were called for the last time concerning the front door being open; the caller thought it had been kicked in. Police said the door was not kicked in and noted that it looked like someone moved out and left the door open. The report has one or two words blacked out followed by AM’s name. “They were just airing it out,” the report says. “There was a very bad odor.”

Jun 2020 - Around Harmony’s sixth birthday, CS tells the Millers she hasn't been able to reach AM or Harmony.

Jan 7, 2021 - KM indicated to DHHS that her family consisted of 2 adults, married, and 4 children. A DHHS caseworker added a note to the redetermination paperwork that KM seemed confused about whether Harmony lived there "because she goes to her mom's every other weekend."

Mar 7, 2021 - J asks his adoptive parents if they can adopt Harmony. "I want to call her a Miller too," JM quoted his son as saying at the time.

Mar 21, 2021 - KM went to her mother’s house with the children "due to domestic violence on her from her husband, AM," according to the request for a restraining order against AM, filed in July 2021 by KM's mother.

Jun 2, 2021 - Another DHHS account change was initiated and DHHS noted that case management for Harmony was closed; KM said Harmony had moved back with her mother.

Jun 2021 - With Harmony’s seventh birthday approaching, the Millers are still sending pictures of J to CS and asking about Harmony. She tells them she wished her ex would stop avoiding her.

Jul 2, 2021 - AM showed up outside KM's mothers' home, crept around her yard and tapped on her window at around 7:45 p.m.

Jul 5, 2021 - The boyfriend of KM's mother found a steak knife in the yard where AM had been standing.

Jul 6, 2021 - AM’s mother-in-law filed for a restraining order against him; KM was living with her mother at the time.

Jul 2021 - Harmony’s great-grandmother called NH DHHS to check on Harmony's well-being and whereabouts after she heard AM had entered drug rehab. She said officials told her that Harmony wasn’t in their system, wasn’t in their custody, and that they didn’t have a case open.

Jul 29, 2021 - CS tells the Millers that she finally found AM, but he immediately blocked her on social media.

Aug & Sep 2021 - AM's mother-in-law's restraining order was heard in court in Aug 2021 and dismissed by the court in Sept 2021 for lack of service.

Sep 2021 - CS told JM she’d made contact with one of AM’s aunts, who told her she hadn’t seen Harmony since some point in 2019. Shortly afterward, she saw AM posting a lot of his belongings on Facebook Marketplace.

Sep 16, 2021 - The Millers began attempting to contact AM and KM over Facebook but had no luck. BM reached out to NH’s DCYF. CS later tells them she finally heard back from the agency.

Oct 2021 - AM's estranged wife KM told officers she had not seen Adam Montgomery since October 2021 and claimed he was living in a sober house. He later moved to Maine with another woman, according to court documents.

Mid Nov 2021 - KM last spoke to AM.

Nov 18, 2021 - Manchester school officials reveal they have no records that Harmony has ever been enrolled there. Harmony's mother CS called LE to say that Harmony was in the custody of AM, and she had not seen Harmony since around Easter, 2019.

Dec 27, 2021 - DCYF notified the MPD that they were unable to locate HM.

Lauren Smith, Mayor Craig’s Chief of Staff, confirmed they received an email from an individual stating issues with DCYF and concern regarding a child. ... They forwarded the information to the police. … Aldenberg said police opened the investigation after being contacted by DCYF.

Dec 30, 2021 - Adam’s brother spoke with LE. According to the affidavit the brother said, “Adam was physically abusive toward Harmony” The brother recalled that “Adam was ‘super short’ with the child, and he learned through family members that Adam had given Harmony a black eye” in 2019.

Dec 31, 2021 – LE said they received a report this week that Harmony has not been seen since late 2019. Press conference #1 AM was first questioned by police after being found sleeping in a vehicle with his girlfriend KS in the area of Harvell St in Manchester. KS said she and AM have been romantically involved for over a year.

Jan 4, 2022 – The FBI officially joined the investigation, the reward is at $33k, and Harmony's father, Adam Montgomery is arrested on a warrant for one felony charge of second-degree assault arising from 2019 conduct against Harmony Montgomery, as well as one misdemeanor charge of interference with custody, and two misdemeanor charges of endangering the welfare of a child pertaining to Harmony.

Jan 5, 2022 - Adam Montgomery was arraigned around noon in Hillsborough County Superior Court North. AM waived his bail hearing and agreed to be held in preventive detention at the Hillsborough County House of Justice. The judge granted his petition for a public defender. He is held on no bond.

The reward increased to $43,000.

KM was arrested in Manchester for one charge of Welfare Fraud. The charge alleges that between Dec 2019 and Jun 2021, KM obtained over $1,500 in food stamp benefits by failing to remove Harmony from KM’s family account with NH DHHS Division of Family Assistance and continuing to collect food stamp benefits for Harmony, despite the fact that Harmony was no longer living with KM and husband, AM.

Jan 6, 2022 - KM was arraigned; judge set bond @ $5k and the Reward Money Climbs to $60,000.

Jan 7, 2022 - The reward for info that helps find Harmony increased to $94k.

Jan 8, 2022 - LE returned to 77 Gilford St with ground thawing equipment.

Jan 9, 2022 - LE returned again to 77 Gilford St where tarps could be seen placed over the backyard and a trailer parked in the driveway with markings that indicate it is used to warm the ground.

A vigil was held for Harmony where CS first spoke in public. She said she has been "begging for any type of answer" since she last spoke to her daughter nearly three years ago.

Search for Harmony Montgomery may focus on her father and his estranged wife’s lifestyle

Retired Boston Police Chief Dan Linskey says the search for Harmony is difficult, but it’s not impossible. He believes the trail to finding Harmony runs through Adam and Kayla Montgomery.

Right now, both are in jail.

Chief Linskey also said establishing a timeline for when Harmony disappeared is critical.

“It’s very important to try to narrow down the exact time the loss occurred, when she was last seen by folks,” Linskey said. “There’s only so many places they could have gone and been. Law enforcement will investigate those and try and find out if there’s a potential to find the little girl there.”

Linskey tells me Adam and Kayla’s cell phone activity, their emails, and their social media accounts will help investigators pinpoint where they were at around the time Harmony was last seen, and provide new areas to search

But there is more to it than that.

Both Adam and Kayla battled substance abuse, and Linskey tells me, that’s a world that could provide valuable new leads.

“People say things in the world of drugs and narcotics and criminal associates that they don’t say to others and sometimes it takes some motivation for those people to come forward,” Linskey said. “So, if I was in charge of investigating this case, my narcotics detectives would be working on people involved in that trade who might have interacted with these folks and see if there is any information they can come forward with that’s helpful.”

Harmony Montgomery Update: Gov. Charlie Baker Responds to Criticism – NBC Boston
Massachusetts Gov. Charlie Baker responded Wednesday to criticism from New Hampshire Gov. Chris Sununu of a Massachusetts judge's decision to place Harmony Montgomery with her father and stepmother before New Hampshire officials could complete a study of their home.

"We are cooperating to the fullest extent that we can with the Office of the Child Advocate here in Massachusetts, which is an independent entity," Baker said when asked about the case during a press conference. "We're as interested in knowing the answer to that as everybody else is."

We hear stories of Harmony trying to help J and just look out for J along the way, so it was very important to us that that relationship continue.”

“There’s absolutely no reason that Harmony would have been given to her biological father rather than adoption even being considered — except that biological parents rights [in the court system] reign supreme,” Bartholet said. “Why is the system paying attention to the biological father here, and not the biological sibling connection? Well, it’s because the sibling is a kid, and kids don't count. What counts are adults, and what counts are parents, not kids.”

“The court and the [child protective services] system in both states, all they had to do was scratch the surface to find out [that Adam] was an unfit father.”

Just the other night, he drew a picture of Harmony. He'll tell his teachers, ‘I have a sister, her name is Harmony. She has blonde hair, glasses and blue eyes.’ He's very proud of Harmony, and he has been since day one of coming into our family.”

Father of missing N.H. girl is suspect in unsolved Massachusetts murder

According to a knowledgeable law enforcement source, Adam Montgomery is a suspect in the murder of Darlin Guzman in Lynn in 2008.

On February 10, 2008, just before 11 pm, police found 28-year-old Darlin Guzman fatally shot in the parking lot of the former White Hen Convenience store in Lynn’s Austin Square.

Guzman was shot in the chest.

According to my law enforcement source, Adam Montgomery, along with two members of his family, have been the focus of this murder investigation almost since day one.

I’m told the investigation revealed that Adam, and two members of his family, interacted with Guzman earlier that day. And that they agreed to meet up at the White Hen in Lynn.

The result of that meeting was deadly gunfire.

Guzman’s car was recovered days later in a cul de sac in Billerica, which is in the direction of Bedford, NH, where Adam was living with his family at the time.

TF Jr., whose sister Crystal Sorey is Harmony’s mother, blames both states for losing track of his niece. He said Sorey talked with Harmony through video calls after Adam Montgomery got custody of the girl. When Montgomery broke off contact, TF Jr. said Sorey repeatedly called child welfare workers and police but was ignored.

The result, he said, was that Harmony’s home life was plagued by drug and alcohol abuse, among other problems.

“Massachusetts failed Harmony by letting her go to New Hampshire,” TF Jr., 44, said Wednesday. “New Hampshire failed Harmony by letting her live in a home like that and just ignoring it.”

Baker added he shares the same concerns as the New Hampshire governor and said that everyone wants to know why Harmony left the state without an Interstate Compact for the Placement of Children (ICPC), an agreement between states that would have required certain safeguards be in place before a foster care child is sent across state lines. In the letter Gov. Sununu sent the chief justice of the Supreme Judicial Court in Massachusetts, Kimberly Budd he expressed “grave concerns” about the decision to hand Harmony over to her father before his state had a chance to complete a home study.

Both governors have requested internal reviews of how agencies in their respected states handled Harmony’s case. Neither would say how long those investigations would take.

The last time police saw Harmony was on Sept. 11, 2019, when police were called to the house for a non-criminal, domestic disturbance. DCYF personnel would later see her in October, police said.

On that day in September, KM, Adam’s uncle, and HM, Adam’s grandmother, tried to retrieve personal items from the house. Adam told police he had paid rent for several months to his grandmother while she was living in Florida recovering from heart surgery. Adam was upset that they tried to “barge their way in without his permission,” according to the police report.

KM told Officer Travis J. Koeppel that Adam and his family had taken over the house when they originally lived only in the upstairs. He and Helen wanted to retrieve some personal items before Adam and his family were evicted at the end of the month.

On Jan. 12, 2020, police were called for the last time concerning the front door being opened; the caller thought it had been kicked in. Police said the door was not kicked in and noted that it looked like someone moved out and left the door open. The report has one or two words blacked out followed by Adam Montgomery’s name. “They were just airing it out,” the incident report says. “There was a very bad odor.”

Newman sat on the bench for almost 17 years and received many awards for his work. He was the First Justice of the Essex County Juvenile Court in 2019 when he made the controversial ruling in Harmony's case. He sat as a judge in that court from 2002 until his retirement three years ago.

“This is an appalling, appalling decision,” said Child Advocate Maureen Flatley about Newman’s decision to give custody of Harmony to her father. She said it should have been obvious that placing Harmony with her father would put her in harm’s way.

“If anybody suggested that this child might be appropriately placed with a father that had a criminal record that included shooting somebody, they really need to have their head examined," Flatley said.

The stepmother of a missing New Hampshire girl is set to be arraigned Monday on new charges.

Prosecutors dropped a welfare fraud charge against Kayla Montgomery for collecting food stamps in 7-year-old Harmony Montgomery’s name and replaced it with three other charges, including theft, according to court documents released earlier this month.

The change was being made based on updated records about the benefits provided by the state Department of Health and Human Services about Kayla Montgomery, the attorney general’s office said.

The stepmother of missing Harmony Montgomery will be allowed to leave jail if she enters a rehab program in Nashua, despite a prosecutor’s request that she stay locked up on $5,000 bail because she knows what is coming in the investigation and might flee.

He said at least one person has reported to police that Kayla and her husband, Adam Montgomery, 32, were seen with Harmony after they both told police they hadn’t seen her since the day after Thanksgiving 2019. Both said Harmony was with her mother in Massachusetts.

Just in: Judge allows Kayla Montgomery, wife of #HarmonyMontgomery's father, to be released on personal recognizance so long as she enters and completes a treatment program. If she doesn't, bail remains at $5K as it was set earlier this month. (Kayla had not posted bail.)
