Accused double murderer will have April trial on stealing charge

The trial is legally separate from the one he’ll face in 2022 for capital murder. The lesser charge stems from his time in Caldwell County Jail because of the murder case.

Nelson is accused of coercing someone outside of the jail to retrieve a trailer. Nelson has been jailed since July 2019, though the stealing charge was filed on Oct. 30, 2020.

Prosecutors and Nelson’s defense team agreed this initial trial will take about two days, beginning on April 20 or 21, 2021.

The office reports the jury was to be picked on April 20th, but no jury was chosen due to the postponement. Potential jurors came in, but they were dismissed. The public was not allowed to enter.”

Man charged in Diemel brothers murders asks for speedy trial in theft case

A Missouri man charged in the capital murder case of two Northeast Wisconsin brothers has requested a speedy trial in a separate theft case.

Last week, Garland Nelson made a second motion for a speedy trial in the case. A judge scheduled a hearing on the motion for June 21, 2021.

Nelson is charged with Stealing a Motor Vehicle. Prosecutors allege Nelson, while behind bars and waiting to stand trial for the murders of Nick and Justin Diemel, convinced someone to steal a trailer. The Associated Press reports Nelson claimed to have paid $500 for the trailer. However, investigators say Nelson did not own it.

Missouri’s News-Press NOW reports Nelson was set to stand trial in the theft case in April, but it was put on hold because advocates and media members were not allowed inside the courtroom for jury selection. News-Press NOW reports that the courtroom in Johnson County doesn’t have resources for an overflow room necessary for COVID-19 distancing protocol.
 
Accused murderer makes second request for trial on lesser charge

In a motion, Nelson’s defense lawyer said he should receive a new trial date within 120 days.

“If this court cannot set this matter for jural trial within 120 days, then the accused respectfully requests transfer to a court that can meet this demand, including a (lower court judge) if necessary,” Nelson’s lawyer wrote in the motion.

Nelson’s cases were moved from Caldwell County, where the alleged murder took place, to Johnson County because of publicity.

However, the Johnson County court was apparently unable to accommodate members of the public during jury selection, leading to a secretive process. During the closed-door hearing, it was revealed Nelson was offered a three-year plea deal on the stealing charge, but he turned it down.

Nelson’s lawyers objected to the public being kept out, and the judge then postponed the trial without a new date.

Garland Nelson, who is accused of killing two Wisconsin brothers, has a trial scheduled for next February, but the logistics could look more different than a typical case.

The abnormalities of a capital murder trial already have started. All court documents for the case are sealed to the public unless specifically requested. But the logistics become more complicated once the jury selection starts.

Johnson County Circuit Court Judge Michael Wagner has said jury selection may have to be moved to the University of Central Missouri’s campus given the likelihood of a large jury pool, and the selection process itself also could look different.

This isn't for the murders though. That trial is set for Feb. 6th, 2023. This is for mail fraud and being a felon in possession of a firearm and ammunition. It is in relation to the same murder case though, however the defense is arguing that it's not in relation and want them separated

A trial has been delayed until Oct. 3 for Garland Nelson on federal fraud charges related to business dealings with two Shawano County brothers, before he allegedly killed them. And, Nelson’s motion to suppress evidence in the case has been denied.
