Megan Boswell had been set to face a jury trial in February 2023; however, in a court hearing Wednesday, her trial was delayed and set to Feb. 3, 2025.

A News Channel 11 crew was in the courtroom as Boswell appeared with her new legal counsel, who recently requested she be allowed to wear civilian clothes while in court. Her attorney, Gene Scott requested the trial date change on Wednesday.

“Delay is generally not good for the state in that we’ve got lots of witnesses that [we] are now going to have to…keep tabs on and keep them kind of on the hook for several years now until it does go to trial,” said Sullivan County Deputy DA William Harper.

“We understand that the new attorney has just been appointed to the case, but obviously, it’s a lot of work, and we’re ready to get it underway,” Harper said. “We had a trial date set in next year, and the state was prepared and ready to go.”

Scott continues to familiarize himself with the case and said that work includes digging up any and every document the defense can find, including past hearings and expert testimony.

“The discovery in this case is just very voluminous,” Scott said. “There’s a lot of experts that will be needed for both sides of the case, and we need to follow up on those things.”

The defense attorney said Boswell has been cooperative, but he’s “not going to get into the ins and outs of [his] relationship with Megan.”

“I think there’s some questions about Megan’s mental health that we want to explore, and I don’t really feel comfortable talking about our relationship,” Scott said.

“We wouldn’t have asked if we didn’t think it was absolutely necessary," said Scott. "Obviously Megan is in jail and can't make bond so we didn’t want to put if off any longer than we have to, but at the same time the case is so complex and there’s a lot that needs to be done...so essentially it’s a 24 month continuance from where the trial is set right now.”

In the meantime Scott said he plans to file new motions, including a recent motion to allow Boswell to wear civilian clothes inside the courtroom, instead of her inmate jumpsuit. He said they also plan to ask for a change of venue.
 
I just tried to add MB’s 2025 trial to my calendar. My iCal won’t even schedule beyond 2 years!

Will key witnesses even be around in 2025?

Boswell's high-profile murder trial has been twice delayed and its latest scheduled start date is February 2025, five years after the baby's decomposing body was found “tightly wound” in a blanket and aluminum foil, and stuffed into a trash can.

She was still alive when she was shoved into that receptacle, where she suffocated, according to pre-trial testimony. The bin was inside a playhouse that was built for Megan when she was a child, according to authorities. The playhouse was on the family's rural Tennessee farm, where various relatives had lived over the years, including Megan and Evelyn, investigators said.

There are many reasons for the long delay in attaining justice for Evelyn's killing, some of them manmade and some beyond human control. The COVID-19 pandemic didn't help. Neither did seemingly endless speculation driven by social media and unrelenting media attention, those associated with the case tell Inside Edition Digital.

Child Services; Evelyn’s remains were found on Mar. 6, 2020 at a family member’s property at the 500 block of Muddy Creek Road in Sullivan County; officially id’d Mar. 11, 2020). *Megan “Maggie” Boswell (18/now 22) aka Maggie Wood aka Megan Nicole Kys “mother” arrested & originally charged (2/25/20) with 1 count of false reporting. Bond set at $25K. Bond increased (3/9/20) to $150K. [see below for re-charges].
Indicted (5/18/20) & originally charged (5/28/20) with 11 counts of false reporting. Plead not guilty. Bond stays set at $150K. [see below re re-charges].
Re-Charged & indicted (8/19/20) & arraigned (8/28/20) with 2 counts of 1st degree felony murder, 2 counts of aggravated child abuse & neglect, 1 count of tampering with evidence, 12 counts of false reporting, 1 count of abuse of a corpse & 1 count of failure to report a death suspicious, unusual, or unnatural circumstances. Plead not guilty. $1M bond. Bond reduction denied (12/3/21).
Trial was set to begin on 2/6/23 continued to 2/3/25. (expected to last 3 to 4 weeks).

12/6/22 Update: Defense filed motion to allow Boswell to wear civilian dress clothes during hearings. The request was made "because of the extraordinary publicity & media attention her case is receiving," according to the motion. Announcement hearing on 12/14/22 at which a new trial date will likely be set. Motions hearing on 12/16/22.
12/14/22 Update: Defense attorney Scott said he plans to file new motions, including a recent motion to allow Boswell to wear civilian clothes inside the courtroom, instead of her inmate jumpsuit. He said they also plan to ask for a change of venue. Motions hearing on 12/16/22 is cancelled. Next status hearing on 4/21/23. And since she received a new attorney, trial has been moved to 2/3/25.

  • Boswell’s recently appointed attorney, Gene Scott, told News Channel 11 this appearance will likely determine the schedule of hearings after her trial was pushed back to 2025 at her last hearing in December.
  • Goodwin has yet to rule on Scott’s request to allow her to wear civilian clothes during court appearances.
