I really, really hope that these two do not get off!! We all knew that they would try to pin everything on Alex. I do think Alex was involved, but we all KNOW that these two had a hand in almost everything! Uugghhh!! I can't imagine how Kay, Larry, and of course Tammy's family feels!

I am confident they will be found guilty if they finally make it to trial. Just hoping Lori doesn't toss more monkey-wrenches to delay the process.
 
Going back to the original probable cause affidavit and Chad's preliminary hearing, we learned quite a bit about where Alex was on the nights Tylee and JJ were killed.


TYLEE

So, when exactly was Tylee killed that night? It seems whenever it happened, it had to have occcured between that window of 12:45am and 4:36am when Alex was specifically not in his own apartment. Because later that morning around 9am, he left his apartment with Tylee's body in his truck and drove directly to Chad's pet cemetary where she was found dismemebered, burned, and buried.

Remember: Lori's apartment was #175 and Alex's apartment was #107.

On September 8th, after the trip to Yellowstone:
  • Alex's phone returned to Rexburg, ID at 8:37pm
  • Alex was at Lori's apt. #175 until 9:35pm
  • From 9:43-9:53pm, Alex is at the Maverick on Main Street, Rexburg, ID
  • 9:54-10:43pm? (49 minutes) - location not specified
  • From 10:44-11:15pm, Alex is at Lori's apt. #175 again
  • 11:16-11:43pm? (27 minutes) - location not specified
  • At 11:44pm, Alex is at his apartment #107
On September 9th:

September 9th is the only time Alex was at Lori's between midnight and 6am. So on the 22nd, if JJ was truly sleeping on Alex's shoulder and he was not covered in duct tape and a garbage bag already, and Alex didn't return to Lori's that night, then Lori killed JJ with duct tape and a garbage bag or at the very least, she wrapped him in duct tape and a garbage bag for some unknown reason sometime in the night.

The only other scenario would be that Alex could have picked JJ up after 6am but before 8am (when MG and DW woke up) and murdered him on the morning of the 23rd. Then drove to Chad's to bury him.

On September 22nd:
  • Around 8:30pm, Lori texted MG (not verbatim): "Hey, I'll be there shortly. JJ woke up and I'm getting him back to bed." (Chandler police file dump.)
  • 9pm-midnight: MG, DW, and Lori were podcasting in #175.
  • Alex brought JJ back to #175 from his apt. #107 sometime in the middle of that recording session. JJ was sleeping on Alex's shoulder and he put JJ to bed in Lori's bedroom and left for the night.
  • After recording, Lori went to her bedroom.
  • DW & MG went to their room where they shared a bed that night.
On September 23rd:
  • DW woke up from a bad dream.
  • MG texted and called Lori and Chad's cell phones for a blessing for DW. She got no answer. Then she went to Lori's room down the hall and jiggled the doorknob. The door was locked.
  • She went back to David.
  • Between 8am-9am, DW and MG and Lori meet in the kitchen of #175. This is when DW asks where JJ is and Lori gives that story of JJ crawling up the cabinets and tells DW that Alex had to pick him up again because of this behavior.
  • 9:30am MG and DW leave Rexburg.
  • 9:55am-10:12am Alex is in Chad's backyard, near the pond where JJ was buried.

Technically Alex could have left his phone in his apt and went to Lori's to get JJ on the night of Sept 22/23. Alternatively Lori could have taken JJ to Alex's apt and locked her bedroom door. We know nothing about Lori's phone pings or her movements.

One of the questions is, where is the podcast recording from Sept 22? That episode has never aired.

As for the night of Tylee's murder, do we suspect that she was killed in the middle of the night when Alex paid a visit to Lori and then loaded onto Alex's truck?

Yeah & why did she have Tylee’s bank card and JJ’s iPad when captured in Hawaii…not to mention she rerouted their monthly SS survivor benefits (coming from their deceased fathers) to her account.

Why, if Lori is innocent, did she let JJ go to Alex’s unit, when Tylee went there and was now either missing or dead? Why did she not go to the police immediately after Tylee didn’t return? I love my brother, but if my child disappeared in his care I would be straight to the police station!

So - from the pdf files that you attached - they BOTH are on ALL these hearings. Not just LV on 1/19/23. Correct?

Both of them for all dates.

These are dates the court set aside for pre-trial motion hearings with the court not knowing what motions will be filed by the parties. I think so close to trial that both parties will be filing motions, from all cylinders.

John Prior said something in a footnote somewhere about Chad asking for additional court-appointed counsel. He's drowning at this very moment I reckon. Chad and Lori coming together with a plea deal would save his bacon.
 
So on December 23rd 2022 Chad filed a motion of objection to the court's scheduling order issued on December 16th.

The footnote on page 3

"The Court also noted "the purely speculative argument that some other attorney may at some point join the defense team, and the new attorney would need time to prepare." See Memorandum Decision and Order at 3. At the time of filing the prior Motion to Continue, Mr. Daybell had not yet requested the appointment of an additional, capital-qualified attorney to the defense team. He has now done so and the reason is no longer speculative."

His objection to the scheduling order was denied by the court on 4th January 2023. Basically the judge said that Daybell has had ample time to prepare for trial and has known since August 5th 2021 that the State was seeking the death penalty.

Prior filed another motion to continue on 3rd January.

Now that Chad is indigent I expect we will see the appointment of additional counsel imminently.

Actually I also just noticed that the hearing on 19th January will be used by the State for their motion for jury sequestration.
 
I wonder if JP/CD waiting until the last minute to declare indigency is a last ditch effort at severance, since any newly-appointed counsel would require time to catch up. However, there are still 3 months until trial.
 
Chad's motion to continue (dated 3rd January) will be heard at the motions hearing on 19th January. He's asking for trial to be pushed to April 2024.

It makes for interesting reading but it's just a big whinge, IMO.

JP waited a whole YEAR to hire a mitigation specialist in August 2022. How lazy is that! It's not like there was a chance of the charges against Chad going away.

His 17-page motion goes on about how mitigation work is so vital that if it is not done as thoroughly as it ought to be done, cases cited show death sentences have been overturned. High likelihood of a death sentence being overturned doesn't demonstrate a prejudice to Chad! If he does better mitigation work there's increased likelihood a death sentence will stick.

He says they can't prepare for a guilt phase of 'he didn't do it' and a sentencing phase of 'he's sorry he did it'. Well that's trial strategy. That isn't going to be resolved by putting the trial back a year. It's one of the pitfalls of every not guilty plea, every defendant who refuses to take responsibility for murdering innocents. He wasn't sorry, he wanted them all dead and he was playing the ukulele because he was so ecstatic, remorseless and twisted.

It looks like JP had all his eggs in one basket, trying to get the prosecutor off the case, instead of focusing on his client. The time spent preparing this document just shows that his attentions are always on trying to disrupt and delay the process rather than on trial strategy and settlement. What a contrast with Archibald, IMO.
