Missing Baby Gabriel case turns focus on S.A. homicide detective

The latest chapter in the case of a missing Arizona child, Gabriel Johnson, focuses on a San Antonio police homicide detective. A hearing concerning Detective Jesse Salame is scheduled in a Bexar County Courthouse Friday morning.

SAPD loses round in Baby Gabriel case

A hearing Friday before state District Judge Philip Kazen determined that SAPD Det. Jesse Salame had to respond to an out-of-state subpoena filed by attorney Daniel Raynak.

During the hour-long hearing, Raynak argued that Salame's interview violated his client's 6th Amendment right to counsel in the Arizona case because her lawyers were not present.

Assistant City Attorney Debbie Klein argued that Salame's still-open homicide investigation into the missing baby case was distinct and separate from the Tempe Police Department's kidnapping case.

Kazan also ordered police here to release a recording of Salame's interview with Johnson to her attorneys. City attorneys had argued that evidence in an open criminal investigation cannot be ordered released.

Groupon drops promotion tied to Baby Gabriel defendant

Groupon, an online coupon company, raised a ruckus today by temporarily offering a promotion for a company owned by Tammi Smith, who is charged in the disappearance of Baby Gabriel.

The first fuming comment, from Tonia G. (Groupon comments omit last names) was “Can’t believe you would put an accused criminal facing trial for a missing baby on your site. Very disappointed in Groupon today, and I am going to cancel my account.”

Dozens of similar comments were posted, and Groupon decided to pull the deal.

Desperate acts of 2 in Baby Gabriel mystery

The meeting in Indianapolis between the two Valley women with complementary passions would pave the way for one of the biggest unsolved Arizona crimes in recent history: the disappearance of Baby Gabriel on Dec. 27, 2009.

The union of a woman who wanted someone else's baby and a confused unwed mother furious at her boyfriend would lead to bizarre adoption schemes and, ultimately, the mystery surrounding a baby's unknown fate.

The case continues today in Maricopa County Superior Court, when a status conference is scheduled for Smith and Johnson.

Baby Gabriel's mother gets trial date in case of missing baby

That the case may be reaching a conclusion is good news for Logan McQueary, 26, who made a rare public statement Monday.

"I am relieved to finally get a trial date," he said.

Maricopa Superior Court Judge Paul McMurdie also set a date of July 25 to hear Johnson's motion to dismiss, and ruled to sever the cases of Johnson,24, the baby's mother, and Smith, 39, the would-be adoptive parent.

The Honorable Paul McMurdie, the Maricopa County Superior Court judge presiding over the nationally watched case, wrote in a memorandum that there is no question that Johnson's rights were violated.

However, McMurdie also said that dismissing the charges is not the only remedy, and the court "must fashion a remedy" based in part on the arguments Wednesday.

= After listening to testimony about a San Antonio detective whose "over the top" tactics during a jailhouse interview deeply affected Elizabeth Johnson, a Maricopa County Superior Court judge ordered her to undergo a second competency evaluation. Johnson was seeking to dismiss the charges against her.

= "A dismissal in a situation like this is a last resort," Judge Paul McMurdie said. "If she is not cooperating with her lawyers, she needs to be restored. If she can't be restored to competency, there is a civil remedy."

= That remedy would be to commit her to a psychiatric facility for treatment, said her current attorney, Daniel Raynak.

= McMurdie said he would postpone a decision on whether Johnson was so tainted by her "infatuation" with San Antonio Detective Jesse Salame that she no longer trusts her lawyers, the basis of the motion to dismiss.

McQueary, meanwhile, said he wishes more efforts were going into finding his son. He said Johnson is competent and putting on an act. She may not have cooperated with previous attorneys, but she has cooperated with Raynak and co-counsel Marcia Kratter, McQueary said.

"I was hoping we could go forward with the trial," he said after court.

A judge ordered Elizabeth Johnson, the mother of missing Baby Gabriel, to undergo another psychological evaluation to determine if she is competent to stand trial.

Johnson’s attorney presented a full day of testimony on Wednesday to convince a judge to throw out her case. He argued that her constitutional rights were violated during an interview conducted by San Antonio Police Detective Jess Salame.

Competency hearing again ordered for Baby Gabriel's mom

An Arizona judge stopped a hearing Wednesday on a motion to dismiss the case against Elizabeth Johnson, whose baby son Gabriel was last seen here in 2009, ordering her second mental competency evaluation.

Maricopa County Superior Court Judge Paul McMurdie called for the evaluation following a psychologist's testimony for Johnson's defense team, a court spokeswoman said.

Her previous defense attorneys filed the motion to dismiss the Arizona charges in October, 2010, alleging that a San Antonio Police Department homicide detective violated her constitutional rights in a May, 2010 interview.
Johnson was deemed competent last summer to stand trial and a trial date is set for Aug. 8, records show.

After sitting in jail for 16 months for the kidnapping of her own son, Elizabeth Johnson was hoping a Phoenix judge would set her free today. Johnson and Baby Gabriel were last seen together here in San Antonio. Our Yami Virgin has been following the case since the beginning and was the only local reporter in Phoenix today.

HOENIX -- Florida's Casey Anthony murder trial has some similarities to a couple of Arizona cases in which mothers were suspected in the disappearances of their children, according to Phoenix attorney Michael Kimerer...


....Kimerer said there also are parallels between the Anthony case and Arizona's case of "Baby Gabriel."

Nine-month-old Gabriel Johnson disappeared in December 2009 when his mother, Elizabeth, allegedly took him away from the Valley. She claims she gave the child to someone in Texas. Elizabeth Johnson is jailed in Phoenix on charges of kidnapping, child abuse and custodial interference.

"Certainly, the Baby Gabriel case has some similarities here," Kimerer told Lawrence, "where a child is gone and the mother is looked at as being the person who caused the child to either be missing or is responsible for killing the child."
