Baby Gabriel's father agrees to turn himself in

Baby Gabriel's father, Logan McQueary, has agreed to turn himself in and be arraigned on Monday on a charge of trafficking in stolen goods....

....The whereabouts of McQueary, 27, were in question as recently as two weeks ago, when a warrant was issued. McQueary fled from Arizona after a Scottsdale friend accused him on Oct. 31 of stealing and selling his Wii, according to court papers....

...The records show that a Maricopa County Superior Court commissioner on Tuesday quashed McQueary's arrest warrant...

...Thursday, Cobb confirmed that McQueary will face justice on trafficking in stolen goods case and that it will be handled in such a way as to allow him to testify in the trial against Smith....

...Also damaging to Smith was the afternoon testimony of Tempe police officer Gregory Duarte.

Duarte indicated that while he and other Tempe investigators were at the Smith's North Scottsdale home in late December 2009 looking for Elizabeth Johnson and her baby, after the pair had fled to Texas, Tammi Smith was actually exchanging text messages with Johnson -- unbeknownst to the police officers inside the Smith's home...

...Ayala said Smith would reportedly approach pregnant women, asking if they wanted to give up their baby for adoption. One of those women was Elizabeth Johnson, pregnant and considering adoption...

PHOENIX -- She's been protrayed as a woman so desperate to have a child, she would do anytyhing, even arrange the illegal adoption of now missing baby Gabriel Johnson.

Tammi Smith is on trial accused of forgery and conspiracy. 3TV has uncovered disturbing details about Smith's biological sister, Billie Jo Peters...

...On June 14, 2002 inside apartment number 1096, Peters, who shows a striking resemblance to her biological sister Tammi Smith, was on a horrifying mission.

McKay explains, "She put some water in the tub, a few inches of water in the tub to help with the mess, the way she put it, and she strapped her baby into an infant carrier seat and she laid with him in the tub and she cut him first and then herself."

...Court records show Peters was charged with Attempted First Degree Murder and Child Abuse and found Guilty but Insane.

Rather than serve time, Peters was sentenced to the Arizona State Hospital where she remains today.

Elizabeth Johnson's attorney speaks out on Baby Gabriel case

TEMPE, Ariz. -- It's the case that has captivated the nation -- the case of the missing Tempe baby, Gabriel Johnson.

The forgery and fraud trial of Tammi Smith, the Scottsdale woman who tried to adopt Gabriel, recently ended with Smith being convicted.

However, The story is far from over. Later this year the baby's mother, 25-year-old Elizabeth Johnson, goes on trial.

Johnson's attorney said his client insists she did not kill her baby and that she loved Gabriel...

...Victor also talked about Smith's conviction in the case. "Tammi Smith did lots of things to get Elizabeth to do lots of things now. I say this not to put out there that Elizabeth Johnson did nothing wrong and takes no responsibility. That's not her position."

Montgomery: Work not done in search for baby Gabriel

PHOENIX (CBS5) - Nearly a week after one of the women accused in the disappearance of baby Gabriel Johnson was found guilty, Maricopa County attorney Bill Montgomery said they are continuing efforts to find the boy.

"As far as our pursuit of the truth in determining the whereabouts of baby Gabriel, that was a significant step, but our work is not done," Montgomery said.

A Maricopa County judge refused on Friday to lower the $1 million bond for the mother of missing baby Gabriel...

Johnson's attorney also filed a motion to have the charge of child abuse dropped, but a decision on that is still weeks away...

The judge also ordered deputies in the jail to unshackle Johnson when she meets with her attorneys..
