Both charges are for Chyenne.
They are just slightly different theories.
One says he strangled her to kill, the other says he knew it created a strong possibility of death.

The criminal complaint says Abbas, "without lawful justification, and with the intent to kill 'C.K,' a minor, strangled 'C.K' with his hand, thereby causing the death of 'C.K.'."

In the second and related charge,
the criminal complaint says Abbas "knowingly, without lawful justification, performed an act that created a strong probability of death," in that he "strangled 'C.K'," thus causing C.K.'s death.
 
I think a family member discovered the truth. He may have confessed or may have let something slip.

MsFacetious, do you think (and it may be obvious ) that the first count is he killed her and the second count ....sorry i was just strangling her and she died, but i didnt mean to kill her....
 
Press Conference:

Made an arrest, charged Terry Abbas with two counts of murder.
For the homicide of Chyenne Kircher.

We have reason to believe that her body is located right by her home.
We are doing some excavation with FBI technicians.
Behind her home in the wooded area, we feel very strongly she is there.

We are running a little behind, we will reschedule this conference until 4pm.

Two counts of murder are because of the two theories of the murder.
Both counts may stick.
I'm sure that there will be more charges down the line.

They say that they arrested him due to their investigation. He didn't turn himself in.
The Critical Response Unit has been investigating it for 6 months.
The local Chief brought them in because their investigation didn't show any unusual circumstances.

Will not say how they know he strangled her.
Won't say if any other family members were involved.

They hope to finish excavating within 2 hours and have more information.
Another press conference at 4pm.

Yes, that's exactly it. :seeya:
One is a "he strangled her intending to kill her" and one is a "he strangled her and knew it COULD kill her."
 
They held a short press conference and announced that the full press conference will be held at 4 p.m. Eastern time. I believe they delayed it because they want to wait until they find her body.

He did go ahead and respond to a few questions. The two murder charges is because they have to file a separate charge for each theory of how she was murdered.

They said a special unit comprised of multiple agencies took over the case six months ago and has received assistance from the FBI. They said he did not turn himself in, but they declined to say how they determined that he killed her. They said that their focus is on him and that they are not focused on her mother.
 
That dear Mother. Two years of missing her girl, and longing for news about her. If the body is indeed near the home, gosh my heart breaks for her. So sad!
 
Good on the chief for bringing in the new group to work on this case when they had nothing. Wish more LE would do that
 
could someone tell me how LE missed a new grave near the house?


I doubt East Dubuque PD even looked in the yard or the house for that matter.

With the letter that was found in the vehicle it was assumed she was a ran away.

For LE to search the property would have required a warrant and there was no probable cause to suspect that she might have been killed or buried to apply for a warrant. Of course asking the parents for permission to look around the yard and then doing a quick check is another thing. But again with the assumption that she had run way I doubt that was done either.

The search is being concentrated on a wooded area behind the home once shared by Abbas, Kircher and Kircher’s mother, Lori Lyons.

A Jo Daviess County investigator said excavation work is underway approximately 100 yards behind the building, which is located directly across from East Dubuque Elementary School.

100 yards away this whole time. I knew she was dead but I never thought she was THAT close. :banghead:

No further information another postponement till tomorrow morning at 8am.
Very detailed excavation right now.

FBI working with Illinois State Police are working the excavation as well as helping with the investigation.
These things can take a lot of time to do them right.

Bond set at $1 million.
He is in custody at the Sheriff's office.
Nobody else in custody at this time.

The mother was still living in the house with Chy's little brother. :tears:
Will not say how they charged him without a body.
Won't answer if there is a confession.

Next presser at 6am PST, 7am MST, 8am CST, 9am EST.
