Prosecutors expected to release more evidence in Casey Anthony case

Prosecutors are expected to release more evidence in the first-degree murder case against Casey Anthony this morning.


The state is expected to release about 300 pages today.

UPDATED: FBI lab notes among latest batch of Casey Anthony evidence

According to a report, FBI analysts looked for human hairs that had signs of decomposition in evidence they collected, including from a steam cleaner and vacuum. The report said none was found. The FBI also analyzed hair samples belonging to Orange County Sheriff's Office crime-scene investigators. That evaluation was done to determine who a strand of hair &#8212; found with evidence &#8212; came from.

Evidence logs from the Sheriff's Office again detailed items taken from the woods where Caylee's remains were ultimately found, including dirt, soda cans, bugs and electrical tape.

Also released Friday was a transcribed interview with Cecilia Benhaida, sister of the woman who sparked a close relationship with Casey Anthony's father George Anthony.

The next hearing in the Casey Anthony case is scheduled for Friday.

The public has already seen transcripts of interviews, FBI reports, pictures and cell phone logs, but when Casey is tried for the murder of her 2-year-old daughter, Caylee, it&#8217;s unlikely every bit of evidence in the small mountain of pages will be brought up during the trial.

Friday&#8217;s batch of documents include FBI testing results, case notes, command logs and evidence logs.

The logged evidence includes items taken from the Anthony family&#8217;s Orlando home, a black trash bag found near the site where Caylee&#8217;s remains were found, comparisons of duct tape and hair samples taken at the crime scene.

The documents also included a transcript of an interview with Cecela Benaida, who told investigators her sister, Krystal Holloway, also known as River Cruz, had an affair with Casey&#8217;s father, George Anthony.

NOON UPDATE: The documents say hair samples were taken from a vacuum in the Anthony&#8217;s home. The vacuum was believed to have been used to clean Casey&#8217;s car. The documents say none of the hairs taken from the vacuum show signs of decomposition.

The documents also say that George Anthony&#8217;s alleged mistress&#8217; twin sister befriended Casey in jail, and helped clean Casey&#8217;s jail cell.

3 p.m. UPDATE: An acquaintance of George Anthony told investigators that she was told the little girl's death was an accident. Cecelia Benhaida said during a police interview that George Anthony told her sister the death of his granddaughter, Caylee, was an accident. She said she didn't know any other details. The interview with Benhaida was released Friday by the State Attorney's Office in Orlando. Benhaida says her sister, Krystal Holloway, had a close friendship with George Anthony.

George Anthony's attorney didn't immediately return a phone call seeking comment.

A statement is contained in the documents that is attributed to Mallory Parker. She is the girlfriend of Anthony's brother, Lee. The statement suggested that Lee Anthony and Parker knew on some level that Casey Anthony killed Caylee.

Lee Anthony's attorney spoke about the documents on Friday. "To this day, I believe everything my sister tells me," Lee Anthony said in a videotaped deposition.

In multiple sworn depositions, Lee Anthony has said under oath that he doesn't know what happened to his niece. But in a 2008 interview included in the documents released on Friday, a journalist, Rozzie Franco, told authorities of a conversation she had with a co-worker of Parker. The co-worker said Parker and Lee Anthony have suspected for a long time that Casey Anthony killed Caylee.

"He is in support of his sister all the way," attorney Tom Luka said. Luka denied that Lee Anthony or Parker ever made a statement to anyone that suggested they know or suspect that Casey Anthony killed her daughter -- or that she confessed to any role in her daughter's death. "Nor did he admit to any sort of behavior that would indicate that Casey knew what happened to Caylee," Luka said.

Local 6 News reported that it appears neither the prosecution nor the defense knows to whom the mystery hair belongs. The state could argue that there is a simple explanation for the hair that was found in the woods. But the defense could try to use the hair to suggest that it belongs to an unknown killer.

When Caylee's remains were discovered, detectives found a World of Disney bag nearby. Inside the bag was a Gatorade bottle, which contained a syringe and a brown liquid that contained extremely small amounts of the chemical chloroform. The FBI crime lab later determined that the liquid was testosterone, possibly used as a steroid for bodybuilding.

Crime scene investigators placed the items from the bag on a piece of brown paper to take a photo, and the 5-inch-long strand of human hair was discovered on the paper, the documents show. The hair does not belong to Casey or Caylee Anthony, and the documents released on Friday show that it also does not belong to any of the crime scene investigators who handled the evidence.

Meanwhile, a transcript of a taped interview with Cecilia Benaida, the sister of Krystal Holloway -- who is also known as River Cruz -- conducted by Orange County Cpl.. Eric Edwards was also included in the documents. In the interview, Benaida told investigators her sister and Anthony's father, George Anthony, became friends and she assumed they had a physical relationship. Under oath, Holloway denied having an affair with George Anthony. Benaida also said that her sister gave George Anthony about $5,000, but she didn't know what he did with the money, according to the transcript.

The mystery hair could help the defense claim that other evidence in Casey's case was contaminated by investigators, and there&#8217;s still their theory that there&#8217;s another killer responsible. The documents indicate the FBI tested the mystery hair against samples from Orange County sheriff's investigators who were at the scene and whose hair could be a match to the dark strand that was found. The hair did not match Caylee or her family.

The newly-released documents show that a five-inch long, fine, dark brown strand of hair from a Caucasian was found with a piece of plastic from the scene where Caylee's remains were found. The documents show the medical examiner's office investigator isolated it on collection paper while examining the piece of plastic. Seven Orange County sheriff's investigators each submitted five head hairs so the FBI could determine whether the hair came from any of them. The records don't show whether they ever figured out whose hair it is, but WFTV has learned they haven't.

Could that mystery hair do for Casey what the bloody glove did for OJ Simpson? WFTV legal analyst Bill Sheaffer says no. &#8220;&#8217;If it doesn't fit, you must acquit.&#8217; This evidence does not rise to that level,&#8221; Sheaffer said.

The documents released Friday also included a transcript of an interview with the sister of a woman who claims she had an affair with Casey's father, George Anthony. Cecelia Benhaida spoke to investigators on February 18, 2010. Cecelia Benhaida said during the police interview that George told her sister the death of his granddaughter, Caylee, was an accident. She said she didn't know any other details. George Anthony's attorney didn't immediately return a phone call seeking comment. His daughter, 24-year-old Casey Anthony, has pleaded not guilty to first-degree murder and has said a baby sitter kidnapped her daughter, Caylee.

Another transcript released was a November 2009 interview with Derrick Williams, whose name got connected to the case as a result of his address at the infamous Sawgrass Apartments, where Casey allegedly left her daughter with the mystery nanny named Zenaida Gonzalez. Williams contacted deputies to speak with them in an attempt to clear his name.

A third transcript, an interview with Rozzie Franco, was previously released in early April and involves a conversation Franco overheard at an Orlando Houston's restaurant.

New judge already setting tone in Anthony case

The new judge in the Casey Anthony case takes some action on Thursday. Judge Belvin Perry lays down the law in setting his first hearing in the case he also some rules for the attorneys on both sides of the case to follow.

The judge ordered attorneys to review the 9th Judicial Circuit's Courtroom Decorum Policy. "I think that's directed at both sides. They're not going to be able to squabble like they've been doing," said Tennis. The new judge also wants to set deadlines and know what motions have not yet been heard. "I think that's defense oriented. I think he's going to want depositions set, what exerts are you going to use. I think he's going to get this on a tight leash," said Tennis.

Judge Perry also wants to know what motions will require hearings. And he's demanding a courtesy copy of all future motions sent to him. "I don't think he appreciated that Judge Strickland went way on a Friday afternoon for a weekend not realizing this was going to be brewing over the weekend I think he's thinking it was rude. I don't think he's planning on that happening to him have any surprises he learns about in the media," said Tennis referring to Casey's defense team, who filed their motion after 4:30 p.m. Friday, asking Judge Strickland to recuse himself.

FOX 35 asked Tennis is it's typical for a Judge to write an order like the one Chief Judge Perry did when taking over a case. "This is a special order for a special case. It sends a signal, he doesn't care for how the lawyers have been behaving in the courtroom and that's going to come to an end," said Tennis.

That hearing is April 30th at 9:30 a.m. on the 23rd floor of the Orange County Courthouse.

But when detectives pressed the issue, Kealing added, they &#8220;deteremined the context of the alleged conversation between Parker and a co-worker was only that Parker believed Casey killed Caylee and that Casey never confessed the crime to her.&#8221;

Local 6 Details Mystery Hair In Anthony Case

A piece of potential evidence in the Casey Anthony murder trial is a hair that was found near where her daughter Caylee&#8217;s body was found on Dec. 11, 2008. FBI lab results previously showed the hair did not belong to Casey or Caylee.

Other media have inaccurately reported the hair was found on duct tape with the body. This is how Local 6 correctly determined where the hair originated.

Page 13846 of the discovery released on Friday contains this information:

That shows the FBI compared the hair to those from evidence technicians who had access to specimen Q107 and found no match -- so it was not contaminated by the evidence technicians. But what is specimen Q107?

For that, Local 6 went to page 10284 of discovery released in October 2009 and found this:

These FBI lab notes show the Caucasian head hair was compared to Caylee&#8217;s (Q59) and Casey&#8217;s (K2) and found not to be a match. It also shows where the collection paper that contained the hair came from: H-60518, Item 4, Q91. This is an Orange County sheriff&#8217;s evidence number, and Local 6 found it on page 3473 of the discovery released in February 2009.

That proves that Q107 Collection paper (H60518, Item 4, Q91) is referring to the paper underneath the World of Disney bag and Gatorade bottle, found just inches from Caylee&#8217;s skull.

For further proof that the sheriff called this evidence number Q91, look to page 3705 of the February 2009 discovery release, and you see this:

Q91 clearly refers to the paper upon which the bottle and bag were photographed. And if you look closely at the lower right-hand side of this evidence photo of the Gatorade bottle, you see what appears to be a hair on the collection paper. Whether it is the &#8220;mystery&#8221; hair or the animal (rabbit) hair referred to in the FBI lab notes above (page 10284), we cannot say.

Earlier, Belich had reported that the mystery hair was on the duct tape found with the toddler&#8217;s remains. WESH-Channel 2 also reported that the strand was &#8220;on the duct tape across Caylee&#8217;s skull.&#8221; But the documents released today say nothing about a mystery hair on duct tape. And Belich updated her initial report by later saying: &#8221;A 5-inch-long, fine, dark brown strand of hair from a Caucasian was found with a piece of plastic from the scene where Caylee Anthony&#8217;s remains were found.&#8221;

In other Anthony news today:
***Belich focused on the news that an FBI expert unintentionally left her DNA on a piece of duct tape. &#8220;The defense could use the FBI&#8217;s slip-up to Casey&#8217;s advantage,&#8221; Belich said. Analyst Sheaffer predicted that the defense would seek to have the evidence excluded but the court is unlikely to agree.

***WKMG reported that Anthony defense attorneys Jose Baez and Cheney Mason visited the office of Mark NeJame, attorney for Texas EquuSearch. The Anthony attorneys went to look at records of EquuSearch volunteers; the defense had wanted photocopies of the records. &#8220;Twice the judge ruled that the only way for the defense team to see those records was to view them in person at Mark NeJame&#8217;s office,&#8221; DeForest reported. &#8220;For the first time in eight months, the defense finally did that.&#8221; NeJame was out of the office and didn&#8217;t want to comment on the situation, DeForest said.

***WESH-Channel 2&#8217;s Bob Kealing focused on Lee Anthony&#8217;s girlfriend, Mallory Parker, and a conversation she had with a co-worker. &#8220;He is in support of his sister all the way,&#8221; attorney Tom Luka told Kealing.

Lee Anthony has said Casey never confessed or suggested she knew what happened to her daughter, Luka added. &#8220;He&#8217;s obviously waiting to see what happens, if there&#8217;s any more evidence comes out,&#8221; Luka said. &#8220;But as it stands at this moment, he is 100 percent behind his sister.&#8221; Lee Anthony has immunity from prosecution for anything he testifies to as long his stories are truthful and consistent, Luka told Kealing.
