Casey Anthony: Jose Baez blasts WESH story on transcripts
posted by halboedeker on May, 18 2010 5:34 PM
<snipped>
On the 4 p.m. news, WESH anchor Martha Sugalski read Baez’s critique: “Your story really showed your bias. There are thousands of transcripts ordered every day across the state and to do a story on it is pretty transparent.”

Sugalski added that the station’s report focused on the Anthony team’s first request for services at taxpayer expense and that transcripts can cost hundreds of dollars apiece.

Anthony Defense Seeks More Death Penalty Evidence
Defense Team Files Motion To Strike State's Notice

UPDATED: 12:28 pm EDT May 20, 2010
<snipped>
Prosecutors and Anthony's attorneys had a disagreement during court hearings last week over how much detail the state should provide regarding their reasons for seeking the death penalty. In a motion filed Thursday morning, the defense said the state failed to provide any indication of the evidence it intends to rely on to prove the existence of the aggravating factors.

The defense also demanded more discovery evidence from Oak Ridge Laboratory concerning the so-called sniff tests done on the air in Anthony's car.

The state attorney's office is also preparing to release as much as 500 more pages of evidence in the case as early as Friday.

Or as WFTV-Channel 9 anchor Vanessa Echols put it: “A defense motion filed today also claims that prosecutors were not definitive about using all five of the death-penalty aggravators and that they failed to indicate which evidence they planned to use to prove the aggravators.”

The defense also wants more discovery evidence from a sniff test performed on the air in Anthony’s car, and the state could release 500 pages of evidence as early as tomorrow, Kealing reported.

Casey's Lawyers File Motion To Strike In Case
Posted: 1:28 pm EDT May 20, 2010
<snipped>
Casey Anthony’s defense lawyers are complaining that prosecutors didn't give them notice before filing the legal reasons they plan to argue for a death sentence.

A defense motion filed Thursday also claims prosecutors were not definitive about using all five of the death penalty aggravators and that they failed to indicate which evidence they plan to use to prove the aggravators.

Prosecutors say the murder was cruel, cold, calculated and premeditated, that it was a result of aggravated child abuse, and that Caylee Anthony was particularly vulnerable because her killer was her mother.

Anthony Defense Wants More Proof
State Recently Listed 5 Aggravated Factors For Death Penalty Case

POSTED: Thursday, May 20, 2010
UPDATED: 7:26 pm EDT May 20, 2010
<snipped>
Casey Anthony's defense is asking a judge to require that the state provide more proof of the aggravating circumstances surrounding the slaying of Caylee Anthony.

In a motion filed Thursday, Anthony's defense said the state did not provide enough proof of the five listed aggravated factors in the case, which the state would use to pursue the death penalty if Anthony is found guilty of murder in her daughter's death.

The state submitted the list of aggravating factors last week. The defense's challenge will go before Judge Stan Strickland for a final ruling.

Casey’s Defense Wants State’s Reasons For Death Thrown Out

In the 4-page motion released Thursday, the defense said there should be evidence to support why the aggravating circumstances are there. They also argue the state has written that it may rely on these circumstances, but not that they exist.

Anthony's attorneys also said the list should be thrown out because it wasn't delivered to them before being released to the media. This was an order Perry gave to both parties.

On Thursday, the defense filed a motion claiming that those conditions are too vague and says the State did not list any facts backing up their case. Anthony's attorneys are also asking for more detailed evidence from a Tennessee forensics laboratory.

On Friday, more potential evidence is expected to be released. A spokesperson for the State Attorney's Office said up to 500 pages of documents are included, some of which will be lab results.

Casey Anthony case: Her defense team wants more details about why state seeks death
The legal reasons cited by prosecutors isn't good enough

4:42 p.m. EDT, May 20, 2010
<snipped>
Last week, prosecutors filed a one-page notice, stating five legal reasons, such as the victim was younger than 12 years old and the death was especially heinous, atrocious and cruel. That's not good enough for Anthony's attorneys.

"No facts were cited in support of those aggravating circumstances," defense attorney Jose Baez wrote in the request filed Thursday. And, Orange-Osceola Chief Judge Belvin Perry, Baez wrote, ordered the state to include the particulars.

"The state has failed to provide any indication of the evidence it intends to rely on to prove the existence of these aggravating factors," Baez wrote.

In other Anthony-related news: Her defense team is asking the judge to order the state to provide certain forensic evidence information, including details about labs that performed various tests on evidence.

Perry Schedules Next Hearing For June 1

POSTED: 11:34 am EDT May 20, 2010
UPDATED: 4:37 pm EDT May 21, 2010

Some of the pages dealt with what prosecutors are working to determine to prove their theory that duct tape on Caylee Anthony's mouth was indeed the murder weapon. In an e-mail between FBI analysts, they discuss why prosecutors are so interested in the length and width of the duct tape, as well as high-tech plans they have to show the tape used in Caylee's death.

In an e-mail dated in February 2009, an FBI analyst said, "They want to know if it would be possible for the tape as it was to cover both the mouth and nose areas." The e-mail continued and said prosecutors would need scale measurements of the tape "to do some computerized re-creation images of the skull with the tape." Also included in the documents was an inventory from the Suburban Drive crime scene that detailed how flags placed at the scene marked a myriad of body parts, including teeth and bones from the leg and ribs.

In newer documents released on Friday, prosecutors said they've submitted secret letters Anthony wrote to fellow inmate Robyn Adams to an FBI laboratory for analysis. Detectives also submitted notebooks containing her known writing samples for comparison. The prosecution wants to confirm the letters were written by her.

On Friday, Judge Belvin Perry also scheduled a hearing for June 1. The hearing will deal with two issues that include a defense motion to seal jail visitation logs and a motion to reconsider certain prior rulings by Judge Stan Strickland.

UPDATED: Casey Anthony case: More documents released by state today
An additional 500 pages of evidence related to the state's murder case against Casey Anthony released today.

9:50 a.m. EDT, May 21, 2010

The records include various inventory lists of DNA evidence and other material found at the site where the remains of Anthony's daughter, Caylee, were found.

Documents also include information on various lab technicians who examined items collected.

The Orlando Sentinel is in the process of reviewing the pages.

This is the latest in a handful of developments in the case this week. Her defense team filed paperwork earlier this week to get more details from prosecutors as to why the state is seeking the death penalty against the 24-year-old mother accused of killing her daughter.

Casey Anthony Charged With Murder In Death Of Daughter

POSTED: Friday, May 21, 2010
UPDATED: 12:07 pm EDT May 21, 2010

The documents show that the state sent the handwritten letters from Anthony to another inmate in the Orange County Jail to the FBI to be analyzed.

Every page and envelopes is included in the lab's inventory sheets. They are being compared to known samples of Anthony's handwriting, like a letter she wrote to Sheriff Kevin Beary a few months after her arrest.

The state also handed over information about the forensic experts who are conducting the tests, including how many times they have testified in court, in which cases and the outcome of those cases.

UPDATED: Hundreds Of New Casey Documents Released
Friday, May 21, 2010 10:47:13 PM
<snipped>
Exhaustive efforts were used after Caylee Anthony was reported missing. Now we're learning the same type of determination and attention to detail were used after her remains were found.

In the Case against Casey, the state is trying to show the evidence traces back to Anthony. In e-mail communications released, FBI technicians focus in on the trunk of Anthony's car. Investigators are also trying to link clothing found at the crime scene to Target, and then link that to Anthony. One of the theories prosecutors have leaked in court is that Caylee died because duct tape covered her mouth.

The case will be back in court on June 1. When Judge Stan Strickland took himself off the case, any motion he ruled on could be brought back up for review. June 1 is the defense’s day to try these motions again. The defense will explain why they say we shouldn't know who is coming to visit Anthony in jail and want the logs kept private.

Prosecutors in the murder trial of Casey Anthony have offered five factors in why they believe she deserves the death penalty. On Thursday, the defense filed a motion claiming that those conditions are too vague and says the State did not list any facts backing up their case. Anthony's attorneys are also asking for more detailed evidence from a Tennessee forensics laboratory. Tests from that lab concluded that air samples taken from inside Casey's car had indicated signs of decomposition.

More potential evidence was released Friday. FOX 35 Reporter Holly Bristow will have a full report today during FOX 35 News at 5 and 6PM.

UPDATED: 586 Pages Of Evidence Released In Casey Case
Posted: 9:50 am EDT May 21, 2010
Updated: 6:46 pm EDT May 21, 2010
<snipped>
Prosecutors in the case against Casey Anthony released 586 pages Friday morning that contain FBI evidence and emails. The documents also contain information about evidence found in the trunk of Casey’s car. With mountains of evidence stacking against Casey Anthony, her lawyers are now trying to discredit some of it. WFTV looked through the 586 pages of newly-released evidence Friday.

The defense could use some of the FBI communications exchanged behind the scenes during the investigation to try to expose problems with the work. But investigators are being up front about it, which could diffuse any defense arguments. Photos of some unspecified piece of evidence show a breach of the packaging. It's unclear whether the breach goes through and through, but the defense may try to get it thrown out or use it to create reasonable doubt.

“The defense will come back and say, 'Look jurors, the evidence was compromised regardless of what testimony you hear from the lab analysts,'” WFTV legal Analyst Bill Sheaffer said. Sheaffer says the defense might try to make the same argument through FBI communications it specifically requested, which show crucial evidence from Casey Anthony's car trunk, including soil samples, pieces of trunk liner and carpeting, passed through a number of hands before it was tested by the FBI.

The new documents also show prosecutors wanted the measurements of the three pieces of duct tape layered over Caylee's face to make a computerized rendering. The two-inch-wide pieces are 9.5, 9, and 7.5 inches long. The fact that investigators are so open about whatever happened could diffuse any defense arguments about conspiracy or cover-up.

WHAT'S NEXT IN THE CASE?
A hearing has been scheduled for June 1 concerning the defense team's fight to keep public records about Casey’s visitors at the jail private and its request for Judge Perry to review some previous rulings made by Judge Strickland before he recused himself over questions about his conversations with a blogger.

Casey Anthony: Stations highlight prosecution’s interest in duct tape, Caylee’s shirt

This afternoon, WESH’s Bob Kealing focused on FBI e-mails about three pieces of duct tape believed to be the murder weapon. The pieces of tape varied from 9 and a half inches long to 7 and a half inches long. “Prosecutors wanted to know the exact measurements so they could do a digital reconstruction of how that tape was applied,” Kealing said. “An e-mail between FBI lab analysts sheds new light on what prosecutors want to know about the duct tape and how they plan to show it was used to asphyxiate Caylee Anthony.”

WOFL-Channel 35’s Holly Bristow also focused on an FBI e-mail about the duct tape. Bristow said, “One expert writes to the other, ‘Prosecutors have been asking investigators for specific measurements on this duct tape they say was found around Caylee’s nose and mouth before it was taken apart by investigators. … They want to know if it would be possible for the tape if it was to cover both the mouth and nose areas.” Bristow added that the defense has told her that the tape did not cover the toddler’s mouth and nose and “they intend to prove that in court.”

Belich later focused on Caylee’s Big Trouble Comes in Little Packages shirt. It was “the last shirt Caylee ever wore,” WFTV anchor Bob Opsahl said. “Today’s new documents show the investigators believe Caylee was intentionally placed in this shirt because of what it said,” Belich said. Legal analyst Sheaffer speculated that Caylee was a pawn in “this power struggle, love-hate relationship” between Casey and her mother, Cindy.

New documents filed in Casey Anthony case
11:07 a.m. EDT, May 25, 2010
<snipped>
One item deals with a hearing scheduling conflict with Mark NeJame, the attorney representing Texas EquuSearch. Earlier, Orange-Osceola Chief Judge Belvin Perry set a hearing for June 1 to hear arguments on the defense's requests to seal jail-visitation logs and to have Perry reconsidered earlier rulings by the initial judge on the case.

One of those items to be discussed involves documents belonging to EquuSearch, the group that helped organize large volunteer searches for Casey Anthony's daughter Caylee, before the toddler's remains were found. NeJame stated that Casey Anthony's defense team scheduled the hearing without coordinating with him, and he had a pre-planned family holiday that day. NeJame stated his office is coordinating a new hearing date with Casey Anthony's defense, and that he was filing the conflict notice simply to assure his portion of the hearing be cancelled and rescheduled.

Also made public today is a filing from the Justice Administrative Commission, the state entity responsible for paying defense costs.

One item filed by prosecutors was in response to a defense request asking the judge to order the state to provide certain forensic information, including details about labs that performed tests on evidence. In his response, Assistant State Attorney Jeff Ashton said certain items requested by Casey Anthony's defense team are not in the possession of the state or any of its agencies. Ashton wrote that the state shouldn't be compelled to obtain additional information — known as discovery — that Casey Anthony's defense team can "easily" obtain on their own. Ashton provided the court with a chart detailing items requested by Casey Anthony's defense. He indicated which items are not discoverable under Florida statute.
