Death penalty still a question in Novack murders

The murder trial for the Fontainebleau heiress accused of killing her husband and mother-in-law will again be delayed as the U.S. Department of Justice considers wether Narcy Novack and her brother should face the death penalty.

Judge to Narcy Novack: You can’t use jewels to hire another lawyer

U.S. Judge Kenneth Kara said taxpayers are already paying for her defense after she claimed to be broke, according to a report on lohud.com.

“Let me use my wedding band to defend myself. My accusers are getting paid. Why [can’t I] use my own stuff to pay for a lawyer?” she said at the pre-trial hearing in White Plains, N.Y. “I need to use assets to defend myself. I need more than what I have.”

The judge’s response: “No.”

The next hearing is scheduled for March 9.

Sex, limbs and duct tape: the marriage of Ben and Narcy Novack

Hoping to establish multiple motives for the murder of Ben Novack, allegedly by his wife, the feds plan to give jurors a lurid portrait of their marital life.

If a court brief filed by federal prosecutors is even partly true, Ben and Narcy Novack had a profoundly dysfunctional marriage — and a life of sex, limbs and duct tape would have made a South Beach madam blush.

Narcy, who faces trial next month in her hotel tycoon husband’s slaying, told the FBI and others that her husband was a pedophile who would give artificial limbs free to amputees in return for sex; that he arranged sham marriages as part of an immigration scam involving his exotic dancer mistress, and that he encouraged his wife to duct-tape him and abuse him during sex.

The court papers released this week contend that Narcy reported some of the behavior to police, the FBI and family members in the years before Ben’s murder.

WHITE PLAINS, N.Y. (AP) — A federal judge ruled Friday that a Florida woman's "chatty" statements to police after the killing of her millionaire husband were voluntary and can be used as evidence at her murder trial.

Some of the statements by Narcy Novack, of Fort Lauderdale, will be admissible only if she takes the witness stand, the judge said.

WHITE PLAINS, NY -- The murder-for-hire scheme to kill Fontainebleau hotel heirs Ben and Bernice Novack involved a drug addict, a hot dog vendor, a bus driver and a scorned woman.

Together, prosecutors say they formed a cast of “monsters” who hatched a plot more savage than a slasher flick.

Narcy Novack, 56, and her brother, Cristobal Veliz, 58, appeared in federal court Monday, on the first day of testimony in the long-awaited, sensational trial in the murder-for-hire killing of Novack’s millionaire husband, Ben Novack, Jr. The brother and sister are charged with first-degree murder, racketeering and a litany of other felonies that could put them behind bars for life.
-------

But defense attorneys say Narcy Novack and Veliz were framed by Narcy Novack’s daughter, who hired the killers because she wanted Ben Novack’s fortune for herself.

WHITE PLAINS, N.Y. -- She called herself “Mona Love,” and she was a prostitute, tattoo artist, adult *advertiser censored* star, stripper and Ben Novack’s other woman.

Love, whose real name is Rebecca A.. Starr Bliss, testified Tuesday that Novack paid her $600 for sex after the two met on a website for johns and prostitutes. The Fort Lauderdale millionaire, who had a love of strippers and prostitutes, was immediately smitten.

He sent Bliss on a $4,000 spa escape, set her up in Fort Lauderdale condo and bought her a cell phone, $10,000 in furniture, $10,000 worth of music equipment and a little toy poodle.

Bliss promised to stop doing tricks, and Novack promised to divorce his wife.

Killer left behind a trail of missed clues in Bernice Novack’s murder

WHITE PLAINS, N.Y. -- Alejandro Garcia was promised $1,000 in cash to beat up an “old lady” and knock out her teeth.

Garcia then drank two bottles of rum for courage before attacking and killing 86-year-old Bernice Novack, a Miami Beach socialite who was once the grand dame of the most famous hotel in the world.

For the first time, Novack’s killer, a man who nearly got away with the perfect murder, detailed her final, terrifying moments.

In federal court Wednesday, Garcia, speaking through a Spanish interpreter, laid out a trail of missed clues that, had Fort Lauderdale police discovered them, may possibly have spared Novack’s son a similar fate some 12 weeks later.

Garcia, 34, is the star witness in the murder trial of Narcy Novack, 55, and her brother, Cristobal Veliz, 58, charged with orchestrating the plots to kill Bernice and Ben Novack Jr., heirs to the Fontainebleau hotel fortune. Prosecutors say Narcy Novack, wife of Ben Novack Jr, wanted to kill him and his mother to take control of his multi-million-dollar business and inherit their estimated $10 million estate.

WHITE PLAINS, N.Y. -- Narcy Novack could hear her husband’s screams as two men pounded him to death with dumbbells in his hotel bed, a federal jury was told Friday.

She placed her finger in front of her lips, signaling for them to be quiet, then tossed the men a pillow so they could muffle his cries.

Alejandro Garcia said he and his accomplice, Joel Gonzalez, pummeled Ben Novack in the chest, ribs and abdomen, then began whacking at his head with the weights to make him quiet. Novack fought back, knocking off Garcia’s sunglasses.

Novack’s stepdaughter becomes sideshow in circus

After the murders of Ben and Bernice Novack, authorities say only one other person stood in Narcy Novack’s path to inherit her husband’s riches.

Her own daughter.

In the weeks after Ben Novack’s murder, his widow’s daughter, May Abad, 36, successfully froze her stepfather’s assets in court. Suspecting that her mother was the killer, Abad managed to block her from being named executrix of Novack’s will.

Narcy Novack was so infuriated that, at one point, Abad alleged that her mother went after her with a crowbar in the driveway of the family’s Fort Lauderdale home, calling her daughter a “traitor.”

Judge issues gag order; denies mistrial request over Novack's media interviews

http://www.lohud.com/article/201205...interviews?odyssey=tab|topnews|text|Frontpage

WHITE PLAINS — Now, Narcy Novack has been gagged.

U.S. District Judge Kenneth Karas yesterday barred Novack from any further contact with the media during her trial after she questioned the innocence of her co-defendant and brother, Cristobal Veliz, in a televised interview.

“I take the First Amendment very seriously,” the judge told Novack after the jury was excused for the day. “But it cannot be a license to jeopardize your brother’s right to a fair trial or your right to a fair trial.”
------

On April 15, The Journal News carried a story in which reporters detailed Novack’s bizarre suggestion that her husband might be alive – claims she repeated in an interview with the cable station Monday – and questioning whether her mother-in-law’s death was a homicide. In the interview this week, she also raised concerns about evidence implicating her brother in the plot.

Within a month of her husband’s murder, Narcy Novack used proceeds from his final convention for a criminal defense lawyer and to make payments, through her sister-in-law, to her brother and co-defendant Cristobal Veliz. Prosecutors contend Veliz used that money to pay off the killers and other associates.

A once-mysterious letter surfaces in Narcy Novack trial; brother takes stand

..........Unsigned, and written in Spanish, the letter asserted that both Ben Jr. and his mother, Bernice Novack, had been murdered as part of a plot by his wife to get his millions.

On Monday, the author of that anonymous letter was revealed, proving that blood is not always thicker than water.

One of Narcy Novack’s sisters, Letitia Toruno, wrote the letter. It described how Narcy Novack and her brother, Cristobal Veliz, were the “assassins” who arranged the killings...........

On Monday, Veliz took the witness stand in his own defense and, for more than three hours, denied every piece of evidence that prosecutors said linked him to the killings...........

Veliz testified that his Nissan Pathfinder had been stolen after Ben Novack was murdered, that his cellphone and debit card were always in his vehicle, implying that someone else used his truck, phone and card to commit the crimes.
