Judge will hear final arguments on motions in Casey Anthony hearing today

Chief Judge Belvin Perry has yet to rule on some of the crucial motions at issue in the Casey Anthony case.

He will hold a hearing for final arguments on the most important motions at 2 p.m. today. Those motions involve excluding statements she gave to law enforcement and her family members early on in the case.

The three days of hearings last week captured most of the attention in the Casey Anthony murder case, but hundreds of pages of witness statements filed Thursday offer fresh details of how the woman's defense may develop at trial.

The hearing is scheduled for 2:00pm Monday and the motions will focus on statements Casey made to detectives and her family.

The defense is arguing that her family was working with police when those statements were made. They say her parents and brother were basically acting as agents for the state and that they were trying to get information from Casey to give to investigators.

WFTV's legal analyst Bill Sheaffer said her family would have to agree to work with investigators for that argument to work.

Casey's family admitted they certainly did not agree to that.

Casey's attorneys argued that she was in custody, even in handcuffs at one point, during the initial part of the investigation when her statements were recorded and she was not read her rights.

Once arguments wrap, it will be up to the judge to decide if Casey's statements will be allowed.

Attorneys to argue over Casey Anthony statements in court today

Sims' motion goes as far to suggest that the prosecution withdraw Dr. David Hall, the botanist, as a witness before that hearing is scheduled.

"It is the hope…after re-reading Dr. Hall's deposition the state would consider withdrawing him as an expert and thus remove the need for a hearing as [to] whether his testimony is admissible," Sims wrote.

Casey Anthony's defense team believes anything Casey told deputies after initially being placed in handcuffs the evening of July 15 should be suppressed from her trial because she was not read her rights.

Anthony was only briefly handcuffed that day, and was not arrested until the following day July 16.


If the judge decides to keep Anthony's statements to investigators, out of evidence because of Sheriff's Office misconduct, the state will likely have to drop four counts against her related to lying to deputies, or it could appeal the decision and further delay the trial.

Prosecutor Burdick, emphasized that law enforcement's initial involvement was "to help Casey and her family find her daughter. That's what they were there for.


Burdick, also noted that they were summoned to the home and it would be a reasonable assumption that deputies would be asking questions of the family members. She also noted that Zenaida Gonzalez was listed as the suspect because she was the individual who they thought was the suspect at the time, not Casey Anthony.

Burdick, spoke about Casey Anthony being handcuffed for five minutes and then un-handcuffed that morning.

This amounted to a "temporary detention" and "not an arrest" after Cindy Anthony complained about credit card fraud.

Mason said, Casey was never informed that she had the right to leave or terminate questioning. That they failed to inform Casey of her Miranda rights. Mason says detectives didn't want Casey Anthony to tell them, "I want a lawyer."

Burdick says LE did not manipulate the Anthonys into doing anything they did not already want to do independently. And she says the Anthonys acknowledged last week it was not their intent to help build a case against Casey Anthony.

Mason said earlier that investigators "directed family over and over to do what they could not." In doing this -- and capturing Casey Anthony in recordings and video -- they circumvented her defense attorney Baez.

Judge Perry did not rule on the admissibility of evidence regarding chloroform and plant life at the crime scene where the remains of Casey's 2-year-old daughter, Caylee, were found in December 2008.

The stations supplied details about what unfolded in the court. Kealing observed that Anthony squeezed Mason’s shoulder. “That seemed to take him by surprise. He didn’t realize she was coming in,” Kealing said. “At the end of today’s hearing, Casey did not appear to acknowledge her parents, who were in the courtroom all afternoon. Judge Perry says it will likely be toward the end of next week before he makes a ruling.”

Kealing later added more detail: “We saw George Anthony in the audience shaking his head with disgust from time to time [at] the state’s statements and arguments he didn’t agree with.”

On WOFL-Channel 35, Keith Landry also highlighted that Perry’s rulings will be coming next week. Landry described the atmosphere as “spirited” and noted that Anthony wore a lavender turtleneck with her hair pulled back.
