Following a welfare check on the woman, the Tombstone Marshal's Office said Fattig was arrested after law enforcement debunked his story that his mother was hospitalized in Tucson. Fattig eventually told sheriff's deputies his mother had died about a year ago.

Fattig is an author and historian who wrote a biography of Wyatt Earp.

At first I was thinking he was cashing her SS checks, but from the additional link we can see that it was the bank that was concerned because there had been social security payments accumulating in her bank account - no charges have been laid against him.

@Newone - I just assumed there were charges due to the arrest.

In your link I saw the following:
"We can't conclude at this point that no crime was committed. We just simply have no evidence to show a crime was committed," Rheinheimer said. He emphasized that if there is no evidence to indicate a homicide, he may consider pursuing the misdemeanor charge of failure to report a death, punishable by four months in jail and a $750 fine.

I guess this rests on the autopsy report.
 
UdbCrzy 2 - this is an ''odd'' news story to follow for sure - seems that the authorities are content that the mother's demise was not 'homicide' (interesting for sure)

An autopsy completed on Monday showed no evidence of homicide, Cochise County Attorney Ed Rheinheimer said. Because of that, there was no evidence that would support felony charges


He definitely had been charged and was held in jail until autopsy was completed which ruled out homicide.

So legally if someone dies you can just keep them?

How sad is it that so many people have nobody looking for them or after them? It seems this woman had her son. That was it. Perhaps psychologically he didn't want to bury her or cremate her?
 
Fattig, who wrote a book about Wyatt Earp, told cops that he was so distraught by his mother's death that he never reported it, Cloud said. He reportedly had been telling friends for months that his mother was in the hospital.

Fattig's Facebook's page says he works for Desert Scream Productions, an independent film-producing company that bills itself as "Arizona's home for horror!"

This is a very strange case indeed. Maybe they will just fine him or something?

Appears to be a group of artistic young people. No real weirdness IMO. I have a nephew into that horror stuff. I'm not down with it, but it's seemingly harmless. In my nephews case he'll call my mom and tell her what horrendous film Elvira is having on. We're not harboring any deceased folks though.

It's very sad this case.
 
Sounds like the mother died a natural death and he never reported it. Peculiar to say the least.
 
The media hasn't reported anything about the autopsy report yet. Do you think they would just leave everyone hanging? LOL

There's a really long and (IMO) bizarre statement here that Fattig made to the media after the charges were dropped. After reading it, I can imagine him being the kind of guy whose thought process is a little unusual, which could lead him to decide not to call LE even if his mother died of natural causes.

For the past week there has been a great deal of speculation regarding the events that led up to my arrest and incarceration.
It is a pointless task to try to run down every rumor and correct every falsehood, whether printed, broadcast, or circulated through the Internet, and I have no interest in going down that path: while I have been approached by media outside Tombstone and outside Arizona, for a statement on this case, I have no interest in talking to those outlets. If I have any concern for public opinion, it is the opinion of my friends and colleagues right here in Tombstone, and it is to those people, the people who matter most to me, that I address my statement...

I didn't find it bizarre. I thought it was touching and thoughtful. I don't know anything else about the case so maybe it's bizarre after the fact?

While it is my responsibility to account for my actions and atone with those who matter most to me, the support I have received makes it easier to get through these difficult days.
