GUILTY MA - Dario Finkel for abusing 7 wk old son, Salem, 2011

26-year-old Dario Finkel originally of Marblehead, now of Salem, was arraigned in Salem District court on Wednesday.

Jennifer Finkel, the child's mother, told police that Dario stuffed a baby wipe into seven-week-old Michael Finkel's mouth when the child would not stop crying.

"This defendant, Mr, Finkel became very upset, very angry as he does generally when the child begins to cry," said Michelle DeCourcey.

Jennifer told investigators that Dario then became violent.

"The baby was on the couch at that point, and the defendant they picked him up, held him in front of him three feet above the floor, and then dropped him in an attempt to stop him from crying," said DeCourcy.

Twice more according to court documents, Dario threw the baby at least four feet but both times Jennifer caught the child. Poor Poor child. All I can say in this case is that I'm pleased the mother did the right thing for her child. She wrote a letter to the perp saying " I'm done its over, you have hit me and (baby) for the last time". I often wonder what is missing from the mothers who do not respond this way. the first time someone laid a hand on one of my children would be the last time! kudos to this mom for standing up for her baby boy and getting herself and baby out of there.

Police said that between 7:30 and 8 p.m. Finkel was in his apartment when his son started crying. Police said Finkel became angry when the baby started crying and told him to "shut up." After a few minutes, police said Finkel walked over to the baby and stuffed a baby wipe into his mouth in an attempt to quiet him.

August 2011:

A Salem father was sentenced to state prison yesterday after pleading guilty to stuffing a baby wipe into the mouth of his crying 71/2-week-old son, then throwing the child on the floor and then at his mother in April...

sentenced to two to 21/2 years in state prison...


For the first time yesterday, MacDougall also revealed that Finkel had threatened to throw his son out a window that night as well...

She went on to say that the baby is now thriving in the custody of a maternal aunt...

Griffin argued, the Department of Children and Families wants to be able to reunite Finkel with his son and wife after he takes some parenting classes.

"DCF believes that with some counseling, Mr. Finkel can become a good father," he said.

When his wife told him she was 12 weeks pregnant last summer, Dario Finkel did not take the news well, court papers say, throwing his barefoot and pajama-clad wife out of their Marblehead apartment and refusing to let her back until she either had an abortion or a miscarriage...

But after their son was born, Finkel was just as upset, allegedly admitting to investigators that he had shaken the baby at least three times in the past and once put his hand over the baby's face to get him to stop crying, all before last week's alleged assault on the 7-week-old infant..


I'm detaining him," Salem District Court Judge Michael Lauranzano said yesterday, granting a request by prosecutor Kate MacDougall.

Finkel burst into tears at the judge's words, sobbing as he was led out of the courtroom
