Hours after three brothers were seen playing with a gun outside their home, a 13-year-old Cobb County boy was dead Thursday night. A 16-year-old older brother is accused in death. But Friday afternoon, he was still on the loose. When he's found, the teen is expected to be charged as an adult and face felony murder and aggravated assault charges.

Oscar Mondragon was often in trouble for having drugs or fighting, and bragged of having weapons, Sherly Parada, 15, told the AJC. Parada said Oscar, Javier and a younger brother were all playing with a gun outside earlier Thursday, hours before Javier was killed. A neighbor told the AJC she also saw the boys playing with guns, but assumed they were toys.

I understand the 16 year old has known problem with drugs and fighting, but I have to wonder how the officials have determined this was a deliberate action and not the result of the brothers "playing" with guns....

UPDATE: A 16-year-old accused of killing his 13-year-old brother was taken into custody without incident by U.S. Marshals on Friday evening after being found hiding in a trailer. He has been charged as an adult with felony murder and aggravated assault & is being held in the Marietta Youth Detention Center. "Police have not yet determined what led to the shooting and whether or not it was accidental" Sgt. Dana Pierce with Cobb County police said.

I agree, kgeaux.... why charges before all the facts are known ?
