ORLANDO, Fla. -- No testimony was given in the trial Saturday because of a still-undisclosed legal issue.

Jeff Ashton again accused the defense of a discovery violation, saying that a defense expert, Dr. Kenneth Furton, did additional research since his deposition.

Ashton said the defense had new presentation material that the prosecution had not seen before.


"You think this would've grown old by now, but I guess some things never change," Perry said.

Perry said he would review Furton's report and his deposition.

After the argument, the defense and Anthony left the courtroom with Perry.

Casey Anthony's first-degree murder trial will resume this morning - two days after Chief Judge Belvin Perry called an abrupt, early recess in the proceedings without detailing why.

Even though Saturday was supposed to be an extended workday, the lawyers in the case met outside the courtroom and discussed matters that are sealed.

Casey Murder Trial To Resume After Abrupt Recess

Casey Anthony’s murder trial continues to day 40 on Monday, after court was abruptly recessed 45 minutes after it was supposed to start.

The defense is expected to wrap up presenting its witnesses in just a few days. But it is still unclear what legal matter forced Judge Perry to recess court on Saturday.

The motion asked that a new jury be seated in the case that is not death penalty qualified.

Judge Belvin Perry announced Monday morning that Casey Anthony's defense filed a motion Saturday claiming Anthony was not competent to continue the trial.

Perry said after the motion was filed, he ordered Anthony to be examined by three independent experts.

The psychologists examined Anthony over the weekend to determine if she was competent to continue with the trial, Perry said.

The letters Casey Anthony penned in jail show an immature woman who needs attention and adoration from others.

That's what three psychologists gleaned from reviewing dozens of Anthony's hand-written notes and letters to a fellow inmate at the Orange County Jail. The doctors agreed to read and give insight from the letters at the request of the Orlando Sentinel.

"She is spending most of her time in isolation with no audience. She has no outlet for the stuff that goes through her mind," said Dr. Daniel Tressler, a forensic psychologist based in Altamonte Springs.

Judge OKs Funding For Unused Expert Witness

Taxpayers will foot a bill for more than $6,000 for a Casey Anthony defense expert who likely won't even testify during Anthony's first-degree.

Jose Baez filed a motion Monday asking for reimbursement in the amount of $6,850.

The amount was invoiced by psychologist Dr. William Weitz, who has since been removed from the witness list for the guilt phase of the trial.
Perry granted the motion Monday.

ORLANDO, Fla. -- While Monday marked Casey Anthony defense attorney Ann Finnell's first appearance in the courtroom since the trial began, jail records show she hasn't been a stranger to Anthony.

Finnell a death penalty-qualified attorney from Jacksonville, was not expected to appear at the trial unless Anthony is found guilty and a penalty phase becomes necessary.


On June 12, Finnell spent about five hours with Anthony, jail records show.

ORANGE COUNTY, Fla. -- Judge Belvin Perry ruled that Casey Anthony is mentally competent to proceed in her murder trial on Monday. On Saturday, the defense filed a motion that Casey be examined by three psychologist to determine her competency to proceed in her trial.

WFTV legal analyst Bill Sheaffer said the defense could be trying to prevent Casey from testifying.


"It may well be that Casey Anthony believes that she should take the witness stand against her lawyers' advice," Sheaffer said.


Sheaffer says it wouldn't stop Casey from testifying if she insists on it, and that decision is hers and hers alone. But it would protect the defense later, if things go bad and she tries to blame her attorneys for putting her on the stand.
