Casey Anthony's murder trial is set to resume on day 35 after the judge called for an abrupt recess.

ORANGE COUNTY, Fla. -- Casey Anthony's murder trial continues on day 35, and both the state and the defense will return to court by 8:30 a.m.

The earlier start time is the result of a showdown on Monday that led to Chief Judge Belvin Perry recessing the court after only two hours with no witness testimony, as well as threatening sanctions against the attorneys.

It appeared the defense had no witnesses ready for the stand and the state complained that for a third time in as many days, Casey's lead attorney Jose Baez tried to sneak in expert opinions he hadn't previously disclosed.

“I will be preparing a sanctions package for the court. I believe this is another deliberate violation of the court's order,” said prosecutor Jeff Ashton.

Casey Anthony's defense team should resume calling witnesses this morning — one day after Judge Perry gave stern warnings to the attorneys in the first-degree murder case and abruptly adjourned court before lunchtime.

The proceedings, unfolded without the jury's presence, centered on allegations that defense attorney Jose Baez violated court procedure by failing to fully disclose the opinions that his experts would testify about to the state.

Prosecutor Jeff Ashton said he was late in getting a report, opinions and other materials from Richard Eikelenboom, a Dutch forensic expert who specializes in "Touch DNA" involving small amounts of the genetic material.

Judge Perry decided not to allow another defense expert to testify about the possibility of getting DNA from the decomposition fluid. However, the DNA expert was allowed to testify about other topics, but not before Judge Perry read a statement to the jury after Casey's defense team broke the rules.

Judge Perry called out Jose Baez for what he called a willful violation of discovery rules that were put in place by Judge Perry.

Dr. Jane Bock, a botanist told jurors on Tuesday that she believed the roots could have grown through the bones, skull and a laundry bag in two weeks.

Botanist Discusses Caylee Remains At Anthony Trial

ORLANDO, Fla. -- Day 24 began with attorneys from both sides arguing whether a defense witness would be able to testify about DNA in the case.

Judge Perry said, he would be willing to hold a hearing later and revisit the issue.

The defense, called Jennifer Welch, questioned by defense attorney Sims.


The defense called Dr. Jane Bock, a forensic botanist.

"I have looked at photographs taken by the medical examiner and the Sheriff's Office crime scene investigators and visited the recovery area and read documents about the case," Bock said.

Bock told jurors that she believed the roots could have grown through the bones, skull and a laundry bag in two weeks. Prosecutors have said Caylee's remains had been in the woods near the Anthony family home since the summer of 2008.

While pointing to a photograph in front of the jury, Ashton asked Bock if she measured the amount of "leaf litter" in a certain area.

"No. Did anyone else?" Bock said.

"The neat thing about this is that you don't get to ask me any questions," Ashton joked.

Ashton pointed out that Bock said in her deposition that she couldn't say when Caylee's remains were placed in the woods. Bock then admitted that it's possible that Caylee's remains were in the woods for more than two weeks.

Ashton also said that Caylee's hip bone was found buried in 4 inches of muck, implying that Caylee's skull was likely in the woods for longer than two weeks. Bock suggested a dog or another animal could have buried the hip bone.

The defense then called DNA expert Dr. Richard Eikelenboom.

Ashton said Eikelenboom originally only submitted a half-page summary of his findings that contained no significant opinion, but now wants to present two written pages and 45 PowerPoint slides to jurors, which Ashton says is a clear violation of Perry's court order for all expert witnesses to submit detailed reports.


Perry decided that by not informing Eikelenboom that he needed to report his findings with a complete statement of opinions for the state, the defense's discovery violation was willful.


Perry informed the jury that Eikelenboom had stipulations for what topics he could testify about.

After sending the jury to lunch, Baez said he was just handed computer evidence from the state, which he thought violated the discovery order.

The state said it gave all the information from the Anthony family computer to Baez two years ago. Baez argued there was too much information and he did not know what to focus on.

Jane Bock, said she believed the root growth found in the "hair mass" and the skeleton could have accumulated in two weeks. But during cross-examination by prosecutor Ashton, she seemed less sure about the skeleton, saying she had only studied root growth on skeletons that had been in place for years.

Bock also told jurors on that fragments found on and in Casey Anthony's car did not match the vegetation seen at the scene where the remains were found.

"Bits of leaves, for the most part" were found in and on Anthony's Pontiac Sunfire, Bock testified, "especially from a camphor tree." Bock said that when she visited the place where Caylee's skeletal remains were discovered, she did not see a camphor tree at the site.

Meanwhile, wrangling between the prosecution and the defense continued before jurors were brought in Tuesday.

Jennifer WelchAttorney Dorothy Clay Sims took over questioning for the defense Tuesday morning, calling OC crime scene investigator Jennifer Welch back to the witness stand for a second defense testimony, and her fifth overall.

Bock said by examining "leaf litter" -- in the area, she believes Caylee's remains could have been placed there are recently as two weeks before they were found. But she later admitted to prosecutor Jeff Ashton that they could have been there longer.
Richard Eikelenboom Eikelenboom did not prepare a report of his findings, Judge Perry said the witness could not testify about his DNA analysis of decomposition fluids from the trunk of Anthony's Pontiac Sunfire.

Despite an objection from the state, the judge did accept Eikelenboom as an expert on DNA analysis.

Yuri Melich The defense called the lead detective in Caylee Anthony's disappearance to testify about his searches of her grandparents' home. It's the third time Detective Melich was called in the trial. He testified twice for the state.

Baez asked if Melich found any physical evidence of chloroform in the Anthonys' home, including chemistry kits, rags or containers.

Yuri Melich said no to each, turning to the jury every time. He did, however, acknowledge that during his first search of the home, in August 2008, he was not looking for chloroform. At that time, Caylee was believed to still be alive.

Did Casey Anthony cross paths with inmate whose son drowned?
Orange County Jail officials say April Whalen was housed in the same section of the jail as Casey Anthony for five days in 2009. Whalen had a son who drowned in a swimming pool.


Also among the state's new findings was information on hard drive activity from the Anthonys' computer on the morning of June 16, 2008.

ORLANDO -- Tuesday, prosecutors revealed they are investigating whether Casey Anthony ever had contact with another inmate whose son drowned in a swimming pool.

Defense attorney Jose Baez told a similar story in his opening statement, saying Casey's daughter, Caylee, drowned in her grandparents' swimming pool on June 16, 2008.

Prosecutors said Whalen did have a son who drowned. The boy's grandfather reportedly found him in the pool and called 911 immediately.

A prosecutor in the Casey Anthony murder case revealed a surprising detail to Chief Judge Belvin Perry while jurors took a lunch break today.

Assistant State Attorney Linda Drane Burdick said an investigation was launched after authorities learned a woman who was booked into the Orange County Jail in 2009 had a child who had accidentally drowned in the family's back yard pool and was found by his grandfather.

Whalen could become a relevant issue before the end of the case, Burdick told Perry.

Wise takes the stand
The latest witness called by the defense, analytical chemistry expert Dr. Marcus Wise, testified about testing done on items found the trunk of Anthony's car.

Defense to depose Vasco Thompson
In a late filing Tuesday afternoon, the defense announced its plans to depose surprise witness Vasco Thompson on Wednesday.

Thompson's attorney, Matt T. Morgan, has filed a motion to quash that subpoena, saying that Thompson "has no personal knowledge of facts relating to the alleged killing of Caylee Marie Anthony."


Judge Perry slams Baez
Earlier today, Perry has found that Casey Anthony's lead attorney made substantial and willful evidence-sharing violations related to one of the experts who is testifying today in the murder case.

An angry Perry said he was concerned about a trend of his orders being "continuously" violated. He also said he would handle Baez' potential discovery violation following the proceedings.Perry appeared on the verge of excluding the defense witnesses from testifying, but held back out of concern it would unfairly punish Anthony.

Judges also expressed concerns


Since taking on Casey Anthony's defense, Jose Baez has been targeted by several Florida Bar inquiries:

In September 2009, the Bar cleared Baez of an ethical complaint accusing him of getting paid inappropriately in the case.
In September 2009, the Bar cleared Baez of ethics allegations made by private investigator Dominic Casey, who claimed he was never paid by Baez. He also said the attorney told him to walk away from Caylee's remains if he ever found them and contact Baez. Both complaints were dismissed based on insufficient evidence
