DIRECT EXAMINATION OF SERGEANT DENNIS MOONSAMMY

He is employed at Orange County Corrections. He is the supervisor at the Women's Detention Center where ICA has been since 10/14/08.

Is she under an certain special status there?

ICA is in protective custody. One of the main requirements, because she is a high profile inmate, she is not in general population. That requires her to be in her cell for 23 hours a day. The 1 hour she is allowed to take a shower, go to the rec yard, go to the TV room or get a book from the portable library. She has been in protective custody for the past 2.5 years.

She is a model inmate. As part of his job, he goes to the unit every day and does a supervisor tour and speaks to every inmate. He has to engage them and get a response which is recorded on an OP-8. Every time he has spoken to her, she is very pleasant and always smiles. She never gives them any problem.

Does her behavior seem unusual to you? His job is care, custody and control. That is what he does. He pays little or no attention to the inmate's behavior except if they break really badly or become uncontrollable. Her behavior to him is the same as almost all the inmates in that area.

Has he spoken to her outside of the area of time he is supposed to? She has engaged him in conversation, yes. She is always pleasant and happy - despite her current situation.

Has this behavior been constant? From the day of her initial incarceration until the last day he worked (Sunday) her behavior has never changed. She is never up or down - constant - she always smiles and is pleasant.

No questions by the State.
