How on earth could we have missed a psychologist??? A four year long investigation? How many children were victimized during that investigative process? That concerns me. However, I love the penalty of a fine paid to the NCMEC. I have to wonder if this doctor knew Dr. William Ayres of San Mateo County. We have a long thread on Ayres.

"A Marin psychologist convicted of possessing child *advertiser censored* was sentenced in federal court to eight years in prison and ordered to pay $50,000 to the National Center for Missing and Exploited Children. Donald Tosti, 76, who surfaced as a *advertiser censored* suspect after taking his computer to CompUSA for repair, was convicted on two charges of possessing child *advertiser censored* after a search of his San Rafael home and office produced a "large collection" of child *advertiser censored*, including depictions of the rape of very young children, according to U.S. Attorney Melinda Haag. Haag issued a statement describing Tosti as a psychologist who founded the Independent Learning Schools...."

Eight years? Really. That's all?
 
Why do they keep prosecuting these men for only 1 or 2 counts when they possess hundreds or thousands of pictures? I have seen prosecutions of 1 count for each picture, which means it can be done. Stop giving these pervs a break!
 
Sorry but I made a mistake in titling this thread. The man's name is Donald Tosti--not David. I've asked a mod to fix it.
 
ITA, Belinda. The authorities spent almost as much time investigating this horrid case as the guy will actually serve in prison. And such violent images? Why only 8 years?

SAN FRANCISCO—Donald Tosti was sentenced Feb. 2, 2012, to eight years in prison and ordered to pay $50,000 in restitution for possessing child *advertiser censored*, United States Attorney Melinda Haag announced.

Tosti was convicted on Sept. 14, 2011, on two charges of possessing child *advertiser censored*. During the trial, evidence showed that Tosti was found to possess child *advertiser censored* after taking his computer to CompUSA for repair. A search of Tosti’s home and office revealed a large collection of child *advertiser censored*, including depictions of the rape of very young children. In sentencing Tosti, United States District Court Judge Jeffrey S. White emphasized the size of his collection and the graphic and extreme nature of the child *advertiser censored* images as aggravating factors in imposing his sentence.

Tosti, 76, of San Rafael, Calif., was indicted by a federal grand jury on Oct. 6, 2009, with one count of possession of child *advertiser censored*. A second charge was added by the grand jury on Nov. 24, 2010, based on additional child *advertiser censored* found after Tosti’s arrest.

The sentence was handed down by Judge White following a bench trial on two counts in violation of Title 18, United States Code, section 2252(a)(4)(B). Judge White also sentenced the defendant to a five-year period of supervised release and ordered him to pay $50,000 in restitution to the National Center for Missing and Exploited Children. The defendant is scheduled to begin serving the sentence on April 2, 2011.

Owen Martikan is the Assistant U.S. Attorney who prosecuted the case with the assistance of Rosario Calderon. The prosecution is the result of a four-year investigation by the Federal Bureau of Investigation, with the assistance of the San Rafael Police Department.

I just don't understand why so many states seem to bend over backwards to lessen the sentence for child pornographers and often, even child sex abusers. It makes me honestly wonder how many predators we have on the bench. I can't help but wonder. So many of these sentences make no sense and are nothing more than a slap on the wrist. It's terribly disheartening.
 
Well, at least he wasn't seeing child patients. That's a relief.
 
I guess Tosti has some time to prepare for prison--to get his affairs together, and all. How gracious of the court.

He could flee too, if he so desired.

He will begin serving his sentence in April, according to the PR above.

ITA, there are likely victims around somewhere. I was just grateful for the small miracle that he didn't have hundreds of child patients.
 
As Ayres allegedly raped some of his victims, and is only a few years older than Tosti, I have no doubt they know each other. Thanks for posting this.
