The wife of a Pinal County man who went missing more than one year ago will testify in court on Sept. 11 after she filed a petition for her husband to be pronounced legally dead...

On July 25, 2014, Rhonda Smith filed a petition to have the court pronounce her husband legally dead ahead of the normal five-year limit so she can have closure, according to Asimou.

Sheriff's detectives are expected to testify at the hearing regarding their efforts and whether they think Thomas Smith is still alive, Asimou said.

Disappeared in Arizona: What to know about the database for the missing

If a person has been absent for five consecutive years and not heard from, after diligent search or inquiry, the person can be declared dead.

Tom Asimou, a Phoenix attorney, has increasingly taken an interest in missing persons cases. He successfully argued for the death declaration in the case of Thomas Keith Smith, who walked out on his wife after a heated 2013 argument over "communication issues."

He never came home. While it was believed he was dead, his body was never found.
Since then, Asimou has taken a handful of other case, some that don't fit neatly into a case file or clear-cut mold.
