Former Senior High teacher gets 30 days for rape of student

A Yellowstone County district judge Monday ordered a former Senior High teacher convicted of raping a 14-year-old female student who later committed suicide to spend 30 days in jail.

Judge G. Todd Baugh sentenced Stacey Dean Rambold to 15 years in prison, with all but 31 days suspended, for sexual intercourse without consent.

Rambold, 54, will be given credit for one day already served. He was handcuffed and led to jail at the close of the hearing.

The judge's sentence was not received well by the girl's mother, who repeatedly screamed "You people suck!" and stormed out of the courtroom.


Too lenient! The rapist should be executed. :stormingmad:

The Judge said that Cherice was just as much in control of the situation as the grown *** creeper who was also in a place of authority for Lord's sake. "The girl was chronoligically older than her age" the Judge said.

The child is dead.

My head is going to explode and cause a fire.

The one question i have for the prosecution is if it was bad enough for 20 years as they asked, why in the world did they offer him a deferred prosecution at first with no jail time
With the teen's death, the prosecution entered into what is known as a "deferred prosecution agreement" with Rambold.

This meant that all charges against Rambold would be dismissed if he completed a sex offender treatment program and met other requirements. One of them was to have no contact with children.

That does put the judge in a bit of a bind and I think makes a mockery of the plea bargain process. His comments were disgusting but if i were the judge I don't think I could give him a whole lot of time based on the prosecutions whole case from deferred prosecution on. 5 years probably. Not to lessen what he did but because the DA badly fumbled the ball, there is something innately unfair about going from zero prison time to 20 years..

ETA in no way am I suggesting I agree with the judge. I just can see it being significantly less than the state asked for given their first offer. And that imo is the states fault. But 30 days is a joke
 
Disturbing. It reminds me of the case in England which I posted about a week back where a 13 year old girl who had been sexually abused was described by both the prosecutor and the judge as "predatory."

Children are increasingly being treated like mini adults in the courts now, and its not healthy IMO. It started with the drive to try younger and younger juveniles as adults and hand them adult sized sentences, and is now beginning to spread to child victims. After all, if they can be judged as mature enough to have an adult sized understanding of the difference between right and wrong, they can be seen as mature enough to be an equal partner in a sexual relationship with an adult.

And before anybody yells at me for that last sentence, that's not my attitude at all. I'm just describing the thinking behind comments like these from judges. For an example of a case where a child has been judged to be BOTH capable of making adult decisions about sex, and be criminally responsible, look at the thread further down this page where a ten year old child is charge with aggravated sexual assault for playing doctor.
 
The judge concedes that he made a poor choice of words, right...as if that makes a bit of difference.

Essentially he agreed that the RAPIST had suffered enough and that he (the judge) couldnt see a correlation between the rape and her suicide.

Really? It is a coincidence that a rape victim committed suicide? Granted I dont have access to the information he (the judge had) but I can make that connection from this 30K foot level.

Please tell me that the RAPIST who violated the terms of his plea deal has to at least register for life as a sex offender. The judge may have chosen to suspend the guy's sentence, but never the less he sentenced him and judged him to be a sex offender.
 
Silky, your points are good ones. But, how more mature than her chronological age do you suppose this child was to be a willing partner for a teacher of this age?

There must be something I am missing.
 
I have another case I have been following where a civil superior court judge denied a request for a third party audit and a removal of conservators because even though the present co conservators clearly and deliberately violated the terms of their appointment, they didnt violate it "enough." Sure, there was over 10 thousand dollars mis appropriated, but he felt it just wasnt that bad.

I try not to be black and white, but really who is the victim here? The victim or the rapist?
 
Well, I think the two issues need to be separated, and Rambold should be sentenced exclusively on his own actions - that is, statutory rape of a student.

That should certainly result in a longer sentence than he received. Men who are simply in possession of pornographic images get longer sentences than that - much more.

But I don't think a teen's suicide 3 years later, due to depression/public humiliation, embarrassment, etc. should factor in to the case. It's impossible to come up with a clear "cause" for suicide in most cases - it's a huge mixture of things. It's likely that a depressed mental state was what led her to seek a sexual relationship with a teacher in the first place. The sexual abuse and suicide aren't cause and affect - they're all parts of the same sad story.

The judge really is way, way off-base in his comments, and the sentence is outrageous. But I don't think people can be held criminally responsible for how the public treats someone.
 
This judge is up for re-election! I would love to thwart his re-election.

The sentence is absolutely ridiculous! This rapist had a prior for inappropriate contact with a minor. Need to look for link. He will offend again and we will all be shaking our heads wondering how in the hello he was ever out of jail in the first place. :furious:

No wonder the teen thought there was no way out. With this prosecutor and judge, she didn't stand a chance. Unreal.

OH i think the judges reasoning is abysmal, its sickening. I am just making a point about how the prosecution also treated the case as a minor matter with no jail time originally and only asked for 20 years once they found out he had seen some neices and nephews. That actually in a way gave the judge an understandable reason for doing a low ball sentence but not 30 days. He didn't use the one reason he had that most people could wrap their minds about or blame the prosecutors for. Instead the sick blamed the victim.

There is no chronological or emotional age where the victim is a willing partner in a teacher vs student sexual encounter imo

Well, there's the case where a woman convicted of her 13th DUI got a plea bargain that kept her out of jail. The same judge presided over it and allegedly warned her that if she drives drunk again (a 14th time?) and kills someone, she "will spend some real time in prison."

It's best that the judge just give up on that whole re election thing. :banghead:
