NEW forensic evidence led to Major Crime detectives charging a former schoolteacher in the Louise Bell murder case.

The evidence forms the backbone of the case against former schoolteacher Dieter Pfennig, 65, who was today charged with the murder of the 10-year-old schoolgirl.

In a sensational development in the 30-year old mystery, detectives from the Major Crime Investigation Section descended on Port Lincoln.

I'm so relieved the family can finally get some justice. I hate that the killer was able to live his life so happily for so long, though. And the excessive cruelty he showed her poor parents with the teasing after her murder! What a monster.
 
MAJOR Crime detectives investigating the murder of schoolgirl Louise Bell waited more than a year for a crucial legal opinion in the case from the Office of the Director of Public Prosecutions.

The Advertiser can reveal that detectives sought an opinion on whether they had enough evidence to charge their only suspect in the case – former schoolteacher Dieter Pfennig, 65 – in late 2012.

However, the ODPP legal opinion – that there was enough evidence against Pfennig, 65, to ensure a reasonable prospect of a conviction – was not provided until a fortnight ago.

The Louise Bell historic murder trial has resumed in South Australia with "one of the founding fathers of DNA internationally" to give evidence this week.

Louise vanished from her Hackham West bedroom, southern Adelaide, in January 1983 and her body has never been found. Advanced testing in recent years has allegedly found the DNA of accused killer Dieter Pfennig on her pyjama top....

The trial was adjourned late last year and resumed this morning in the Supreme Court in Adelaide.

The man accused of murdering Louise Bell is conscious and “doing crossword puzzles” in his hospital bed following a heart attack, a court has heard.

Defence counsel, however, have questioned whether Dieter Pfennig is fit to stand trial after his ordeal — prompting a judge to request his cardiologist come to court and give evidence.

Pfennig, 67, suffered a heart attack in his Yatala Labour Prison cell last week and spent time recovering in a medically-induced coma.

"International DNA expert Professor Peter Gill has given evidence at the Louise Bell murder trial about whether a sample collected from the 10-year-old's pyjamas matches the man accused of her 1983 killing Dieter Pfennig.

The body of Louise Bell, the 'shy and obedient' primary schoolgirl who vanished from her bedroom one night 33 years ago in the southern Adelaide suburb of Hackham West, has never been found.

Only her pyjamas, the yellow-flowered top torn and sodden but neatly folded near the letterbox on a neighbour's lawn five weeks after her disappearance, and her gold hoop earrings have ever been found.

Forensic evidence taken from her pyjama top, from a stain, a piece of fluff and a 'tape lift' has been analysed by laboratories in both South Australia and the Netherlands, with differing results.

Professor Gill, the UK and Norway-based scientist whose expertise in DNA proved that a woman posing as the daughter of Russian Tsar Princess Anastasia was a fake, has given evidence to the Adelaide Supreme Court trial via Skype.

The court was told Forensic Science South Australia generated a likelihood of 6,400 to one that the sample from the pyjama top was Pfennig's, ABC News reported."

Prosecutors have wrapped up their case against Pfennig, who is charged over the abduction and murder of Louise in January, 1983.

Much of the case against the 67-year-old relies on complex DNA evidence... It was originally subject to challenge but Pfennig's defence has now dropped objections to its admissibility.

The defence case will now proceed but the court has been told Pfennig will not give evidence with only one witness to be called on Friday.

'Inconsistent DNA results from abducted Adelaide schoolgirl Louise Bell's pyjama top creates a lack of clarity about the strength of the forensic evidence, a defence lawyer has told the South Australian Supreme Court.'

'In his closing address, one of Pfennig's lawyers, Paul Charman, told the court the forensic evidence was uncertain.

"We say the inconsistencies in the results causes there to be a lack of clarity about the strength of the DNA evidence," Mr Charman said.

"There are two questions in relation to DNA: one; whose DNA is it on the pyjama top, and the DNA evidence can never actually prove that it's only ever a likelihood ratio, and two; how did it get there?

"We say the prosecution has led a great deal of evidence in relation to question one and very little in relation to question two."

Mr Charman said how the DNA was transferred onto the Louise's pyjama top could not be known beyond reasonable doubt.

He said secondary transfer could not be excluded through Pfennig's daughter who played basketball with Louise.'

'During her closing address, prosecutor Sandi McDonald dismissed the claim DNA could have been transferred through Pfenning's daughter as as "ludicrous".'

'Ms McDonald told the court the prosecution case was more than just the DNA evidence and Pfennig had left a trail of evidence behind him over the past three decades.'

'Another of Pfennig's lawyers, Grant Algie QC, will address the court on the rest of the evidence on Tuesday.'

'Two inmates who alleged prison confessions were made about Louise Bell's abduction and murder were attention-seeking fraudsters, a lawyer has told an Adelaide court.'

'His lawyer, Grant Algie QC, said two prisoners who testified Pfennig allegedly confessed to murder were frauds with "extreme" personalities.

He told the Supreme Court former prisoner and Baptist minister Stephen Akpata was an intelligent, self-righteous and self-interested man.

"In my submission the character of the man is appalling, he's a fraud," he told Justice Michael David.

Mr Algie said another "long-term career criminal" was an unreliable witness with an antisocial personality disorder and narcissistic traits.

It was "objectively absurd" and totally implausible Pfennig would have confessed to him, Mr Algie told the court.

He said that prisoner had a Louise Bell case fixation and had Pfennig confessed to him in late 2005 it was "incredible and unbelievable" that he did not immediately go to authorities and tell people.

Justice David said he would treat both witnesses' evidence with great caution.'

'The long-running trial concluded with Justice David indicating he will deliver his verdict on November 14.'

Justice Michael David announced his guilty verdict to a packed public gallery full of family members, detectives and others.
He said in court that he wanted to "bring this whole ghastly thing to an end".
"I'm going to say something that's quite unusual, but I've thought a lot about it.
"During this period of time, between now and the sixth [of December], I say to your client through you: If he could tell the authorities where the bodies of Michael Black and Louise Bell are … then that may or may not affect my sentence."
 
Finally solved... I lived about 2 km from where this happy, scared the **** out of me. RIP Louise.
