Thank you minor4th for answering earlier , i find it difficult to see how the judge , in believing OP's version would still be able to consider the ear-witness testimonies as reliable...unless your line of reasoning is that she would consider Burger and husband only heard OP and not RS , at any point ,and Van Der Mewre yes heard a female voice at 1:56 but it wasn't RS and so forth....

Is that what you were saying? Just interested in how you are seeing this.

She's going to have to reject some portions of ear witness testimony and reconcile it with he physical evidence. I don't know how the judge will come out on this.

Today I returned an item to Sears. I stood in line for quite a while under the direct gaze of a lovely blonde model WHO LOOKED JUST LIKE REEVA! She was standing in a meadow, dressed in summer clothes, looking directly into the camera.

The slogan over her head said "Forever Free." I fought tears back for almost 15 minutes and finally had to leave.

It seems to me that the longer the trial lasts, the victim begins to fade away and before us is the murderer, alive in color... suffering. It almost begs for us to project our feelings about "poor Reeva" and make them "Poor Oscar," especially since something can be done about Oscar and Reeva is gone forever.

It bugs the hell out of me that Masipa was smiling and so happy after the announcement. Is she glad both sides are happy now or what?

well.. Masipa, and the two Assessors, whose job it is to brings the Facts of the matter to Masipa, who then applies the Law to the Facts precludes any wondering at all as to how Judge Masipa will 'come out' on this. It isn't an either / or situation. That's what she, and they, the Assessors are there for.. their mandate does not include them suspending their powers of logic or reason , or to reject ear witnesses testimony to reconcile with the physical evidence. .not much problem there.

Reconciling the ear witnesses testimony with the Testimony of the Accused , and the reverse , is where the worry( for those inclined to worry about this ) will begin, and end, with the detailed judgement.

No one knows what the judge will accept and what she will reject from the testimony. Not even you ;)

no one knows why she would reject earwitness testimony on a whim to fit a variation of versions by the accused, .. not even you have an explanation for that.

No I'm not. Where do you come up with that?

Again, you presume to know exactly how the judge is going to rule and I say again it's impossible to know.

I don't say how she will rule, I say how she DOES rule. she applies the Facts to the Law. the Assessors provide the collated facts TO the Judge so that she CAN apply the Law to them.


You are saying, you don't know how she 'will come out of this'. I say. she will apply the Facts to the Law.. YOUR theory is, she will reject certain facts ,etc. I say, the Assessors will have to 'reject portions earwitnesses" that is. the same portion, of the same witnesses together in concert ,and then get Masipa to accept that rejection of those facts and then apply the Law to the remaining facts..

I say. this isn't going to happen. It doesn't work like that.

This is what you wrote.. . I pointed out the obvious error in that theory. .

Masipa isn't going to reject any ear witness testimony unless both assessors present this to her. That is their job. Her job is to apply the facts the Assessors present as an ongoing process to her.

So your theory requires three people to reject the exact same portion of ear witnesses testimony, the exact same ear witnesses, too, naturally. . but you provide no explanation as to why this would be even possible, much less considered,? why?
