The Wyoming man authorities say kept a 7-year-old boy locked inside an outdoor cage -- including overnights and during rainstorms -- allegedly told deputies that he disliked the child but kept him in an outdoor cage to better ensure the child's safety, The Laramie Boomerang reported.

The paper reported that the man, Alexander Smith, is set to be in court on Thursday for a preliminary hearing. Jena Harman, the boy's mother, has already been bound over to district court. They were both charged with one count of child abuse and three counts of felonious restraint.

Jena Harman, the child's mother, and her boyfriend, Alexander Smith, face up to 20 years jail for allegedly caging the child outside their Laramie, Wyoming, home.


Police said the six-by-five-foot cage was made in June from cattle paneling and wooden snow fence with plywood covering half of the opening.

Neighbors said they sometimes witnessed the abuse, but were afraid to report it, fearing retribution by Smith.
The arrests came nearly a year after the first incident of abuse was reported. According to the Laramie Boomerang, the sheriff’s office had received complaints of child abuse and requests for the child's welfare to be checked on that dated back to August of last year.

An October 2013 incident report said the child was kept outside and not fed for a period of several days, during which he was forced to take shelter in a vehicle in foul weather, according to the Associated Press.

Couple Pleads Guilty

According to court documents, Jena Harman and her boyfriend, Alexander Smith, changed their pleas to guilty last month to two of four counts against them: child abuse and felonious restraint. The county attorney dismissed the other two charges of felonious restraint.
The couple could spend up to 10 years in prison for the crimes.

District Court Judge Wade E. Waldrip, who is from Carbon County, sentenced 32-year-old Jena Harman and 38-year-old Alexander “George” Smith to suspended prison sentences of three to five years.

As part of the suspended sentences, Smith and Harman will each serve 12 months in the Albany County Jail followed by five years of supervised probation. Harman will receive 175 days of credit for time she has already served, and Smith will receive 272 days of credit for his time served.

In addition, Judge Waldrip told Harman that she will be required to enroll in a treatment program after her year in jail is complete. She is also required to pay restitution for the funds put forward by Medicaid in order to care for the child. Restitution owed by Smith, if any, will be determined at a later date.
