One of Sacramento's worst cases of lack of co-operation with police has finally resulted in a murder conviction, four years after the shooting of a teenage girl.

22-year-old D’Andre Leon Monroe has been sentenced to 40 years to life for the fatal shooting of 15-year-old Aliyah Smith in 2010. The troubled teen had taken shelter in a friend's apartment after a fight with another girl led to a gang chasing her. When she peeked out of the window to see if they'd gone, she was shot through the head.

While Monroe was found guilty of second-degree murder, his co-defendant, Marcel Bullard Jr, also 22, was acquited of murder but found guilty of grossly negligent discharge of a firearm and burglaries. He was sentenced to nine years but will be released because of time already served and credits.

'Initially, 12 young people were arrested and charged with Aliyah’s death. Eight pleaded no contest to accessory to murder. Another pleaded no contest to voluntary manslaughter. Charges were dismissed for one.

Police detectives said it was one of the worst cases of lack of cooperation they’d ever seen, and the judge mulled the shooting’s circumstances before he sentenced Monroe and Bullard.'

Aliyah's mom spoke of her regret at the trial, that her last words to her runaway daughter on the phone had been 'I don't care, stay where you're at.' Despite that, she had gone out searching, and was in jail for DUI when news was broken to her that her daughter had been killed.
