12-year-old Davia Garth is dead and her mom, Sonya Garth-Gray is fighting for her life in the hospital, following what police say may have been a 'domestic dispute', in Cleveland, Thursday night. Rufus Gray, 59, has been arrested. He lived at the home in the 6900 block of Clement Avenue.

Judging by the photograph of his battered face, there was definitely some sort of altercation. I wonder if that happened at home or during the suspect's arrest?

The police report indicates that Gray lived at the home. Gray-Garth's son—Gray's stepson—was attacking the man when police arrived, according to the family member.

Court records indicate a lengthy criminal history for Gray, including a voluntary manslaughter conviction in 1989, and charges of kidnapping, assault and weapons infractions.

He's also been charged with felony domestic violence four times, the last time in 2012. According to court records, he was sentenced to two years of probation and released on Oct. 25, just five days before the alleged attack.

On Nov. 10, a Cuyahoga County grand jury indicted Rufus Gray for aggravated murder, attempted murder, felonious assault, possessing weapons while a convicted felon, domestic violence and aggravated burglary. Gray, Sonya Garth's estranged husband and Davia's stepfather, pleaded not guilty and is currently behind bars on a $5 million bond...

There was a history of abuse. In 2011 Sonya Garth was granted a domestic violence protection order, but later asked it be rescinded. Gray was convicted of a felony domestic violence charge in October 2012 for kicking and slapping Sonya Garth during an argument. Gray was placed on two years probation. He completed that probation five days before he allegedly killed Davia...

On Oct, 6, Gray was arrested. It was the fourth time since 2008 that Sonya had told police he threatened to kill her. Even though he was still on probation for the 2012 domestic violence felony, city prosecutors decided there wasn't enough evidence to charge Gray, Dissell reported.
