GUILTY OK - Uwe, 49, & Stefan Rushing, 14, murdered in their Lawton home, 20 Jan 2014

Thorsten Rushing calmly walked to the bathroom, slid on a pair of latex gloves and then spent the next “10 to 15 minutes” suffocating his little brother, Stefan Rushing, who’d already been shot in the head multiple times as he slept.

Those details were shared at a preliminary court hearing by a co-defendant in the case against Thorsten Rushing, 18, who is charged with first-degree murder in the deaths of his brother and father.

While Thorsten Rushing attempted to suffocate his brother, their father — Uwe Rushing — was more than likely already dead, testified Ethan Thompson, who hid in a closet at the Rushing home the night Stefan, 14, and Uwe Rushing, 50, were killed.

Witnesses suggested the motive in the killings appears to be money — specifically Uwe Rushing’s life insurance policy. Each of the witnesses mentioned the term insurance and said that in exchange for helping kill his father and brother, Thorsten Rushing offered gifts of money, vehicles and housing.

Two men pleaded guilty Wednesday in the murder plot of a high school classmate’s father and 14-year-old brother.

Ethan Thompson pleaded guilty to first-degree murder and conspiracy to commit first-degree murder in the case and was sentenced to life in prison plus ten years. Timothy Delahoy was sentenced to five years in prison for conspiracy to commit murder and two counts of accessory after the fact.

Police believe Rushing was the triggerman and tried to make it look like a home invasion with the help of four friends, who have all pleaded guilty and are serving time for their roles in the crime.

The opening day of testimony in the Thorsten rushing murder trial came to an abrupt halt Monday, shortly after one of his alleged co-conspirators took the stand.

Rushing is accused of shooting his father and brother to death in their home in Lawton. Monday morning’s opening statements at the Comanche County Courthouse followed four days of jury selection last week. Testimony is expected to last two weeks, but Monday’s session was cut short following an objection by Rushing's attorney.

Tuesday, one of the men who has pleaded guilty to helping Thorsten Rushing murder his father and brother took the stand.

In that testimony he said Rushing planned the murder of his father Uwe and offered money and guns to Bankston, Davis and Delahoy. He said they never discussed killing Stefan. Thompson said on the Friday before the murders occurred they attempted the crime but failed when Uwe noticed that Davis was on his back porch and called 911.

After the close call, Thompson says they told Rushing they were no longer interested in helping. He says Rushing told them that was unacceptable and began telling them about his new plan for that Sunday night.

Another surprise Wednesday at the Thorsten Rushing murder trial as two of the state’s key witnesses backed out of their plea agreements to testify against him.

Cody Davis and Wesley Bankston had both previously pleaded guilty to their roles in the crimes in exchange for their testimony. The judge ruled them both to be in contempt of court, and allowed the state to use previous testimony from Rushing’s preliminary hearing as evidence.

That wasn’t the only excitement in the courtroom Wednesday. Defense attorney Stephen Jones asked for a mistrial during testimony from the crime scene investigator, saying the information he was testifying to had not been provided during the trial. The judge refused to grant the mistrial, but did agree to limit the investigator’s testimony to what was written in his report.

The investigator’s testimony came as he walked the jury through chilling picture from the night of the murders, including images of the two victims. He pointed out several inconsistencies that he saw between the physical evidence and Rushing’s story.

Muriel Correa of the OSBI says the particles found on Rushing's clothing are from a discharged firearm, but there is no way to tell when or how they were put there.The murder weapon was also identified in court today along with the shell casings.

The state is still trying to pull witnesses to help prove that Thorsten was the one who pulled the trigger. The murder weapon was presented in court today and it was identified as a nine-millimeter handgun
